Dear Mr. Ells, Manager,Town of Barnstable, My.neighbors and I are writing for your awareness and assistance in the following, and have cc:d other parties that should also have awareness, oversight authority and/or responsibilities pertaining to below. State and condition shared below has been ongoing for at least 6 months but In nearly all instances for years at these properties. It is a growing trend negatively impacting family, residential properties below in our neighborhood, and perhaps more importantly, neighboring residential properties and the neighborhood as a whole. • Residential properties being used as a central point for business, including business/commercial vehicles/equipment on the property as well as advertising signage of the business • Residential properties that appear vacated, abandoned,or otherwise are not maintained; overgrown brush/vegetation overtaking the property and structures in some cases;Same obstructing abutting sidewalk/walkway in some cases • Residential properties being rented short-term and frequently, in part(e.g.a room)or whole;sometimes as many as 5-7 vehicles parked in driveway, roads or in yards; Concern of exceeding occupancy limits Properties below have been observed to have at least oneof above conditions: -230 Scudder Ave 245 Scudder Ave 5 Sylvan Dr r// 16 Sylvan Dr 78 Pitchers Way 20 Arbor Way 52 Pitchers Way 53 Arbor Way 65 Sylvan Dr 73 Sylvan Drive 7 Briarwood Ave 142 Pitchers Way 93 Arbor Way It is my understanding that Town regulation/code touches on one or more of these conditions, nuisance, violations at these addresses, though is not limited by just these: Chapter 170, Rental properties 160, Problem properties, chronic 192, Signs 224,Vacant&foreclosing properties 54, Building Premises Maintenance 240,Zoning Several neighbors and I have discussed selling our properties and moving to another village or town presumably when:these conditions are not the sustained/growing issue they are here before things continue to worsen the neighborhood and property resale values. If one cannot afford to own a single-family, residential property/home:without a til f tin rooms;or because the cannot afford the most minimal/basic turnstile o renting y upkeep and maintenance of that property;or without operating and advertising business services from that residential property, than perhaps one solution they should consider is renting themselves and leaving home ownership to those who can,and who are interested in all the responsibilities that go along with property ownership-rather than cutting corners and skirting lawslcode, and ultimately adversely impacting the neighbors and slowly dragging down our (once)quiet residential community, never mind the property values from resale perspective. I i Additionally, I wanted to call your attention to the increasing and persistent traffic issue in our neighborhood.I am told that neighbors have submitted complaints, and have visited the Barnstable Police Department in the past to request relief in some form. Vehicle traffic on Pitchers Way and Scudder Ave regularly experiences dangerous speeds, and far exceeding that for the population density that exists in our neighborhood, and for the pedestrian traffic that area children, bikers and dog walkers use it for. From Scudder and Marston Avenues intersection to the West End rotary& Pitchers Way and West Main Street intersection to Scudder Ave,traffic more often than not reaches and exceeds 45-50mphl While it may be significantly worse during peak season months, it exists all year long. I think it's reasonable to understand that these are primary roads that see a lot of traffic, but the consistent traffic speeds we experience is both absurd and dangerous for our neighborhood and the people who live and visit here. May we make a suggestion of 1)increased police, speed trap monitoring presence 2)speed bumps/tables(either permanent or temporary)and/or 3)the traffic study resources needed(if any)to install solar powered signage with speed limit with real-time speed alerts of traffic to drive proactive behavior changes by drivers-like in Hyannisport,Osterville and South St in Hyannis Any other solutions or suggestions are needed and welcome toward the goal of improvement and safety. I welcome your review of the matters, and know you will find status as described. I hope that the Town can assist with addressing and responding to the matter such that conditions above are curbed and prevention of reoccurrence such that this community can be safely maintained. Sincerely yours, Voting neighborhood residents Message Page 1 of 3 Anderson, Robin i From: Anderson, Robin Sent: Friday, August 19, 2016 3:58 PM To: 'Robert Sydney' Subject: RE: Dobbie Property 142 Pitchers Way Hi Mr Sydney I complexly understand your frustration. Please understand that with Mr. Dobbies being arrested, tried and incarcerated we have been unable to ticket him. We cannot tow&store the vehicles at his expense as he has not had due process. We can't impose an expanse on him without affording him an opportunity to cure it. He is currently unable to address the matter for other reasons as well(which I am not at liberty to disclose). These events played out during the course of our investigation and it greatly impeded our ability to address the issues properly. That being said,we are trying to find another alternative and it means that we have to be a little more creative. I am working on an idea with the police officer assigned to this case but I can offer no promise for its successful implementation. I am unsure about the police response to that address as you described. I can only say at this point it most likely involved the occupants in a domestic situation as the property owner remains locked up. I have not heard of any criminal reports there lately. Again, thank you for your patience. py6Le Robin C.Anderson Zoning Enforcement Officer 200 Main Street Hyannis,MA 026oi 5o8-862-4027 -----Original Message----- From: Robert Sydney [mailto:rfsyd@yahoo.com] Sent: Friday, August 19, 2016 2:48 PM To: Anderson, Robin Subject: Re: Dobbie Property 142 Pitchers Way Ms. Anderson: Thank you for your prompt reply and.for your continued efforts and those of other departments in this matter. do have one follow-up item and one question. 1) A neighbor informed me this morning that the police pulled up to the Dobbie house this past Saturday, and (according to her) blocked off the street briefly and raced into the house. I have no further information on reason for this. 2) Three or more unregistered cars have been parked on the property for over two years at least. I do not understand why the"proper authorities"are unable to make a definitive decision to remove the vehicles in-all that time. As a former city attorney for Cambridge, MA, I know that it does not require two years of legal research to ascertain the municipal or DMV authority to act. I request the contact information of those "authorities,"as I would like to discuss the matter further with them. 8/22/2016 Message Page 2 of 3 Thank you again. The dumpster has been delivered in response to our directive to clean the property. (This is a good development.) The unregistered cars are in Mr. Dobbie's name and do not belong to the current occupants. As you are aware, the property owner is incarcerated. We have not yet been able to secure approval from the proper authority to have the vehicles towed. However, the request has been made and is currently under consideration. It is most unfortunate that the apparent lifestyle of the occupants is not compatible with most neighborhoods. They have been advised and DCF has also been made aware that the occupants must relocate. It is difficult to secure a home/lease for an affordable unit that can accommodate the number of occupants residing at this address. DCF is actively working with the occupants to this end. I cannot hazard a guess as to when that move may occur. Please know how sorry I am that progress seems to move at a snail's pace.I thank you for your patience with this matter. Right now most of what needs to happen is out of our control. Be assured that we continue to work with other agencies in order to resolve these matters. I do anticipate a definitive answer on the unregistered vehicles soon.Certainly, the property appearance will be greatly improved with just that action. Thank you again for your patience. pgbuc Robin C.Anderson Zoning Enforcement Officer 200 Main Street =. At that time you suggested the neighbors sit tight and that we would see significant improvements at the Dobbie property. I wish to note that little has changed. Yes, a dumpster now resides in the driveway, but trash remains strewn about the yard including tools, a clothes dryer, and the lead-acid car battery which hasn't moved since May. (I believe it poses a hazard to children). I and my fellow neighbors are disappointed in the progress to rectify this situation. 8/22/2016 Message Page 3 of 3 Also, I wish answers to the following: 1) how many unregistered cars are allowed to be parked on residential property in this town? If the answer is only one,why can not the other two be impounded? 2) Are the current occupants squatters? If that is the case, why can not the town appoint a receiver for the property(during Mr. Dobbie's absence)and evict the occupants? Thank you for your attention to this matter. At that time, I spoke with Jeremy Silano and Katherine Rayle who produced a letter reportedly authored by you allowing them to reside there for an unspecified period of time. It should be noted that while the visit was conducted, there were several health code violations noted by BOH members and Mr. Silano was advised how to address these issues. Arrangements were made to have a dumpster brought to the property to remove the trash and material. Additionally, I made note of several unregistered MV's, an unregistered boat and trailer along with two jet skis placed-in the side yard, plainly visible from the roadway. Since that conversation I've done a little investigating at the Barnstable Registry of Deeds and over the phone to various parties, and offer the following for your records. Mortgage issue and possible foreclosure remedy: 1. Although the record shows no first mortgage, there is now a $393,000 FHA-backed reverse mortgage on the property. This mortgage was recorded on 2/25/2015 at BK 28700, page 221. There is a HUD mortgage filed on the same date at BK 28700, page 234. The people at the Registry told me that this is basically the same transaction, and represents HUD/FHA backing on the loan should there be a default. 2. The FHA case number listed on the mortgage is : 251-5418288-962; The loan number is 3332345814 3. The reverse mortgage lender was"One Reverse Mortgage, LLC" (the same company advertised on TV by Henry Winkler...aka the Fonz). This mortgage was then transferred to a company called "Reverse Mortgage Solutions" tel: 888-918-1110 . This company is responsible for ( ) p Y p servicing the loan, which includes direct payment of property taxes and insurance. It is also responsible for assuring that the borrower(Dobbie) is complying with all obligations of his mortgage agreement. 4. 1 spoke with a representative of Reverse Mortgage Solutions, and he did indeed indicate that they are the servicer of this loan. I gave him a brief overview of the situation. We discussed the owner's contractual obligations under the mortgage. Failure to comply with those conditions is a basis for foreclosure. Among the duties of the borrower is to maintain the property in good shape and (most importantly) that the borrower or spouse (of which there is none here) must not be vacant from the house for more than 12 months(renters or squatters do not suffice). I explained the incarceration situation and we agreed that this situation was certainly"not living in the house." He said that their company has a risk assessment team whose job is to investigate the integrity of the underlying collateral (the house). I informed him that the , Barnstable Building, Health, and Police Departments were all familiar with this property. I encouraged them to contact you folks.... So you hopefully you will be hearing from them. 5. If Mr. Dobbie is going to be incarcerated for more than 12 months, I suggest the town support and encourage the mortgage servicer to foreclose on the property. Additionally, I believe Reverse Mortgage Solutions should be directed to clean up the property now; they might even be willing to go beyond the minimum state sanitary code requirements in order to preserve the equity in their collateral. Also, if there are squatters, they have the authority to evict them. ti Municipal Remedies J 1. As you know, Mass.General Laws, c. 111, sec. 1271 allows a municipality to seek(in court)the appointment of a "Receiver" to manage a neglected or abandoned property. Such a Receiver can act as a property manager to clean up the property and evict squatters if necessary. 2. Mr. Dobbie's incarceration is tantamount to abandonment of the property, at least as long as he is in lock-up. The property clearly is in decline with the attendant health and safety issues known to us all. 3. 1 request that the town law department review this matter and be encouraged to file a petition to appoint a Receiver for the property. This process could proceed simultaneously or in collaboration with the Mortgage servicer's actions discussed above. You might also direct the law department to review case law suggesting that the failure to properly maintain property, such as Mr. Dobbie's lack of care, reduces the value of neighboring properties. Rattigan v Wile 445Mass 850(2006). Failure of the town to address these issues could lead neighbors to petition the Board of Assessors to reduce property assessments of these neighboring properties. 4. The state sanitarycode refers to "rubbish" 105 CMR 410.020 as"combustible and non- combustible ( ) s o combustible waste materials..." and states that the list of materials"includes but is not limited to" a number of items. If some of the items strewn about Mr. Dobbie's yard do not fall into a specifically labelled item, I suggest that the collective detritus falls within the "...not limited to" definition. Also, as you know, if Mr. Dobbie is renting the premises, he is required by sec. 410.600 to provide adequate storage facilities for rubbish, and the occupants are required to t properly place the rubbish in those containers. 5. Finally, it is my understanding that only one unregistered automobile is allowed on residential property. If this is the case, the town should immediately remove and impound the excess unregistered vehicles. Thank you for your consideration. r a , t ,, " ':.cam y 1 _.• Sq :i`S _ .•i. Thanks. Jen Sent from my iPhone Begin forwarded message: From:"Mary White"<mar a mmtcenter.com> Date:October 19,2015 at 10:22:54 PM EDT To:<ienlcullumnvahoo.com> Subject:Complaint re 142 Pitchers Way Hi Jen, Thanks so much for taking the time to talk with me today. As I said,my husband and Lare very concerned about the escalation of tunnoil that is happening in the house across the street from us at 142 pitchers Way-We live at 135 Pitchers Way. This past year things have been especially bad.The owner of the property- Mr.Richard Dobbie has been in and out of jail repeatedly. He returns each time with"friends"who take up residence at 142.It appears that these 10/20/2015 Message Page 2 of 6 people are on parole.Let's just say many are unsavory characters as is evident from the state of the property-no one takes care of it,they dump their trash and random items all over the yard as you can see from the attached photographs. Over the summer when we had our windows open we would go to bed listening to escalating arguments that took place in the front yard. At times there have been as many as 7 people staying there, all"friends" that Mr.Dobbie has met in the correctional facility, all wrongly accused or in the wrong place at the wrong time per Mr.Dobbie-essentially all "good"people. The following report really has us concerned as it makes us wonder if any of these unstable, frequently intoxicated people(both men and women)have access to a firearm and is there one on that property? httl2://m.cUeoodtimes.com/article/20151014/NEWS/I 51019696 If we weren't already overly concerned this past weekend put us over the edge.We have a 22 FT sailboat stored in our side yard.We noticed mid-morning Sunday that the companionway was open.Long story short,it became clear to us that someone had unstrapped the swim ladder, climbed aboard the boat, hung out there smoking with no respect for where the ash or cigarette butts went(all over the vberth cushions)and used the portable toilet which we then had to clean out(It had been winterized)We surmise that someone slept there. So essentially trespassing and breaking and entry. I did call the police and reported this. What concerns us most is that Mr.Dobbie's latest transgression appears more serious than previously and he may soon be in prison for some time.In that case who will we have for neighbors?Who decides who lives in his house in his absence, and will deal with problems which occur? It has essentially become a half house for parolees in the middle of a residential area. Jen,it makes us realize that this situation at 142 Pitchers way is on a fast pace to a worse place then it already is. We are now realizing the danger that exists feet from our own door and the possibility that if someone would climb up into our boat what is to stop them breaking into our home and how unnerving all this is to me especially as there are times my husband is away from home on business. We moved to Hyannis almost 10 years ago because we love Hyannis. We both volunteer in the community,my husband with the Cape Community Business Partners and our dog and I in the companion animal program-her favorite place to visit is the Barnstable community center day care program. We love our community and don't want to move but don't want to live in fear every day and across the street from a dump. We do not know where to turn to get help so I appreciate you helping us out Sincerely, Mary White&Chris Dixon Mary White LMT Massage Muscle Therapy www.mmtcenter.com 978-807-8245 "you can't change the wind, you can however adjust your sails" -----Original Message----- From:Mary White fmailto:marypmmtcenter.coml Sent:Monday,October 19,2015 9:33 PM To:Mary White Subject: 142 10/20/2015 r a, Message Page 3 of 6 v ° '40 ., .f. - , >r r t. a e f u E Alf, >r Y 10/20/2015 Message '. •- 4 of• t k w wrt a. wl ! i B 10/20/2015 Y a j T A+ I r j / , 1 Message ` . . HYANNIS, MA 02601 i i i I I pTti DATE: May 8. 2015 TO: Building File FROM: R. Anderson, Zoning Officer RE: Complaint—Used Car Lot LOCUS: 142 Pitchers Way, Hyannis Inspectors: Patrick Franey,Bob McKechnie I received a complaint concerning the creation of a used car lot in a residential neighborhood on Pitcher's Way. The caller also stated that the owner/occupant was creating an apartment in the basement and the work was being without permits or approval. Subsequently, I reported to the site with Bob McKechnie. We found 7 unregistered cars and one unregistered truck parked by the dwelling. The cars appeared to be lined up for display on Pitcher's Way in the same fashion as a small used car lot. A review of aerial photos on line show this same area was wooded and green as recently as last summer. The owner apparently clear cut the area and created a defined graveled parking lot. He also provided a walking area and outlined the border with cobblestones resulting in the unmistakable appearance of a commercial site. There are three parking areas on site—the proper driveway by the kitchen door, the newly created display area fronting Pitcher's Way and another area separated by a mounded landscaping feature that accommodated two additional vehicles (of the eight referenced). On the left side of the dwelling, a new entrance to the basement was created directly behind the side door to the primary dwelling. A large shed was placed at an angle off of the driveway proper. Abutting the sidewalk was a pile of firewood and sign that advertised that is for sale and warning thieves that the site is on camera and being recorded. In fact, a sign was posted on the front door alerting visitors to the use of surveillance cameras. Since our initial visitation, I have received at least three or four additional calls complaining about this property and the commercial uses. One caller declared that the property owner was heard to be bragging about his intention to repair cars and sell them from this location as well as creating a basement apartment. The debris strewn about the side and rear yards was said to have been removed from the basement as he readied the area for the new apartment. Prior to our departure, Bob posted a stop work order on the window of the new basement entrance (window facing Pitchers). Usually, the bright orange sticker would result in a phone call inquiring or denying work that was being done without a permit. We have had ` no communications with the property owner. Later, I discovered that Patrick Franey had been to the site a few weeks earlier in response to a complaint about work without a permit. He indicated that her had spoken to the property owner and had been admitted to the basement area. This was prior to the the display cars. He found the owner doing sonly cosmetic work in the basement. In retrospect, that complaint must have been the result of the owner's bragging about his intentions. The inspection occurred prior to the commencement of any actual work or site improvement. May 11, 2015 Mr. Dobbie, the property owner came in with his tickets. He sought paperwork to register his shed and was provided with the set-back figures in order to be in compliance with the zoning requirement for placement. He told me that the tickets are "bullsh_C and has an agricultural exemption. According to Mr. Dobbie, the agricultural exemption also exempts him from the ordinance that limits unregistered vehicles to just one. I asked him how big the subject lot is and where he grows his vegetables. He responded that the lot is .25 acre and he grows vegetables on this lot and another property nearby where he lives. I advised him that he does not have an agricutlral exemption on this lot and that an agricultural exemption would not allow him 7 or 8 unregistered vechicles on this property. He started yelling that he hates this town and he's moving to Vermont and taking all of his businesses with him. He started yelling about going to see "Tom" immediately and clarified for me that Tom is the Town Manager. He left the tickets on our counter. HOMEOWNER'S EXENIMON The Code states that "Any homeowner performing work for which a building perinit is requhrd shall be exempt from the provisions of this section(Section 109.1.1 -Licmising of construction Supervisors);provided that if the homeowner engag es a person(s)for hire to do such work, that such Homeowner shall act as supervisor.,. Many homeowners who use this exemption are unaware that they am assuTning the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supeivisor is ultimately responsible. To ensure that the bomcowncr is Mly aware of his/her responsibilities, many communities require,as part of the permit application. that the bomeovencr certify, that he/she understands the responsibilities of a Superyisor. On the last page of this issue is a.fDrm currently used by several towns. You may care t amemd and adopt such a forralcertifii cation for use in your community.
