ARRIVED ON LOCATION SIDE i OF A REALTY OFFICE WITH TWO APARTMENTS IN THE REAR BASEMENT AREA,WE FOUND THE REPORTING PARTY IN THE APARTMENT ON SIDE 2 OF THE BUILDING,WE WERE MET BY MR.JOSHUA BASSETT, MS.AMY BOURGEOIS AND HER BABY WHO POINTED OUT TO US AN OUTLET IN THE LIVING ROOM.THEY STATED THAT WHEN MS.BOURGEOIS ATTEMPTED TO UNPLUG A"BABY MONITOR"SHE NOTED SPARKS INSIDE THE OUTLET. MR.BASSETT STATED THAT SHORTLY THEREAFTER HE HEARD"CRACKLING"COMING FROM THE OUTLET AND NOTICED IT WAS SPARKING AND HAD SOME BLACK SMOKE EMITTING FROM IT,HE ATTEMPTED TO REMOVE AN EXTENSION CORD PLUGGED INTO THE TOP RECEPTACLE;WHICH SUPPLIED POWER TO A LIGHT,BUT THE PLUG WAS "STUCK" IN THE OUTLET. THEY THEN CALLED US. UPON INVESTIGATION WE NOTED A BLACK SOOTY DISCOLORATION AROUND THE OUTLET.THERE WERE NO SPARKS NOTED AND THE WALL AND OUTLET AREAS WERE COOL TO TOUCH.MR.BASSETT SHOWED ME A SMALL UTILITY ROOM, WHICH SEPARATED THE TWO APARTMENTS,WHERE A CIRCUIT BREAKER PANEL WAS LOCATED,MY IMPRESSION is THAT THIS IS A SUB-PANEL(BECAUSE THERE WERE NO MAIN SHUT OFFS.NONE OF THE BREAKERS IN THIS PANEL WERE TRIPPED.I SHUT OFF BREAKER#6 WHICH READ"LIVING ROOM". FF OBERLANDER AND MYSELF DETERMINED THAT THERE WAS STILL POWER TO THE OUTLET AFTER SHUTTING OFF THIS BREAKER,I THEN MET WITH THE OTHER TENANT, MALKIT THIND(790-2677)AND EXPLAINED THE SITUATION T O HIM.HE LED ME INTO HIS BEDROOM WHERE HE POINTED OUT ANOTHER ELECTRICAL PANEL.THIS PANEL ALSO DID NOT HAVE ANY BREAKERS TRIPPED IN IT BUT IT DID HAVE A MAIN BREAKER.THROUGH THE PROCESS OF ELIMINATION WE FOUND THE CIRCUIT BREAKER WHICH SHUT OFF POWER TO THE OUTLET IN MR.BASSETT'S APARTMENT.THIS BREAKER ALSO SHUT OFF POWER TO THE BATHROOM IN MR. TH1ND'S APARTMENT. Summary of Evidence: Brian Kane appeared to present the petition before the Board . Mr . Kane stated that he desired to expand the pre-existing non- conforming use to include an additional . 11 parking spaces to be used as commercial parking for the ferry line . He identified Vachon , Inc . , as owner of the property , and that he, Brian Kane , represents Devon Inc . , the applicant , and is . authorized by the owner to appear before the Board to request this special permit . They , the Steamship Authority , have no objection or preference to the intended use . Victor Skende and his sister Beverly who are abutters at 77 South Street spoke in opposition . Also speaking in opposition was John Moda owner of the parking lot at 76 South Street . '- I � 'Finding of Facts : At the July 11 , 1991 meeting , by a motion made by Bliss and seconded by Nightingale , the Zoning Board of Appeals made the following finding of facts as related to Petition #1991 -37 : 1 : There are presently two ( 2 ) non-conforming uses on the lot . They are an apartment house and a real estate ( professional ) office ues . 3 . We have heard and received documentation that as early as 1957 there were various office and retail uses on the lot . 4 . The Zoning Ordinance allows the expansion and change of a non-conforming use as per Section 4-4 . 2 provided that such "change is from one non-conforming use to one other non- conforming use only" , and that the creation of a commercial parking lot would indeed be a third , new non-conforming use on the lot . Please be aware that I am fully prepared to comply with whatever the law may require in improvements. The Town recently repaired the street in front of my office. When they did so the retaining wall holding a up the street collapsed and damaged the exterior wall. I tun waiting for them the come and repair the wall so that I may coordinate some of these imVrovements, since part of the improvements are going to take place in the area they will be repairing. i I would also like you to fax over a list of your concerns, so that I may j be better prepared to discuss them with you. 1 would appreciate it.
