This letter is to notify you that after our investigation it has been determined that the gas service 43
(5/12/18),56 (5/14/18),64 (5/22/18) Pleasant St,Hyannis and 86 South St(6/24/11),
Hyannis were found to be cut-off.
This letter DOES NOT preclude the excavator or homeowner from calling 811 before commencing any
work. State law requires anyone planning underground excavation work to notify local utilities by calling
811 to get your underground lines identified for you prior to doing any digging. The call to 811 is the
LAW and must be made in advance of starting work. This confirmation letter of a gas cut-off DOES NOT
relieve the excavator of making the call to 811. It is a State Law requirement.

As you are aware,the structures"that comprise the site now known as Sea Captain's Row (specifically;
<43; 441 56, 64, 66 Pleasant Streefand two large structures at 86 South Street) have been'on the Hyannis Fire
Department's Abandoned& Dangerous Buildings List since June of 2014. When these properties were
occupied they were maintained at minimum levels: Now, after four years of inactivity they areAangerous.
A recent inspection of these properties finds the buildings-in a state of serious disrepair. All of these
buildings are unused, uninhabited (with the exception of those who break in), open to the weather and for all
intent abandoned.. Some efforts have been made to secure`the buildings but,this is an`ongoing battle as they
are often broken into: Currently,the lots have not hadaccess restricted to them. and are being used as a
dumping ground.-mattresses,tires and other.debris is strewn about the lots and the lots are overgrown with
brush: In some cases,this`debris.is at or very' near the lot lines ex osin adjacent ro `erties and occu ied

structures to potential harm in the event of afire Thislocation provides numerous locations for vagrants to
hang out or otherwise use these sites.There is no consistent supervision of these sites.Pleasant Street:..
receives a fair amount,of.foot traffic by:pedestrians walking,to,the:Steamshiv Authority terminal from the,

Main Street area and its'various transportation hubs:Also,a commercial parking lot is still being operated at
53 Pleasant Street.This lot brings foot traffic to the area year-round These lots are an`enticing cut-thought to
gain access to the ferry and harbor;area.
Back in November of 2017,when.the discussions regarding the Sea Captains Row project was in the'fore'front .
of local news, Katheleen Conti.of the Boston Globe toured the site and wrote in her article:on the project; .
"In reality, Sea Captains Row is part cf the underbelly of Cape Cod that most tourists never see•a strip
neglected buildings, a hangout for homeless'people and drug addicts, littered with used needles- evidence
of;the grip of the opiod epidemic on the Cape The rich maritime history.is hidden behind boarded up houses
and parking lots for visitors of the nearby ferry."

We have deemed all of these,structures_to be especially unsafe in,the event of fire.- Militating
conditions include;
- The mix of various methods to board up, not jcompliant with arson prevention board up methods.
The proximity of some of the structures to occupied.buildings.
The damage to the buildings that will allow for rapid fire,spread through the structures.Ceilings
and walls are compromised and missing in'various locations.
- The structures have broken outwindows,'open windows, and holes in the roof which will provide
sufficient ventilation to allow afire to grow rapidly: ;
In an effort to limit access many fire.escapes have been removed and the doors not properly:,
secured and blocked.
The structures have damage that present a collapse,hazard presently. This will only be exacerbated
under fire conditions.
Two structures have chimneys that appear to,be in danger of collapse.
will provide you with the Fire Department sheets that detail conditions for each address.
Current development plans call for all of these structures to.be"demolished to make way for.the new
residential structures.The developer,had stated that the structures are "in pretty bad shape" during the
regulatory process. We desire to make the site safe for the neighborhood.,those passing through the'-area, as
well as firefighters and EMT'_s and police officers who may be summoned to these sites.. :
On December 4, 20181 emailed the property owner fo see what plans they have for the siteand the
timeline for resolution of these issues. .1 have not"received the courtesy of a response�to my inquires.
Our goal had been to work with the.developerto get,these buildings.downbefore another winter
season makes them more enticing:to our-vagrant..' population.'We desire to work with you-and theproperty
owners to make the site safe in the best and most cost-efficient manner available. Your assistance in

EMERGENCY CONDEMNATION AND ORDER TO VACATE
Finding of Unfitness for Human Habitation and
Determination of Immediate Danger
The property owned by you located at 43 Pleasant Street, Hyannis, was inspected on
November 14, 2003 by David Stanton, RS, Health Inspector for the Town of Barnstable,
after receiving a call from Hyannis Fire and Rescue.
Based on the results of that inspection,the Barnstable Health Department finds that the
dwelling is unfit for human habitation. Pursuant to M.G.L c. 127B and 105 CMR
410.831 (D),the Health Department further finds that the conditions within the dwelling
are such that the danger to the life or health of the occupants of the subject dwelling is so
immediate that no delay may be permitted in making this finding.
The following violations of 105 CMR 410.00, State Sanitary Code II: Minimum
Standards Of Fitness For Human Habitation were observed:
105 CMR 410.750: Conditions Deemed to Endanger or Impair Health or Safety(I)
"Failure to comply with any provisions of 105 CMR 410.600,410.601, or 410.602
which results in any accumulation of garbage, rubbish,filth or other causes of
sickness which may provide a food source or harborage for rodents, insects or other
pests or otherwise contribute to accidents or to the creation or spread of disease.
There was a large accumulation of garbage,rubbish, filth and other causes of sickness
present at the location. There were several cockroaches observed at said location.
Based upon these findings any and all occupants of the room inspected are hereby ordered to
vacate and the landlord/owner is ordered to secure the subject dwelling within 48 hours of
receipt of this order. If any person refuses to leave a dwelling or portion thereof,which was
ordered vacated,they may be forcibly removed by the local Board of Health(M.G.L. c. 127B),or
by local police authorities at request of the Board of Health.

Furthermore, anyone who fails to comply with any order of the Board of Health may be
subject to fines of not more than$500. Each day's failure to comply with an order shall
constitute a separate violation.
Once vacated this dwelling may not be occupied without the written approval of the
Board of Health. Please call the Board of Health for a reinsepection of the room once it is
cleaned and ready to be occupied again.

Dear Mr. McEvoy:
On May 12, 1994 you entered into an agreement for judgment with the Town in which
you agreed not to park any cars or use any signs on Lots 122, 133, 134, 135, 137, 142,
and 268. This agreement resulted in your being allowed to use Lot 121 only,which is the
lot your shed is on.
Recently we sent you a letter about this;however,your use of these lots continues.
Additionally,your use of the lot behind the hardware store and the use of Lot 137 as an
entry point for all your lots has added to the confusion.
