As you know,I have been requested by the owners of the above-referenced property,Glenn&Sheila Tobin(collectively,the"Applicant"),to render a zoning opinion to your office with respect to 96 Quail Lane ("Locus" or"the Property") and whether the . Property,presently a vacant lot,is buildable. My opinion letter was delivered to your office on May 1, 2014. In rendering this opinion, I relied-upon the deeds, plans and records available at.the Barnstable County Registry of Deeds as well as Town of Barnstable Assessor's records, its Zoning Bylaws,and the Applicant's building plans. Based upon this research,it was my opinion that Locus is a buildable lot. Please allow this letter to respond to your follow up questions regarding the past ownership of the Property,as well as the past ownership of abutting properties,as that relates to the doctrine of merger and whether any abutting lots were formerly held in common ownership. Please note that while there is some commonality with one individual as a result of generational/family transfers,at no time has the Property been held in common ownership with any abutting parcel since the 1970 subdivision plan was registered and the,individual lots were conveyed out. Accordingly,none of the Abutting lots could be deemed "merged lots as defined by § 240-91(F)of the Town of Barnstable zoning bylaws. My conclusion is informed by the following facts: The history of this parcel for zoning purposes begins with an examination of a Plan of Land w dated April 2, 1952, registered with the Land Registration Office (Land Court)owApril 11, 1952, - Land Court Plan 19844-F. On June 7, 1971;the owners of Lots 4; 5; 6, 7, and 8 on the,1952 Plan f sold those lots to John E. Barnard, Jr. and Francis L. Van Buskirk, as Trustees of.the Barnstable Development Trust. At the time of the purchase, the new owners had already prepared a further subdivision plan for the lots that they were acquiring. The ownership history of each of these lots since their 1971•creation is set forth below. 96 Quail Lane. Lot 24(96 Quail Lane)has been owned by the Applicant,Glenn E.Tobin and Sheila L.P. Tobin since December 16, 2013. The properly was conveyed to the Applicant by Deed registered at the Barnstable Land Court Registry as Certificate of Title No. ("CTF#")202283. Prior to the Applicant acquiring title in 2013, Locus had stayed in the prior owner's family since 1984. The history of 96 Quail Lane from the creation of the lot in 1970 to the present is as follows: • Land Court Plan 19844-1, dated April 9, 1970 was'registered with the Barnstable Land Court Registry creating Lot 24 (106 Quail Lane), as well as Lots 23 and 25. • On December 12,•1972, John-E. Barnard, Jr. and Francis L. Van Buskirk, Trustees of the Barnstable Development Trust,sold Lot 24 to George and Etta Cohen for$19,000.00. O'Rourke and Kathleen Vivona—each inherited an undivided 1/3 ownership interest in 60 Quail Lane. The Decree was registered on December 5, 1990 (CTF# 122089). • Immediately thereafter, John J. O'Rourke and Kathleen Vivona bought out.,their brother's interest, resulting in each owning an undivided '/z interest in the property as tenants in k common (CTF# 122090).._ r • John J. In examination of the above titles, there is only one link during the last forty(40) years in the chain of title for the three lots that could arguably give rise to a claim of common ownership. This claim,however, fails. 60 Quail Lane was owned by Thomas E.O'Rourke from 1984 to 1989,and then by his children via inheritance from 1990 to 2013,when siblings Kathleen Vivona and John J. O'Rourke sold it to the present owners, Mr, & Mrs. Castle. 96 Quail Lane was.owned by Thomas E. O'Rourke,Kathleen Vivona and her husband Vincent Vivona beginning in 1984. The father,Thomas E. O'Rourke,passed in 1989, leaving Kathleen and Vincent Vivona as the sole owners until 2000 when Kathleen became sole owner of 96 Quail Lane presumably as part of a divorce settlement. Thus, from 2000-2013, Kathleen Vivona owned 96 Quail Lane individually,while she and her brother owned 60 Quail Lane from 1990-2013. While there is an element of commonality,.the generational transfers, combined ownership with spouses, siblings, parents, etc., defeat any potential claim of merger: Indeed, based upon the ownership structure it appears that the former owners may have specifically considered the doctrine of merger 4 so as to avoid having any one owner retain sole control/ownership over the abutting lots in order to maintain 96 Quail Lane as a buildable lot for a single-family home.
