kinds of business carried on by the Corporation and members of the family over the past forty-
,' years. It appeared that an unlimited business use was sought, but later in the hearing, and -
while taking a .view of the premises, the members of the Board were infoin ed that a regular
all-year freight service was under consideration; that the use of a 110-.foot vessel for the

Dear Mr. Perry:
Enclosed please find a copy of the Chapter 91 Waterways License application and
plans for the above referenced project. The Town of Barnstable maintains the existing pier
structures at the end of Pleasant Street under DEP Waterways License#980. The existing
timber pier structures are public landings and are in a state of extreme disrepair. The
proposed pier reconstruction project includes the complete removal of the existing timber
pier and pilings systems, removal of the existing concrete slab, partial removal of the existing.
granite block seawall, the installation and maintenance of a steel sheet-pile bulkhead and the
construction and maintenance of a replacement timber pier/wharf system with associated
utilities. The proposed project received approval from the Town of Barnstable Conservation
Commission at the public hearing meeting held on January 23, 2007.
A Chapter 91 Waterways permit is required for this project. The Division of
Waterways requires a Zoning Certificate as a part of the Chapter 91 application. Would you
please certify that this project is not in violation of the local zoning bylaw?
Please find enclosed a copy of the required form from the Chapter 91 application.
Will you please complete and sign the Municipal Zoning Certificate and inform us when it is

The Town of Barnstable owns and maintains existing pier structures at the end of
Pleasant Street and on Parcel D and Al as shown on the accompanying plans. The existing
timber pier structures, authorized by the state under DEP Waterways License#980, are public
landings and are in a state of extreme disrepair. Existing wetland resource areas found on or
within 100 feet of the project site include land under the ocean, land containing shellfish, a
man-made coastal bank and land subject to coastal storm flowage.
The project involves the reconstruction and maintenance of the existing licensed timber
pier and bulkhead. The proposed pier reconstruction project includes the complete removal of
the existing timber pier and pilings systems, removal of the existing concrete slab,partial
removal of the existing granite block seawall, the installation and maintenance of a steel sheet-
pile bulkhead and the construction and maintenance of a replacement timber pier/wharf system
with associated utilities at the end of Pleasant Street and on Parcel D and A1, Pleasant Street in
Hyannis Inner Harbor. Work will take place within land under the ocean, land containing
shellfish, a man-made coastal bank(the existing granite block seawall), and in land subject to
coastal storm flowage.
The existing pier is supported by a system of timber pilings and provides access, by
way of an easement, to a fendering system for the Woods Hole Martha's Vineyard &
Nantucket Steamship Authority. All existing timber pilings that support the pier, along with
the existing pier superstructure, will be removed and disposed in a suitable upland and off-site
location. The proposed project will replace the lower pier system owned by the Town of
Barnstable, but will leave the fendering system in place. A set of timber stairs that provide
access to the fender piles will be removed and replaced when the work is complete.
A steel sheet-pile bulkhead is proposed along a portion of the pier to provide support to
the existing gravel parking area in the event of erosion of the existing side slope. The top of
the steel bulkhead is proposed at or just below the existing surface and will not be visible
unless the seaward slope should erode.
The proposed reconstruction of the pier system will include some minor improvements
to this facility that will slightly reconfigure and expand the existing footprint to best
accommodate its use. Electricity will be provided. The parking area will remain as a pervious
gravel surface. A ramp has been added to the Parcel Al portion to provide vehicular access for
the pier. The proposed pier has been structurally designed to support such use.
The site is located within Hyannis Inner Harbor, a highly dedicated marine use area. .
Although dredging was once permitted and performed at this location no dredging is proposed
under this application. All impacts to the existing wetland resource areas will be temporary in
nature and will not have long term or permanent impacts on land under the ocean or land
containing shellfish. The proposed work is a public municipal pier renovation project and will
improve public access and will not have and adverse effect on the interests of the Wetlands
Protection Act or the Town of Barnstable Wetlands Protection Bylaw.

plans for the above referenced project. The Town of Barnstable maintains the existing pier
structures at the end of Pleasant Street under DEP Waterways License#980. The existing

Waterways requires a Zoning Certificate as a part of the Chapter 91 application. Would you
