Good Morning,
We received a compliant regarding hot plate usage in the second floor of the main building yesterday. We found tenants
using a multi burner hot plate in the former kitchen area.The tenant using it agreed to stop.
Appears to be an internal dispute among second floor tenants. Mr. Hodgson (508-737-3358) admitted to subletting
rooms on the second floor after other tenants left.
It appears that the total number of tenants in the building has not changed.
The back of the building is still fire damaged from the February fire and one window is still boarded up.Tenants
complain of rain water entering the building on the first floor.The attempt at a wooden handicap ramp on the South
side of the building is falling apart and suffering from water damage. Indications are that no separation work has been
done in the work shop(though we could not access it) and the interior window separating the shop from the back egress
corridor/stairs is still in place.
The single family one story building located immediately to the rear of this structure is still fire damaged and unsecure.
There are piles of debris in the yard as well as a large roll of dumpster filled with debris.There has been no activity here
for a while.The sheet rock has been removed from this structure so it remains as a unsecured pile of tinder.

Dear Mr. Reichman:
am sure you are aware of the recent fire that occurred in the rear building on your
property at 45 Ridgewood but accessed by Spring Street: As a result of the current
conditions inspectional services was notified. A follow-up inspection of both buildings was
performed on the afternoon of Feb. 28, 2018.
Although it is apparent that the rear building, having suffered direct fire damage is in no
condition to be occupied, what was not immediately apparent was the condition of the
front building. This dwelling also suffered some damage as it is located in close proximity
to rear of the 1 story building accessed through Spring St.
Inspectors were advised that the occupants of this building were relocated to a motel,
however it was determined that the tenant in the first floor unit was still in residence there
accompanied by several relatives and a baby.
We found the interior access to the 2"d floor to be impeded by several locking
mechanisms, one of which was difficult to operate.
Staff found the second story to be an independent rental unit containing 4 bedrooms, 2
baths and a kitchen. The former garage was converted into a workshop and is currently
rented independently of the tenants for a commercial use.
The subject property is located in the SF—single-family zoning district governed by
Chapter 240 Section24.1.4 of the Town of Barnstable zoning code.

l The following items were identified and must be addressed:
The Single-Story Dwelling
The former living room/den in the single-story dwelling was converted into a bedroom
without proper permits and the corresponding required upgrade to fire prevention
provisions.
This unit operates as an unlicensed-unpermitted lodging house containing 4 adult
occupants and at least one child.
Two-Story Structure
Building permit#33537 dated 3/1/1990 was issued for a 2"d story addition containing 4
bedrooms and 2 baths. The original floor plan is on file. ,
Staff found this structure to be operating as duplex with 2 complete and segregated units
on first and.second floors.
The.dwelling must be returned to a single family home by obtaining a building permit
to restore it according to-the original design and permitted floor plan. A licensed plumber.
and electrician will be necessary in order to cut and cap the utilities on the second
floor in the kitchen. All utility connections must be rendered non accessible with a
finished wall.
Locking mechanisms located on the 1st floor kitchen door must be removed to
restore access and flow to the single family structure.
The garage space is required to be finished in accordance with the building code as .
directed by Local Inspector Jeff Lauzon and its use must revert back to storage for the
residents of the single family dwelling.
In addition to complying with the building and zoning codes, all matters relative to the state
sanitary code and fire department shall be satisfactorily addressed as well.

I received a complaint from tenant(John Hodgson -508-737-3358) about the rear building of this property
involving the following issues:
1. Missing CO detector in the rear 2 story building (2nd floor unit). The landlord has not�replaced since
being notified last April.
2. Bedbugs-the landlord says the tenants are responsible.
3. Holes in the screens-landlord has not replaced or repaired any of the screens.
4. Trash - Is the landlord required to provide trash pick up for 3 units or more?
The property owner is RAF RE Enterprises. They are apparently a large foreign RE_investment company
that operates on the east coast. The tenant says he calls Sergi at 617-820-1525 when he has a problem
and mails his rent check to PO Box 1003, Mashpee 02649. The assessors site shows an address in
Stoneham, MA.

need to research the legality of the property but in the mean time, I thought the HFD and the Health Div `
would be interested in knowing the landlord is refusing to replace a missing CO detector. I believe this is.a
registered rental but maybe it has not been inspected?

INTENT: It is the intent of this section to allow the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the activity
shall not be discernible from outside the dwelling: there shall be no increase in noise or odor,no visual alteration to the

• No traffic will be generated in excess of normal residential volumes.
• The use does not involve the production of offensive noise,vibration,smoke,dust or other particular matter,
odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of
normal household quantities.
• Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment.
• There is no commercial vehicles related to the Customary Home Occupation,other than one van or one
pickup truck not to exceed one ton capacity,and one trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation.
• If the Customary Home Occupation is listed or advertised as a business,the street address shall not be
included.
• No person shall be employed in the Customary Home Occupation who is not a permanent resident of the
dwelling unit.

Dear Mr. Reichman:
I am sure you are aware of the recent fire that occurred in the rear building on your
property at 45 Ridgewood but accessed by Spring Street. As a result of the current
conditions inspectional services was notified. A follow-up inspection of both buildings was
performed on the afternoon of Feb. 28, 2018.
Although it is apparent that the rear building, having suffered direct fire damage is in no
condition to be occupied, what was not immediately apparent was the condition of the
front building. This dwelling also suffered some damage as it is located in close proximity
to rear of the 1 story building,accessed through Spring St.
Inspectors were advised that the occupants of this building were relocated to a motel,
however it was determined that the tenant in the first floor unit was still in residence there
accompanied by several relatives and a baby.
We found the interior access to the 2"d floor to be impeded by several locking
mechanisms, one of which was difficult to operate.
Staff found the second story to be an independent rental unit containing 4 bedrooms, 2
baths and a kitchen. The former garage was converted into a workshop and is currently
rented independently of the tenants for a commercial use.
The subject-property is located in the SF—single-family zoning district governed by
Chapter 240 Section24.1.4 of the Town of Barnstable zoning code.

The following items were identified and must be addressed:
The Single-Story Dwelling
The former living room/den in the single-story dwelling was converted into a bedroom
without proper permits and the corresponding required upgrade to fire prevention
provisions.
This unit operates as an unlicensed-unpermitted lodging house containing 4 adult
occupants and at least one child.
Two-Story Structure
Building permit#33537 dated 3/1/1990 was issued for a 2"d story addition containing 4
bedrooms and 2 baths. The original floor plan is on file.
Staff found this structure to be operating as duplex with 2 complete and segregated units
on first and second floors.
The dwelling must be returned to a single family home by obtaining a building permit
to restore it according to the original design and permitted floor plan. A licensed plumber
and electrician will be necessary in order to cut and cap the utilities on the second
floor in the kitchen. All utility connections must be rendered non accessible with a
finished wall.
Locking,mechanisms located on the 1st floor kitchen door must be removed to
restore access and flow to the single family structure.
The garage space is required to be finished in accordance with the building code as
directed by Local Inspector Jeff Lauzon and its use must revert back to storage for the
residents of the single family dwelling.
In addition to complying with the building and zoning codes, all matters relative to the state
sanitary code and fire department shall be satisfactorily addressed as well.

NOTICE OF VIOLATIONS OF 310 CMR: 15.00 THE STATE ENVIRONMENTAL CODE
TITLE V: MENIMUM REOUIREMENTS FOR THE SUBSURFACE DISPOSAL OF
SANITARY SEWAGE AND TOWN OF BARNSTABLE CODE 4 353-9-DISCHARGE
ONTO GROUND PROHIBITED.
On February 25, 2018, Health Inspector Donna Z. Miorandi, R.S. received a call from the Hyannis
Fire Department to respond to the property owned by you located at 45 Ridgewood Avenue,
Hyannis (a/k/a 40-A Spring Street as entrance is through 40 Spring Street), Map/Parcel 327-053.
The following violations of 310 CMR 15.000, the State Environmental Code, Minimum
Requirements for the Subsurface Disposal of Sanitary Sewage and the Town of Barnstable
Code were observed:
310 CMR 15.303(1)'(a): Septic system is in hydraulic failure. Raw sewage was observed ponding
on the ground
Town of Barnstable Code-353-9: Discharge of sewage onto the ground.
(1) You are directed to keep the on-site sewage disposal system pumped as many times as
necessary(daily if needed)to keep it from overflowing onto the ground.
310 CMR 15.354: Abandonment of Systems: Cesspool present at said location.
You are directed to correct the,violation listed above within thirty (30) days of your
receipt of this'notice by'obtainng a septic abandonment permit from the Town of
Barnstable Health Department and properly abandoning the septic system.
The following procedure shall be used to abandon a system:
(a) Within 14 days to discontinuance of use of a system, the facility owner shall apply
to the Approving Authority to abandon the existing system citing the reasons(s)
abandonment is necessary, and where connection to municipal or private sanitary
sewer has been made, a copy of the sewer connection permit shall be submitted
with the application;

(b) Upon receipt of the Approving Authority's written approval to abandon the system,
the septic tank shall be pumped of its entire contents by a licensed septage hauler;
and
(c) The tank shall be excavated and removed from the site, or the bottom of the tank
shall be opened or ruptured after being pumped of its content so as to prevent
retainage of water and the tank shall be completely filled with clean sand or other
suitable material approved in writing by the Approving Authority.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the,order is served.
Non-compliance will result in a fine of$100.00 per violation. Each day's failure to comply
with an order shall constitute a separate violation.

Dear Mr. Reichman:
I am sure you are aware of the recent fire that occurred in the rear building on your
property at 45 Ridgewood but accessed by Spring Street. As a result of the current
conditions inspectional services was notified. A follow-up inspection of both buildings was
performed on the afternoon of Feb. 28, 2018.
Although it is apparent that the rear building, having suffered direct fire damage is in no
condition to be occupied, what was not immediately apparent was the condition of the
front building. This dwelling also suffered some damage as it is located in close proximity
to rear of the 1 story building accessed through Spring St.
Inspectors were advised that the occupants of this building were relocated to a motel,
however it was determined that the tenant in the first floor unit was still in residence there
accompanied by several relatives and a baby.
We found the interior access to the 2"d floor to be impeded by several locking
mechanisms, one of which was difficult to operate.
Staff found the second story to be an independent rental unit containing 4 bedrooms, 2
baths and a kitchen. The former garage was converted into a workshop and is currently
rented independently of the tenants for a commercial use.
The subject property is located in the SF—single-family zoning district governed by
Chapter 240 Section24.1.4 of the Town of Barnstable zoning code.
The following items were identified and must be addressed:
The Single-Story Dwelling
The former living room/den in the single-story dwelling was converted into a bedroom
without proper permits and the corresponding required upgrade to fire prevention
provisions.
This unit operates as an unlicensed-unpermitted lodging house containing 4 adult
occupants and at least one child.
Two-Story Structure
Building permit# 33537 dated 3/1/1990 was issued for a 2nd story addition containing 4
bedrooms and 2 baths. The original floor plan is on file.
Staff found this structure to be operating as duplex with 2 complete and segregated units
on first and second floors.
The dwelling must be returned to a single family home by obtaining a building permit
to restore it according to the original design and permitted floor plan. A licensed plumber
and electrician will be necessary in order to cut and cap the utilities on the second
floor in the kitchen. All utility connections must be rendered non accessible with a
finished wall.
Locking mechanisms located on the 1st floor kitchen door must be removed to
restore access and flow to the single family structure.
The garage space is required to be finished in accordance with the building code as
directed by Local Inspector Jeff Lauzon and its use must revert back to storage for the
residents of the single family dwelling.
In addition to complying with the building and zoning codes, all matters relative to the state
sanitary code and fire department shall be satisfactorily addressed as well.

enclosed a copy of this document for yous-observation._
The original petition is being kept in my
office if ,you wish to further examine it.
This violation of Building and Zoning
laws must be rectified as soon as possible, or I will
be obliged to file a complaint before the proper court
of law.
The law referring to this violation
states: Viz;
a. The Chief of Police, upon application of tall

WE, the undersigned, being residents of and property owners
on Ridgewood Avenue, Hyannis, Massachusetts, hereby protest and object
to the construction, maintenance and occupancy of certain buildings on pro-
perty of George and/or Mary Armanitas at 45 Ridgewood Avenue, Hyannis,
Massachusetts, for the following reasons and upon the following grounds:
r 1. That the construction, maintenance and occupancy of said
building or buildings is in violation of the zoning By-Laws
and building code of the Town of Barnstable.
2. `That the` 66upancy of the buildings aforesaid creates in the
neighborhood, a nuisance, both public and private, and deprives
the parties hereunto of the peaceful and quiet enjoyment of
their premises.
Ik. 3. That the occupancy of the buildings aforesaid creates a grave
#t and serious traffic problem on Ridgewood Avenue., endangering
the safety, health, and well-being of the undersigned, the
entire neighborhood, and all persons who ..travel over said
Ridgewood Avenue.

WEREFORE, THE UNDERSIGNED hereby bring this matter to the
attention of the responsible officials of the Town of Barnstable and ,
call upon them to enforce the By-Laws and building code of the Town ..,
and to protect the residents, citizens and taxpayers thereof from the
