Board Members hearing this appeal were Richard Boy,Ron Jansson,Gene Burman,William Garreffi,and Acting Chairman Emmett Glynn. Kirby R.Thwing,Jr.,owner of Manufacturer's Edge,Inc.,represented himself before the Board. Mr. Thwing told the Board he purchased the business from Stuart Eveland who had been running a shed business for the previous four years. Along with the shed business,Mr.Thwing is seeking to expand the business to include education and demonstration of woodworking techniques. There will be retail sales both inside and outside. Mr. Thwing explained that Richard Masse received Site Plan Review Approval for this site on August 9, 1995 however,he personally has not been to Site Plan Review. Mr.Thwing said he was told by the Building Commissioner and the Planning Department that the previous Site Plan Approval would be sufficient. The Board asked how many businesses there where on this one site. Mr.Thwing replied that the building in the back is Crowell Lawnmower. The building in the front was Eveland Shed and Bay State Realty on the first floor and an apartment on the second floor. Bay State Realty is no longer there. The Board questioned why the applicant had not gone to Site Plan Review. He is seeking a new use on the lot and that use needs Site Plan Review Approval. The Board had a concern with the number of uses on the site. There is office use,retail use, lawnmower repair,an apartment and an educational display all on this one lot. The Board instructed the Petitioner to apply to Site Plan Review and then return to the Zoning Board of Appeals. New staff reports will be given to the Board and the applicant. However, setback and side/rear yard setback requirements must be observed. Old King's Highway Historic District Committee approval is required if the building is to be located in the Historical District. Due to the many and varied zoning districts within the Town I would suggest that you obtain a Zoning Ordinance w/map from the Town Clerk's office. DEFINITION OF HOMEOWNER: Person(s) who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to be, a one to six family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner" shall submit to the Building Official on a form acceptable to the Building Official., that he/she shall be responsible for all such work Performed under the building permit. (Section 109 . 1 . 1 ) The undersigned "homeowner" -assumes responsibility for compliance with the State Building Code and other applicable codes, by-laws, rules and regulations. The undersigned "homeowner" certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements HOMEOWNER'S SIGNATURE APPROVAL OF BUILDING OFFICIAL Note: Three family dwellings 35,000 cubic feet, or larger, will be required to comply with State Building Code Section 127 .0, Construction Control. MISC5 HOME OWNER'S EXEMPTION The code states that: "Any Home Owner performing work for which a building permit is required shall be exempt from the provisions of this section (Section 109. 1. 1 - Licensing of Construction Supervisors) ; provided that if Home Owner engages a person(s) for hire to do such work, that such Home Owner shall act as supervisor. - Many Home Owners who use this exemption are unaware that, the responsibilities of a supervisor they are assuming for Licensing ConstructionSuperyisorsSeSect ond2.{155) .RuThisles alackeoflations awa=eneas often, ' - results in serious problems, particularly when the Home Owner hires unlicensed persons. In this case our Board cannot proceed against the unlicensed person as it would„with, licensed supervisor. The Home Owner acting as supervisor is ultimately responsible. To ensure that the Home Owner is fully ,aware of -his/her responsibilities, many communities require, as part bf the 'permit 'application ,,,that the 'Home Owner certify that he/she understands the responsibilities of• a supervisor. On the last page of this issue is a form currently used by several towns.
