Jones represented the.petitioner who is seeking a special permit and variance to Allow a parking lot, two apartments, and six rental rooms., at 39 Pearl St. , Hyannis in a residence B-1 zoned district. The variance request concerns permission for six -rental rooms and two apartments in an existing single family dwelling; and -the special permit request concerns a parking lot at this location which would be used for. the patrons of the Asa Bearse -Restaurant on Main St. , Hyannis. Atty. Jones said that the Pearl St. property is now in a state of disrepair, has historical value, and should be renovated and upgraded. This large house is not suitable for single-family residence and the petitioner proposes to preserve its historic- significance and to make this structure I an asset .to the neighborhood. The property comprises 16,000 sq. ft. in an area which requires a . minimum lot size of 10,000 sq. ft. and a parking area would be established on this parcel of land as shown on the plan submitted with the filing. Twenty parking spaces would be maintained and closely supervised. The property can be considered unique to the zoning district due* to its location and shape and- all of the conditions necessary for the granting of a variance and special permit exist at the site. The public. good will be served if the parking lot is Allowed since this will lessen congestion in this area and the requested variance relief will .allow the upgrading of the-building.- The petitioner would have an apartment and three rental rooms on each of the two floors and a purchase and sales agreement has been entered into with the Bonds, owners of the property. . The Bond brothers and Rachel Bond asked that the petition be allowed and no one spoke in. objection. The Board took the matter under advisement. I discussed with Mr. Hoyt (12-6-95) the desires of the Town to renew the easement for the driveway portion to the lot. He has concerns, however, that he may be refused a permit to operate the 14 space parking lot that remains on his property. This same lot has been used by the public under the Town's easement for the past 10 years. His intention is to rent the spaces on a monthly or annual basis and not to be involved in daily parking fees. I have reviewed this matter with Art Traczyk and we are in agreement with the following observations: • A new owner may occupy this residence under the current B&B provision of our ordinance, (which requires owner-occupancy) and allows for the accommodation of up to 12 guests providing that all rights to the existing special permit/variance (1980-038) are surrendered or, • A new owner may operate under the existing special permit/variance (1980-038),which identifies two apartments and six rooms for let. An on-site manager would be required in order to satisfy the obligation of the original petitioner who,as manager of the former Asa Bearse Restaurant was noted to often be in very close proximity the property. • Our review of the 1980-038 decision and the information you provided with your inquiry clearly indicates that the current operation does not comply with the requirements originally imposed or those required under the current B&B ordinance as an as-of-right operation. Jones represented the petitioner who is seeking a special permit and variance to allow a parking lot, two apartments, and six rental rooms at 39 Pearl St. , Hyannis in .a residence B-1 zoned district. The variance request concerns permission for six rental rooms and two apartments in an existing single. family dwelling; and .the special permit request concerns a parking lot at this location which would be used for. the patrons of the Asa Bearse Restaurant on Main St., Hyannis. Atty. Jones said that the Pearl St. property is now in a state of disrepair, has historical value, and should be renovated and upgraded. This large house is not suitable for single-family residence and the petitioner proposes to preserve its historic significance and to make this structure an asset to the neighborhood. The property comprises 16,000 sq. ft. in an area which requires a minimum lot size of 10,000-sq. ft. and .a parking area would be established on this parcel of land as shown on the plan submitted .with the filing. Twenty parking spaces. would be maintained and closely supervised. The property can be considered unique to the zoning district due to its location and shape and all of the .conditions necessary for the granting of a variance .and special permit exist at the site. The public good will be served if the parking' lot is. allowed since this will lessen congestion in this area and the requested variance relief will allow the upgrading of the building. The petitioner would have an-.apartment and three rental rooms on each of the two floors and a purchase and sales agreement has been entered into with the Bonds, owners of the property. The -Bond brothers and. Rachel Bond asked that the petition be ,allowed and no one spoke in objection. The Board took the matter under advisement. The Board voted unanimously to grant the petitioner a variance for six rental rooms and 'two apartments, at the Bond property, 39 Pearl St., Hyannis in a residence B-1 zoned district and found that although there would not be a family in residence at. this dwelling which is _a requirement in the by-law for 'the six rental- rooms, 'the petitioner's restaurant business which is close by, will enable him to make frequent inspections of this property to ensure that the supervision usually provided by the family in residence, will be provided. Evacuations were in progress. A 2nd Alarm was transmitted upon arrival bringing Mutual aid to the scene from neighboring departments. Heavy fire conditions required master streams from the Hyannis and COMM ladder companies as well as several handlines to be bring the fire under co»trol.Dozens of personnel were on scene for several hours. Of interesting note,this fire was on.the final night shill of Hyannis:Firefighter'Danny Clough who drove Engine 823 to the (ire and retired the following morning at 0800 hours after 36 years with the Hyannis Fire Department.
