Each of these properties is improved with a residential duplex (two-family) structure. Recently, a question was raised by the building department with respect to the legal status of the duplex on 102- 104 Quaker Road. However_, since the legal status of all'of my clients' properties on Quaker Road could be affected by this query, I will address all of-the properties herein. Since I met with Mr. Perry, I have confirmed that construction of all of the duplexes was commenced in 1971. and completed the following year. At that time, the area was zoned Residence A-1. Section P of the then Zoning By-laws permitted two-family dwellings provided a special permit therefor was issued by the Board of Appeals. Enclosed is a copy of the special permit issued in Board of Appeals Case No. 1970-52, which authorizes the construction of the duplexes in question, among others. I have also enclosed copies of Land Court Plan No. 21173-F and 21173-G, as that special permit refers to , the lot numbers as they are set forth on the former plan and effectively required the latter plan. Pursuant to the decision, a two-family dwelling was permitted on each of Lots 32 and 33, one two-family dwelling was permitted on the combined Lots 47 and 49, and two two-family dwellings were permitted on the then Lots 40,42 and 44 (which were re-subdivided on LC Plan No. 21173-G as the present Lots 54 and 55). -For your information, the two-family structure on Lot 33 (102— 10.4 Quaker Road) is also the subject of a front-yard setback variance issued in Board of Appeals Case No. 1971-35, a copy of which is also enclosed for your records. I trust that the above and the enclosed are sufficient for your determination that the two- family dwellings were properly permitted.
