However, it seems that since your visit to the site a question has been raised (possibly by another town official) regarding the intended use for the structure which is for the containment of Green melt.This property was developed in the mid-1980s and was used for automotive repair and a contractor's yard.These uses continue today. We are both co-owners and tenants of this property and have been using our portion as a contractor's yard for approximately 20 years including the storage area in question. We only this year improved the containment bin with a roof and asphalt base.This green melt is being used to treat the commuter parking lots to the rear of our property. I spoke with the commissioner and our discussion centered around whether the property maybe grandfathered for these uses or the use allowed under certain conditions? He has asked that we look at the historical use of the property and provide further information. I ask that you give us two weeks to see what we can put together regarding these issues. He said that he has stored salt there for over 20 years but not in a shed... he indicated that someone (I don't recall who) by agreement with Mr. Callahan put the roof structure over the salt shed. He didn't realize no permit was pulled. Mr. Callahan indicated that he intends to comply by obtaining a building permit for the structure but will try to prove that his salt storage use is pre-existing. I instructed him to write a written response to our notice of violation for now and then he can provide whatever documentation he has in support of his use at the time of his building permit application. The property is also known as 86 Ridgewood Ave by the tax collectors records. e The following is an attempt to explain the usage of the property since it was built 1983-1984. . The building is an industrial space building consisting of approximately 10,000 square feet (250' x 40') with 6 industrial overhead garage doors. The building was built by John Morgan (`.`Morgan") and first leased to Dick Beard Chevrolet Subaru ("Dick Beard") from 1984 to 1991. Dick Beard used this property as an auto repair, sales, detailing and auto body shop facility. The building was subsequently lease by Morgan to Mark S. Hayes d/b/a Foreign Motor Car of Cape Cod as a general a automobile repair facility. In 1994, Mark Hayes and John Callahan purchased the property from Morgan under the above referenced corporate name and leased some of bays to other tenants. On MaY_15 c _ _ __ _— • .__ 19 86_..._...,, The Board of Appeals found Attorney Michael 'Ford'represented the petitioner's who are seeking relief for Property shown on a subdivision Plan as Lot 1, indicated as Lot 240 on the Assessor's Map; the locus contains -2.54 acres and has 50 feet of frontage on Ridgewood Ave., Hyannis located in a Business and RB zoning district. The petitioner's are asking the Board to overturn a decision of the Building Inspector rendered on February 1986, or a Variance from use regulations. At issue is that pdrtion of Lot 1 which is located on Ridewood Ave., and lies within the RB zone and serves two purposes at this time, a portion of the over flow parking of Pufferbellies and also the warehouse building that was constructed in 1985 - the petitioner believes that he has the rights to use that portion of the lot as access to camterci.al activity. This 50 x 100 foot parcel has since P at least 1964 been shown as part of the larger parcel to the rear and since that date has been and continues to be one (1) contiguous lot with the back parcel. It is the position of the petitioners that this particular portion of the lot has been utilized for access to the camiercial area of the lot for at least nineteen (19) years. The petitioners have granted an easement to the Executive Office of Transportation and Construction of the Comionwealth of Massachusetts over Lot 1 including a forty (40) foot wide strip running fran Ridgewood Avenue which the ECTC is utilizing for the .purposes of servicing the railroad tracks which it owns and presently leases to Hyannis & Cape Cod Railroad. This access is closed JJ off at 10:00 p.m. nightly. Dexter Bliss made a motion to grant the relief sought by the applicant, namely, a use variance - this would be a substantial hardship to the petitioner if he were not allowed access to his property - Chairman, Luke Lally, seconded the motion with the following restrictions: The use to be curtailed at 9:00 p.m. nightly The access to be used solely for gaining access to Pufferbellies The Board voted unanimously to grant a Variance to allow use of the residential portion of the premises for access to the business portion.
