GEORGE and ALICE M. GEORGE, Trustees of TAC Realty Trust, of c/o 17 Thacker Shore Road, Yarmouth Port, MA 02675, hereinafter called the Lessor, which expression shall include their heirs, administrators, executors, successors and assigns; and Robert F. Kennedy Children's Action Corps of 11 Beacon Street, Suite 820, Boston, MA 02108, hereinafter called Lessee, which expression shall include its heirs, administrators,executors, successors and assigns. WITNESSETH that in consideration of the rent herein reserved and the mutual covenants herein contained, the Lessor does hereby demise and lease unto the Lessee the complete first and partial second floors of building at 11 Potter Ave., Hyannis, MA 02601'and exclusive use of the parking at the front of the building. Hereinafter this leasehold area shall be referred to as the"subject premises"or the"demised premises". TO HAVE AND TO HOLD the demised premises unto the Lessee for the term of 60 months (5) years from 12:01 a.m. March 1,2015 to 11:59 p.m. February 28,2020 r This lease is made and accepted upon the following terms,covenants and conditions: 1. RENT The Lessee covenants and agrees to pay to the Lessor without demand, at such place or places as the Lessor shall from time to time designate,the rent for said premises in the amounts and at the times as follows: The rent shall be per month payable in advance on the 1"day of each month. TAXES,COMMON INSURANCE This is a gross lease with Lessor paying for annual fire and extended coverage insurance and annual real estate taxes,community preservation acts fees and fire district tax. 3. UTILITIES Lessee shall be responsible for the first floor gas and electric meter. The second floor tenant shall be responsible for the second floor gas and electric meter. The Lessee shall provide the second floor tenant with a list of times and dates of expected usage and the two parties will agree that the Lessee will provide a reasonable contribution to the second floor tenant's monthly energy expenses during the months that the second floor is used by the Lessee. r . Lessee shall be responsible for 75% of water and sewer used on the demised premises. The Lessor will be responsible for the cost of sewer to the building. In addition the Lessee is responsible for: Snow Removal: Lessee and the second floor tenant agree to be responsible for sidewalks as required. Snow removal from the,parking lot shall be completed.at the sole expense of the Lessor. SIGNS AND ALTERATIONS Except as hereinafter provided, the Lessee shall make no structural alterations of nor additions to the demised premises without the Lessor's prior written consent in each instance;and will not place,hang, paint,write, install, erect or permit to be placed,hung, painted,written, installed or erected any sign to the outside of the building or anywhere upon the outside of the demised premises without the Lessor's prior written consent in each instance. All signs and building permits are the responsibility of the Lessee and should conform to all regulations of the Town of Barnstable or any other governmental entity which has jurisdiction. 5. ASSIGNING OR SUBLETTING Lessee shall not assign this Lease in whole or in part, or sublet all or any part of the premises, without the written consent of the Lessor first having been obtained, which consent shall not be unreasonably withheld. In any event, the Lessee shall not be permitted to sublease for any other use, which would be in violation of any existing leases of the Lessor. Consent by the Lessor to any assignment or subletting shall not constitute: a waiver of the requirement for such consent to any subsequent assignment or subletting. The prohibition against assignment or subletting shall be construed to include a prohibition against any subletting or assignment by operation of law. In making its decision to allow assignment or sublet, Lessor reserves the right to review and approve the proposed assignees'/sublessees' financial statement. Lessee shall not assign in whole or in part to any assignee/sublessee that intends to use the premises to conduct a business that would be in direct competition with any other lease occupying the building in which the demised premises is a part as of the date hereof. Any sub-lessee must maintain a liability insurance policy matching that of the Lessee before and during their occupancy in the building. Said policy must name the Lessee and the Lessor as additionally insured. 6. LESSEE'S USE OF DEMISED PREMISES Lessee shall use the demised premises for youth driver education and afterschool programs for children and Lessee may use the premises for any other lawful business use not in direct competition with any other tenant occupying the building in which the demised premises is a part, subject to approval by the Lessor, said approval not to be unreasonably withheld. Uses shall not be in violation of any laws or ordinances. Lessor hereby acknowledges and consents to the use of the demised premises by lessee and its immediate predecessor,as of the date hereof. 7. MAINTENANCE OF BUILDING a. The Lessor agrees to keep in good order,condition and repair the foundations and roof of the structure of the demised premises and the building of which it is a part,to include electrical, plumbing and HVAC systems. In the event of damage to the said foundations,.exterior walls or roof or any other parts of the building of which the demised premises are a part,or damage to the said electrical,plumbing or heat and air conditioning system, if any,caused by any act of negligence of the Lessee,his employees, agents,visitors, invitees, licensees,such damage shall be repaired at the sole cost and expense of the Lessee. In the event Lessee in order to conduct its business should require utility services(e.g.voltage or more outlets,etc.)greater than those presently provided by the Lessor,'all expenses for such additional installations shall be at the sole expense of the Lessee. Other than as provided above in section a,the Lessee agrees to keep and maintain the demised premise in as good order, condition and repair as the same is or shall be as constructed by the Lessor or Lessee and every part thereof,except as hereinbefore provided,reasonable use an wear excepted. c. The Lessee, his employees or agents shall not mark, paint drill or in any way deface any walls, ceilings, partitions, floors, wood, stone or iron work, except as provided in Paragraph 4, but Lessee shall have the right to install trade fixtures when necessary; provided,however,that any damage to the building caused by such installation shall be repaired by the Lessee at the termination of the Lease or at the time of removal of the trade fixtures. Notwithstanding the aforesaid, Lessor acknowledges and consents to alterations and modifications to the demised premises made by lessee and its immediate predecessor as of the date hereof. All repairs required under this section (7 a, b, c) shall be commenced immediately after damage and be diligently pursued to completion. All work and material to be of the standard and quality of that damaged. d. The Lessor shall not be responsible for any other improvements or repairs of any kind upon the demised premises whether interior or exterior including all broken glass except those recited in paragraph 7(a)above. Broken glass is the Lessee's responsibility. 8. KEEPING PREMISES CLEARED The Lessee agrees to keep the sidewalk in front of the demised premises clear of snow, ice, rubbish and other debris and.not to place or allow any employee, agent, invitee, licensee or delivery person to place or leave any rubbish or other debris in the rear parking area and to hold the Lessor harmless against any loss, cost or damage resulting from a breach of this covenant, where negligence of the Lessee is shown. Lessee shall also be responsible for providing rubbish removal and shall be responsible for all cleaning of stairways, areas, hallways, and lavatories and exterior windows within the building of which the demised premise is a part. 9. NOTICES - Whenever in this Lease it shall be required or permitted that notice or demand is given or served by either party to this Lease to the other, such notice or demand shall be given or served and shall not be deemed to have been duly given or served unless in writing and forwarded by certified or registered mail addressed as follows: to the Lessor, c/o Thomas N. George and Alice M. George, Trustees, 17 Thacher Shore Road, Yarmouth Port, MA 02675; to the Lessee, c/o Robert F. Kennedy Children's Action. Corps., 11 Beacon Street, Boston, MA 02108, or such other address as the Lessee may notify Lessor in writing from time to time. 10. LESSEE TO MAINTAIN INSURANCE Lessee covenants and agrees that,it will, at its sole cost and expense, procure and maintain in force throughout the terms of this Lease, or any extension thereof,for the mutual benefit of the Lessor and )Lessee,the following: a. General public liability insurance, so-called, against claims for bodily injury or death occurring upon, in,or about the demised premises and on, in or about the adjoining sidewalks adjacent thereto, such insurance to afford protection to the limits of not less than $1,000,000.00 in respect to bodily injury or', death to any one person and to the limits of not less than $2,000,000.00 in respect to any one accident or occurrence; and Page.3 of 9 LEASE OF COMMERCIAL PROPERTY-11 Potter Ave.,Hyannis,MA b. Property damage against claims for damage or injury to property or members of the public, occurring upon, in, or about the demised premises and on, in or about the adjoining sidewalks adjacent thereto, such insurance to afford protection to the limits of not less than $250,000.00"in respect to the damage to the property of any one owner. c. All of the aforesaid shall be kept in effect under valid and enforceable policies issued by an insurance company or companies satisfactory to the Lessor, and such policy or policies shall name the Lessor and the Lessee as assureds as their respective interest may appear. All such policies of shall provide that they are not to be, cancelled without a minimum of twenty (20) days prior written notice to each assured named therein. Lessee shall, upon the commencement of the terms of this Lease, deposit with Lessor originals or duplicate originals of the policies provided for herein. In the event that Lessee fails to take out, pay for, maintain or deliver any of the insurance policies provided for in this paragraph, the Lessor may, in its sole discretion, and without waiving or releasing Lessee from his agreements to be performed under this paragraph, takeout, pay for, and maintain any and all of the said insurance policies and shall have the right to designate any and all sums paid for such insurance as additional rent under this agreement payable to the Lessor on demand. h a hereto hereby waives an and eve claim which arises or may arise in its favor and d. Each party hereto agrees immediately to give to each insurance company which has issued to it policies of fire and extended coverage insurance, written notice of the terms of said mutual waiver, and to have said insurance policies properly endorsed,if necessary,to prevent the invalidation of said insurance coverages by reason of said waivers. 11. INDEMNITY The Lessee agrees that he will indemnify and save the Lessor harmless from any and all liability;: damage, expense, cause of action, suits, claims, or judgments, arising from injury to persons or property on the demised premises or upon the adjoining streets and sidewalks which arise out of the act, failure to act(when an act by Lessee was required by law), or negligence of the Lessee,his agents or employees. The Lessor agrees that he will indemnify and save the Lessee harmless from any and all liability, damage, expense, cause of action, suits, claims, or judgments, arising from injury to persons or property on the demised premises or upon the adjoining streets and sidewalks which arise out of the act, failure to act(when an act by Lessor was required by law),or negligence of the Lessor, his agents or employees. 12. ATTORNEY'S FEES In the event of default by the Lessee,the Lessee will pay to the Lessor reasonable attorney's fees paid or incurred by the Lessor for enforcing the Lessee's terms, provisions, covenants, conditions and agreements, or any of them herein contained including reasonable attorney's fees incurred in proceedings to collect rent or to evict the Lessee, provided the Lessor is not then in default and provided further that any proceedings commenced by the Lessor are adjudicated in his favor. 13. DAMAGE TO PREMISE . In case the demised premises or any part thereof shall at any time during the term or any extended term be destroyed or damaged by fire, flood, water damage, wind damage, accident, or other casualty so as to interfere with' use or occupancy of the premises for operation of Lessee's business, and if the demised premises and the remainder of the building cannot be, or are not in fact, rebuilt or restored to the Page 4of9 LEASE OF COMMERCIAL PROPERTY—I I Potter Ave.,Hyannig,MA condition at the start of the Lease within sixty (60) days after the first occurrence of any such fire, flood, water damage, wind damage, accident, or other casualty, then the Lessee, may terminate the Lease, by written notice to the Lessor, and upon mailing said written notice to the Lessor this Lease shall immediately terminate. Upon termination of the Lease by written notice as provided herein the Lessee's obligation to pay any further rent shall immediately cease and the Lessee shall immediately vacate and surrender the demised premises to the Lessor. If the Lessee has paid any rent in advance of the date of termination, Lessor shall reimburse Lessee a just and proportionate part of the rent. If the demised premises and the remainder of the building can be rebuilt and restored with sixty (60) days from the first occurrence of any fire, flood, water damage,wind damage, accident,or other casualty, then the Lessor shall, at the Lessor's own expense and with due diligence so rebuild or restore the demised premises and the remainder of the building, and a just and proportionate part of the rents hereby reserved shall be paid by the Lessee until the demised premises and the remainder of the building shall have been so rebuilt and restored;provided said casualty is not the fault of the Lessee. 14. QUIET ENJOYMENT The Lessor covenants and agrees with the Lessee that in consideration of the Lessee paying the rents as aforesaid and performing and observing the covenants and agreements herein contained on their part to be performed, the Lessee shall peaceably hold and enjoy the said premises hereinbefore described without hindrance or interruption by the Lessor or any other leaseholder of Lessor,or any persons claiming under them. 15. LESSOR'S INSPECTION OF DEMISED PREMISES Lessee shall permit the Lessor,their agents, employees and contractors, to enter the premises and - all parts thereof during business hours,to inspect or repair the same and to enforce and carry out any provision in this agreement. Such entrance and inspection shall be during regular business hours and without interruption of Lessee's business. 16. LESSEE'S RIGHT TO BE SUBJECT TO ALL MORTGAGES AND ENCUMBRANCES OF RECORD The rights of Lessees under this Lease are hereby made subject and subordinate to all mortgages and encumbrances of record now or hereafter placed upon said premises by the Lessor. 17. FIXTURES AND ALTERATIONS TO BECOME PROPERTY OF LESSOR It is understood and agreed between the parties that any alterations or additions to the premises, including, but not limited to wall-to-wall carpeting, shall become the property of the Lessor. Lessee shall have the right to install personal property, trade fixtures, and equipment on or in said premises and shall have the right to remove such personal property and trade fixtures at the expiration or earlier termination of this Lease, provided, however,that such removal shall not cause injury to the demised premises or the buildings of which the demised premises are a part. Lessee shall at its own expense prior to vacating repair any damage to premise caused by such removal. 18. DEFAULTS BY LESSEES a. If the Lessee defaults in fulfilling any of the covenants of this Lease other than the covenant for the payment of rent and such default shall not be made good within seven(7)days after written notice and demand, or if the default is of such a character as to require more than 7 days to cure and the Lessee fails to proceed diligently to cure.such default or if the estate hereby created shall be taken on execution or by Page 5of9 LEASE OF COMMERCIAL PROPERTY—11 Potter Ave.,Hyannis,MA other process of law or if the Lessee shall be declared bankrupt or insolvent according to law, the Lessor may give the Lessee ten (10) days notice of intention to end the term of this Lease and thereupon at the expiration of said ten (10) days, the term under this Lease shall expire as fully and completely as if that day were the day herein definitely fixed for the expiration of said term, and the Lessee shall then quit and surrender the demised premises to the Lessor,but the Lessee shall remain liable as hereinafter provided. b. If the Lessee defaults in the payment of the rent reserved herein or any part thereof and such default is not corrected within fourteen (14) days after written notice thereof, the Lessor, may, upon written.notice,terminate this Lease and re-enter the demised premises and dispossess the Lessee and other occupants of the demised premises by judicial proceedings or otherwise and remove their effects and hold the premises as if this Lease had not been made. c. The provisions of paragraphs a and b of this section are cumulative to and not in exclusion of, but are in addition to any other right or remedy which may be available to the Lessor by law. d. In the event of any repossession of the demised premises by the Lessor because of any default of the Lessee either under paragraphs a and b of this section or by reason of any other right or remedy available to the Lessor, the Lessor may, if it so elects relet the demised premises or any part thereof and for the remainder of the term, or for a longer or shorter period in the discretion of the Lessor, and the Lessee agrees to .pay to the Lessor the rent herein reserved on.the days when the same becomes due, up to a total of four (4) months of rent (in addition to any back rent owed, if any) in accordance with the termination right of Lessee set forth in paragraph 32 herein, which right shall be assumed to have been exercised upon repossession of the demised premises by the Lessor, less the net proceeds of the reletting. 19. MANNER OF PAYMENT AND CONDITION OF PREMISES The Lessee does hereby covenant with the Lessor that it will, during said terms and for such further time as it or any persons claiming under it shall hold the said premises or any part thereof,.pay unto the Lessor the said rent at the times and in the manner aforesaid and will keep all and singular the interior of the said premises,the windows thereof and the plate glass of said,building in such repair,order and condition as the same now are at the commencement of said term or may be put into during the continuance thereof, damage by fire, or other unavoidable casualty excepted. Lessee is responsible to maintain for the benefit of the Lessor, insurance for glass breakage. All glass replacement is the responsibility of the Lessee. 20. EMINENT DOMAIN If the whole or any part of the premises shall be taken under the power of eminent domain, this Lease shall terminate, as to the part so taken, on the day when the Lessee is required to yield possession. thereof, and the Lessor shall make such repairs and alterations as may be necessary in order to restore the part not taken to useful condition; and the rent shall be reduced proportionately as to the portion of the premises taken. If the amount of the premises so taken is such as to impair substantially the usefulness of the premises for the purposes for which the.same are hereby leased,then either party shall have the option to terminate this Lease as of the date when the Lessee is required to yield possession. All compensation awarded for such taking of the fee and the leasehold shall belong to and be the property of the Lessor except that the Lessor shall not be entitled to any portion of the award made to the Lessee for the cost of removal of stock and fixtures. 21. LESSOR'S RIGHTS No mention in this Lease of any specific right or remedy shall preclude Lessor from exercising Page 6 of 9 I LEASE OF COMMERCIAL PROPERTY—11 Potter Ave.,Hyannis,MA any other right or from having any other remedy or from maintaining any action to which it may otherwise be entitled either-at law or in equity; and the failure of the Lessor to insist in any one or more instances upon a strict performance of any covenant of this agreement or to exercise any option or rights herein contained shall not be construed as a waiver or relinquishment of the future of such covenant or right or option,but the same shall remain in full force and for the future unless the contrary is specified in writing by the Lessor. 22. MODIFICATION OF LEASE It is further understood and agreed that no'modification or extension of this Lease shall be binding unless endorsed hereon by the parties hereto, which endorsement shall be properly executed in the same manner as the original Lease. 23. UPON TERMINATION Lessee further covenants that it will, at the expiration of the term hereof, remove its goods and effects and those of any person claiming under him and will peaceably yield up the Lessor the said premises and all alterations, and additions made to or upon the same, in as good repair; order, and condition in all respects as the same shall be at the time of occupancy by Lessee, or may be put into, damage by fire, flood, water damage, accident, or other casualty excepted and reasonable use and wear thereof excepted. The said premises shall not be overloaded, damaged or defaced and no trade or occupation shall be carried on upon the premises or use made thereof which shall be improper, unlawful, noisy or offensive,or contrary to any of the laws of the Commonwealth of Massachusetts or of the bylaws or rules of the Town of Barnstable for the time being in force, or which shall be dangerous to any person or property. 24. PLACEMENT OF FOR LEASE SIGN If Lessee does not renew his Lease prior to ninety (90) days from the expiration of this Lease,, Lessor shall have the right to exhibit a "For Lease" sign in the window of the leased premises during the last month of said Lease. LICENSES PERMITS,APPROVAL Lessee is responsible to secure at its expense all licenses, permits or approvals necessary for the renovations and repairs and for the use of the premise. 29. TRASH RODENTS,SNOW AND ICE Lessee is to provide for its own trash removal and shall keep the premise free of rodents and bugs, if necessary, by treatment of the premise on a regular basis by a recognized Massachusetts exterminating company and shall provide Lessor of proof of said treatment upon reasonable request of Lessor. All snow and ice removal in the lot in the front of the building abutting the leased premise not completed by the Town of Barnstable shall be the responsibility of the Lessee at its sole cost. 30. OPTION TO EXTEND LEASE TERM There is included in the lease for no additional consideration one (1) option to the Lessee to renew the lease for an additional term of three (3)years upon such terms and conditions as herein except for the rent consideration shall be 3% above the then current year of the lease and which will increase every year thereafter by 3% annually. Said option to be exercised by notice in writing to Lessor at least ninety(90)days prior to the end of the original lease term. 31. TOXIC OR HAZARDOUS WASTE The Lessee shall not use or cause to be used on the premise except in ordinary quantities for the operation of its business materials which are of a toxic or hazardous waste nature and which would violate the standards of any level of governmental regulation. The Lessee agrees to reimburse the lessor for any expenses or damages incurred or suffered because of the failure to keep and perform the covenants and conditions herein contained. 32. OTHER TERMS Parking. Lessee shall grant the use of one parking spot for an employee of the second floor tenant. Common Area. The Lessee's leased'premises shall be separate from the second floor tenant's space. This will create a commonly shared staircase, front lobby, and men's and woman's bathrooms. The Lessee and the second floor tenant agree to clean and maintain these areas. Termination Clause. If, at any point during the initial 60 month term or any option period that follows;the Lessee's funding is terminated, the Lessee may give the Lessor notice and the lease will be considered null and void. We were given 2"Citizen Request Management sheets about prior complaints from other neighbors on Dumont Dr dated 8/9/2016 and 6/17/2014. When we arrived home we read the complaints more carefully and found that the property is zoned for office(3400), not construction. It is rented out to a contractor and outside there are glass for windows,two bathtubs,two small propane bottles, roof shingles,and old wood,some of which has been there so long that vines are growing on them. There are also many other items in the yard which are not used in an office setting. There is also a very large dumpster that has not been emptied in a very long time that is very close to the road. Apparently this complaint has been handled by the Health Dept and they seem to focus on the dumpster which is close to the road: We feel that this is a zoning issue and not a health issue and should be investigated by your department. We also question why a large, locked dumpster is needed for a small office building. Please inform us of this is a zoning issue or if it a situation that should be handled by the Health Dept. Robin Rowland and his wife purchased the lot from my wife's ex-husband, Charles Markarian and constructed a commercial multi-use building. When the Rowland's first started the construction of this new structure, my wife and I were asked to allow a few parking spaces from my wife's building at 707 Main St(which fronts the property on Dumont St.) in order to satisfy the town's requirement at that time. I also signed the initial lease to help Robin Rowland with the financing of the new building. I operated a glass business in this location for over 5 years and kept an office at 707 Main St. (my wife's business location). I opened a new location Nantucket and used the Potter Ave location for storage and staging for the island. I returned from Nantucket in 2006 and I continued to use the Potter Ave location for storage. I have been working with Marvin Design Gallery and Marine Home Center in Hyannis, Nantucket and Martha's Vineyard. f. We are expanding our offerings to add a small millwork operation and I am working towards operating a small shop to fabricated window surrounds and custom mahogany screen doors at the.Potter location. Hence,the reason for the request of the electric permit application to update the service. Note: I had a 3 phase converter in this location in early 2000 to run larger glass edging and polishing equipment. My wife has been in her location at 707 Main Street in excess of 25 years. (which is adjacent to this property). We have lived through the issues that have affected this neighborhood with the homeless and the drug and alcohol problems coming from the old vacant Gulf station (now a town green) and the homeless camps behind Dumont St.for years. I still have homeless sleeping in the front entrance of 707 Main St and often find empty alcohol bottles and used syringe needles around the Potter Ave and 707 Main St locations.This is and has been a problem for years. I was unaware that you had met with my son to speak with him about neighbor complaints.And I certainly apologize for his response to your review of conditions.The lease has always been in my name since the building was originally constructed. I am presently a tenant at will and with the recent death of young Tom George, things are in a uncertain status. I have been helping to take care of the total building maintenance including snow removal. As noted, I represent Potter Avenue, LLC, the owner of the above property. Attached please find a copy of the GIS mapping depicting the parcel, which is shown on Barnstable Assessor's Map 308, as Parcel 150. As we discussed during our meeting, this parcel was previously zoned in the Business Zoning District of the Town of Barnstable at the time of its construction. Accordingly, its construction and subsequent use was as a matter of right. The building, which has been consistently used for professional and general office use is now a pre-existing, non-conforming use as the result of the adoption of the downtown Hyannis zoning. The subject property is now located in the RB Zoning District as a result of the adoption of the zoning boundaries for.the HVB and OM Zoning Districts. I have highlighted the OM District line in orange and the HVB line in yellow on the attached plan. As you can see, the use of the property boundary lines at the time of the development of the OM and HVB zoning map deleted the subject property from the commercial zone and created its non- conforming status. This property fronts two streets,Dumont&Potter. The entrance to the building is actually on Potter Ave. I am informed that the downstairs has been approved as a mercantile use. The entrance to the mercantile bay is on Dumont Street. I found the berm required along Potter to be satisfactory. The handicap parking stall has been created in the wrong area. I have been informed that the handicap ramp has also been amended. I requested that Ralph Jones meet me on site in order to verify that these amendments do not violate any ADA ordinances. Ralph approved both the stall and the ramp. The applicant was also advised that the street numbers must be posted for both the mercantile side and the Potter Ave. side. Vegetation was not completely in accordance with the approval. The applicant shall purchase a tree or shrub for installation in the barren area by the building corner(facing Potter Ave). He has provided me with a copy of the receipt in order that SP approval does not interfere with issuing a final CO. The receipt copy is attached for historic reference. The applicant has reinforced the slope on the side yard(abutting the Uniform Shop)with rail road ties. Mr. Reilly did not plant one of two trees at the property corner on Dumont. However,he did plant more than the required amount of trees lining the side perimeter(behind the Uniform Shop). I would recommend(not require)that the applicant plant additional Creeping Juniper on that side in order to mitigate erosion and I advised as such. I found there to be considerable run-off from the adjacent property resulting in some wash out in between the subject lot and the commercial property fronting Main Street. This is noted strictly for informational purposes as the subject lot does not contribute to the run-off. Due to the severe rain, I did not walk the rear portion. I do not recollect seeing the required- improvements on Dumont Road. The catch basins (front&rear were quite visible and obviously functioning). Subsequent to receiving all appropriate sign-offs, including the fire department, I have agreed.to approve the site as is (with the installation of the additional tree or shrub). Giangregorio RE: SPR 44-99 Rowland Assoc. 10 Dumont St. Hyannis& 11 Potter Ave(R308Z150) I inspected this property at the request of CJ Reilly 9/15/00. Mr. Reilly seeks a final CO today. This property fronts two streets,Dumont&Potter. The entrance to the building is actually on Potter Ave. I am informed that the downstairs has been approved as a mercantile use. The entrance to the mercantile bay is on Dumont Street. I found the berm required along Potter to be satisfactory. The handicap parking stall has been created in the wrong area. I have been informed that the handicap ramp has also been amended. I requested that Ralph Jones meet me on site in order to verify that these amendments do not violate any ADA ordinances. Ralph approved both the stall and the ramp. The applicant was also advised that the street numbers must be posted for both the mercantile side and the Potter Ave. side. Vegetation was not completely in accordance with the approval. The applicant shall purchase a tree or shrub for installation in the barren area by the building corner(facing Potter Ave). He has provided me with a copy of the receipt in order that SP approval does not interfere with issuing a final CO. The receipt copy is attached for historic reference. The applicant has reinforced the slope on the side yard(abutting the Uniform Shop)with rail road ties. Mr.Reilly did not plant one of two trees at the property corner on Dumont. However,he did plant more than the required amount of trees lining the side perimeter(behind the Uniform Shop). I would recommend(not require)that the applicant plant additional Creeping Juniper on . that side in order to mitigate erosion and I advised as such. I found there to be considerable run-off from the adjacent property resulting in some wash out in between the subject lot and the commercial property fronting Main Street. This is noted strictly for informational purposes as the subject lot does not contribute to the run-off. Due to the severe rain,I did not walk the rear portion. I do not recollect seeing the required- improvements on Dumont Road. The catch basins(front&rear were quite visible and obviously functioning). Subsequent to receiving all appropriate sign-offs, including the fire department, I have agreed to approve the site as is (with the installation of the additional tree or shrub).
