This agreement resulted in your being allowed to use Lot 121 only,which is the lot your shed is on. Recently we sent you a letter about this;however,your use of these lots continues. Additionally, your use of the lot behind the hardware store and the use of Lot 137 as an entry point for all your lots has added to the confusion. Hyannisport, MA 02672 April 19, 1996 Ralph Crossen, Barnstable Building Commissioner 367 Main Street Hyannis,MA 02601 Dear Mr. Crossen: The Hyannis Civic Association has discussed alleged unauthorized commercial parking lots that are operating in the east end of the village of Hyannis. Of major concern have been the illegal parking lots operated by Maurice McEvoy. It is widely recognized that the Town of Barnstable has expended a great deal of time, energy and money in the past to bring these lots into compliance. Violations,however are ongoing. Relative to the McEvoy lots,there are at least three(3)areas of concern that have been discussed by Association members and are itemized below: I In 1980 a special permit was granted to Maurice McEvoy to operate a commercial parking lot at 53 Pleasant Street(Assessors Map 327 Lot 121). Attached is a copy of Appeal #1980-30 from the Zoning Board of Appeal. Based on the Board's findin ,,conditions were placed on this approval. To date,those conditions have not been met. Thd"are numerous sign, violations. Also at the time this permit was granted,the lot was vacant. There now exists a, structure(building)without the benefit of any permits and constructed within the front yard set. back. There is no plot plan that indicates how 68 vehicle spaces can be located on this lot. If zoning by-laws are to be observed, conditions based on the appropriate findings must be enforced. 2. On May 12, 1994, there was a PERMANENT wiuNcnoN agreed to by the Town's Attorney and Rose and Maurice McEvoy (see attached CA No. 93-621). The terms and conditions agreed to continue to be violated. 3. Mr.McEvoy has used Assessors Map327 lot 243 for commercial parking. Assessors records indicate that this lot is owned by James Burke. April 27-29 is Daffodil weekend on Nantucket and both legal and illegal commercial parking lots will be in full operation. We realize that you have had a full plate since coming on board,but we are hopeful that you will personally observe these lots for compliance and with particular attention to lots currently operated by Mr. McEvoy. It is a total waste of the towns time,energy and money,if after obtaining an agreement for judgement in Superior Court,there is no enforcement. Please advise the Association as to what action is being taken to bring these lots into compliance. Thank you for your consideration in this matter. Joseph Reardon represented the petitioner who is seeking permission to establi'gh a commercial parking lot on Pleasant St. , Hyannis in a Residence B-1 zoned district. The property in question is directly across the street from the petitioner's residence and is located between a private way and Vachon, Inc. The property was used for many years by Mr. Covell who operated a rooming house with considerable more persons than the allowed six lodgers by the family in re- sidence. The building had historical significance and in 1978 was purchased by Mr. McEvoy. In 1977, the building was fire damaged and in 1978 after Mr. McEvoy purchased it, additional fire damage was so severe that the building had to be razed. The foundation hole had to be filled in at a cost of more than $4,500. An outstanding mortgage of $28,000 incurred by Mr. McEvoy at the time of purchase is still being paid monthly. Although fire insurance was carried on the property, the insurance company is awaiting a report from the State Fire Marshall since it is suspected that arson may have caused the second fire. Atty. Reardon said that Pleasant St. can be considered unique since it is divided into four zoning districts even though it has a relatively short length of 800 ft. to 1000 ft. Business, Professional Residential, Business Limited C and Residence B-1 are the four zones. The Heritage House is there because of a non-conforming use. Due to the surrounding commercial properties and its location next "to a private way, this land has further uniqueness. The petitioner is suffering financial hardship which is beyond his control. . Mr. Reardon stated that the Town Engineering Dept. has approved the parking plan submitted by Mr. McEvoy and the petitioner could be granted a special permit for a change of a non-conforming use. The private way abutting this property is approximately 30 ft. wide and would not be used for access to the parking lot. The petitioner is agreeable to planting _a privet-...hedge on the nort ly P�Qf the property__Abutting the....private _way. The parking lot would have 68 parking spaces. The petitioner does not intend to pave the area at this time. Bill Sperry of OCD asked that a green island be established with plantings to improve the aesthetic appearance of the parking lot. Mr. Gordon Litchard of 125 Pleasant St, spoke in favor of the petition due to the need for parking in this area. Miss Constance Fortune spoke in fa w r provided that the privet hedge was planted on the northerly side and no use was made of the private way. However, this property had a prior non-conforming use as a boarding house and therefore application can be made for a special permit to change the . use to a parking lot under Section P. (6) of the zoning by-laws. The prior, non-conforming use was not intentionally abandoned nor was it discontinued for a period of two or more years. ' The Board found that public parking is inadequate in this area and the petitioner_`-s proposal to create a public parking area would help to alleviate congestion in this highly congested area of Hyannis. The change of use from a non-conforming boarding house to a parking lot would not be detrimental to the neighborhood and would be in keeping with the spirit and intent of the zoning by-laws. The Board voted unanimously to allow the petitioner a special permit for a parking lot at 53 Pleasant Street, Hyannis, subject to the following restrictions: 1. The private way abutting the parking lot shall not be used for ingress or egress to the parking lot nor shall vehicles be parked anywhere on this private way. 2. A privet hedge shall be planted and maintained along the entire northerly side of the parking lot, abutting the private way. 3.
