Summary: Granted with Conditions Applicant: Merlesena Realty Corporation Property Address: 146 Rosary Lane, Hyannis, MA Assessor's Map/Parcel: Map 345 Parcel 017 Zoning: Business B Zoning District Background & Relief Requested: The objective of this application is to reuse an existing structure for two apartment units, a studio and a one-bedroom. The subject property is an 0.11-acre lot located on Rosary Lane and developed with a 1.5-story, 832 sq.ft. building that dates to 1926. Prior to 2003, the property had been used as a single-family dwelling. In 2003, Michael and Jayne Croteau purchased the property and improved it by converting the first floor to a hotdog, takeout fast food service called "Pinky's". The food establishment was permitted as-of-right as a principal permitted use in the B Business zoning districts. In late 2004/early 2005, the Croteau's applied for and were granted a variance to use the second floor for a studio apartment of 375 sq.ft. Apartments are a principal permitted use in the B Business Zoning District allowed as-of-right. However, the existing building and its location on the lot do not conform to the minimum dimensional requirements for multi-family (apartments) as specified in Section 240- 21.A(9). Variance No 2005-008 was granted to the dimensional provisions of Section 240-21.A(9); (d) - minimum front yard setback; (e) - minimum rear yard setbacks; and (0- perimeter green space. The variance was issued based upon the reuse of the existing structure. In May of 2008, the applicant purchased the property and is now seeking to convert the first floor (that area formerly occupied by Pinky's") to a second one-bedroom apartment unit. To accomplish the proposal, the applicant still requires variances from minimum front yard setback, minimum rear yard setbacks, perimeter green space as well as additional relief from provision (a) which requires a minimum lot area ratio of 5,000 sq. ft. of lot area per each apartment unit. The lot has only 5,201 sq.ft. of area and to support the second apartment unit requires the additional relief. ,f Town of Barnstable,Zoning Board of Appeals— Decision and Notice Appeal No. 2008-059 Modification of Variance No. 2005-008-Merlesena Realty Corporation-Multifamily Dwellings(Apartment) Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 25, 2008. An Extension of Time for holding the public hearing and for filing of the decision was executed and filed. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 24, 2008 and continued to October 1, 2008, at which time the Board found to grant the modification of Variance No. 2005-008 subject to conditions herein. Board Members deciding this appeal were, James F. McGillen, William H. Newton, Michael P. Hersey, Craig G. Larson, and Chair, Laura F. Shufelt. Attorney Peter L. Freeman represented the applicant. He introduce Mr.John P. Merlesena, owner of the Corporation and submitted photos of the building and site showing when it was Pinky's and now after exterior changes were made. Attorney Freeman cited that the use is a permitted use the only relief needed is in dimensional requirements as specified in the Ordinance. He cited that the lot and the building on it predates zoning and do not conform to today's zoning requirements. The intent is to reuse the building just as it is. Only interior adjustments and exterior maintenance will be needed. The Board and Attorney Freeman discussed the parking situation and it was determined that three cars can be accommodated on the lot. It was noted that the applicant wished to keep the circular drive on the lot should the use change in the future. It Board concluded that if this is variance is granted, to then change to another use permitted in the district would require the variance to be surrendered. Public Comment was requested and no one spoke in favor or in opposition to the proposal. The Board discussed the situation and agreed that it would be a less intensification in use to allow the two apartments however, Board Member, William H. Newton cited that he did not think this was an appropriate use of the property given the location was surrounded by commercial industrial type uses. The Board determined that they could grant the request by modification of the existing variance already issued for the property-Variance No. 2005-008. Findings of Fact: At the hearing of October 1, 2008 a motion was duly made and seconded to find the following findings of fact: 1. Appeal No. 2008-059 is that of Merlesena Realty Corporation seeking to modify Variance No. 2005-008 issued to Michael and Jayne Croteau for property addressed 146 Rosary Lane, Hyannis, MA. The applicant is seeking a modification of that variance to permit the lower level of the building, which had been used as a take-out fast food service, to be converted to an apartment use. Thereby creating only two apartments in the building, a studio and a one-bedroom unit. The subject property is shown on Assessor's Map 345 as parcel 017. It is in a Business B Zoning District. 2. The proposed conversion of the building to two, apartments with conditions on the number of occupants is viewed as a less intense use of the property than that of a drive-through food service establishment. 2 yA , Town of Barnstable,Zoning Board of Appeals— Decision and Notice Appeal No.2008-059 Modification of Variance No.2005-008-Merlesena Realty Corporation-Multifamily Dwellings(Apartment) 3. The applicant is proposing the reuse of the existing building and has not proposed any expansion. All alteration to the building will be interior only. The use of the property will rely upon that existing structure and its location on the lot as a legal pre-existing nonconformity. The proposed reuse, as apartments is-a principal permitted use in this zoning district. The variance being requested is only from the increase in dimensional requirements of that permitted use. 4. The circumstances that justify the grant of this variance are established by the fact that the building exists on the property and that no alterations to that building are being proposed. The building and its existing location is a topography feature of the property affecting the lot. This is a unique feature not generally shared by other lots in the area. 5. Two-family use is exempt from the requirements of Site Plan Review. 6. This relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance as it is a less intense use that could be allowed as-of-right in the B Business Zoning District. . The subject property is an 0.11-acre lot located on Rosary Lane and developed with a 1.5-story, 832 sq.ft. building that dates to 1926. Prior to 2003, the property had been used as a single-family dwelling. In 2003, Michael and Jayne Croteau purchased the property and improved it by converting the first floor to a hot dog, take-out fast food service.called "Pinky's". The food establishment was permitted as-of-right as a principal permitted use in the B Business zoning districts. In late 2004/early.2005, the Croteau's applied for and were granted a variance to use the second floor for a studio apartment consisting of 375 sq.ft, Apartments are a principal permitted use in the B Business Zoning District allowed as-of-right. However, the existing building and its location on the lot do not conform to the minimum dimensional requirements for multi-family (apartments) as specified in p Section 240=21.A(9).1 Variance No 2005-008 was granted to the dimensional provisions of Section 240-21.A(9); (d)- minimum front yard setback; (e).- minimum rear yard setbacks; and (f)- perimeter green space. The variance was issued based upon the reuse of the.existing structure. In May of 2008, the applicant purchased the property and is now seeking to convert the first floor (that area formerly occupied by Pinky's")to a second one-bedroom apartment unit. To accomplish the . proposal, the applicant still requires variances from minimum front yard setback, minimum rear yard setbacks, perimeter green space as well as additional relief from provision (a) which requires a minimum lot area ratio of 5,000 sq. ft. of lot area per each apartment unit. The lot has only 5,201 sq.ft. of area and to support the second apartment unit requires the additional relief. Town of Barnstable,Zoning Board of Appeals—Decision and Notice Appeal No.2008-059 Modification of Variance No.2005-008-Merlesena Realty Corporation-Multifamily Dwellings(Apartment) Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 25, 2008. An Extension-of Time for holding the public hearing and for filing of the decision was executed and filed. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 24, 2008 and continued to October 1, 2008, at which time the Board found to grant the modification of Variance No. 2005-008 subject to conditions herein. Board Members deciding this appeal were, James F. McGillen, William H. Newton, Michael P. Hersey, Craig G. Larson, and Chair, Laura F. Shufelt. Attorney Peter L. Freeman represented the applicant. He introduced Mr.John P. Merlesena, owner of the corporation and submitted photos of the building and site showingwhen it was Pinky's and currently after exterior changes were made. Attorney Freeman cited that the use is a permitted use and the only relief needed is in dimensional requirements as specified in the ordinance. He cited that the lot and the building on it predates zoning and does not conform to current zoning requirements. The intent is to reuse the building just as it is. Only interior adjustments and exterior maintenance will be needed. The Board and Attorney Freeman discussed the parking situation and it was determined that three cars can be accommodated on the lot. It was noted that the applicant wished to keep the circular drive on the lot should the use change in the future. The Board concluded that in order to grant this variance, if it were to change to another use permitted in the district would require the variance to be surrendered. Public comment was requested and no one spoke in favor or in opposition to the proposal. The Board discussed the situation and agreed that it would be a less intensification in use to allow the two apartments. However, Board member, William H. Newton cited that he did not think this was an appropriate use of the property given the location was surrounded by commercial industrial type uses. The Board determined that they could grant the request by modification of the existing variance already issued for the property—Variance No. 2005-008. Findings of Fact: At the hearing.of October 1, 2008, a motion was duly made and seconded to find the following findings of fact: 1. Appeal No. 2008-059 is that of Merlesena Realty Corporation seeking to modify Variance No., 2005-008 issued to Michael and Jayne Croteau for property addressed 146 Rosary Lane, Hyannis, MA. The applicant is seeking a modification of that variance to permit the lower level of the building, which had been used as a take-out fast food service, to be converted to an apartment use - thereby creating only two apartments in the building consisting of a studio and a one-bedroom unit. The subject property is shown on Assessor's Map 345 as parcel 017. It is in a Business B Zoning District. 2 Town of Barnstable,Zoning Board of Appeals—Decision and Notice Appeal No.2008-059 Modification of Variance No.2005-008-Merlesena Realty Corporation-Multifamily Dwellings(Apartment) 2. The proposed conversion of the building to two apartments with conditions on the number of occupants is viewed as a less intense use of the property than that of a drive-through food service establishment. 3. The applicant is proposing the reuse of the existing building and has not proposed any expansion. All alteration to the building will be interior only.' The use of the property will rely upon that existing structure and its location on the lot as a legal pre-existing nonconformity. The proposed reuse, as apartments, is a principal permitted use in this zoning district. The variance being requested is only from the increase in dimensional requirements of that permitted use. 4. The circumstances that justify the grant of this variance are established by the fact that the building exists on the property and that no alterations to that building are being proposed. 'The building and its existing location is a topographical feature of the property affecting the lot. This is a unique feature not generally shared by other lots in the area. 5. The Board noted that construction of the building in 1926 would predate zoning in the Town of Barnstable. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of January 05, 2005,the Board unanimously made the following findings of fact: 1. The applicant in Appeal 2005-008 is Michael and Jayne Croteau. The property is addressed 146 Rosary Lane,Hyannis,MA,located as shown on Assessor's Map 345 as Parcel 017. The property is zoned Business B. The applicant seeks a variance to the provisions of Section 3-2.l(J)Multi-family Dwellings (Apartments)to allow for the creation of a one bedroom apartment within the existing building. 2. The existing structure is a one and one-half story building that the Assessor's record states has 1,164 sq.ft. of living space. The structure houses "Pinky's"a hotdog,takeout fast food service on the first floor. That use is a Principal Permitted Use in the B Business Zoning District. The business use was established in 2003 and replaced the use of the structure which was a single-family residence. 3. The area of the lot is 0.11-acres and conforms to the lot requirements for the B Zoning District. The structure dates to 1926 and does not conform to the required 20-foot front yard setback. The structure predates zoning in the Town and would be considered a pre-existing legal non-conformity. 4. The existing second floor of the building estimated at 375 sq.ft. is vacant. The apartment is to be located within the existing structure, on the second floor and a part of the first floor of the building. Apartment use is permitted in the B Business Zoning District,however, the location of the unit in the existing structure can not satisfy the requirements of Section 3-2.1(J)Multi-family Dwellings. The , applicant therefore seeks a Variance to provisions: d)-minimum front yard setback; e)-minimum rear yard setbacks; and f)-perimeter green space. 5. The proposed apartment unit is minimal in that it is to be located in the existing area of the building. No expansion of the structure is being proposed. The proposed apartment has been before the site plan review committee and was found to be approval on November 04,2004. 6. Although no findings with regards to MGL Chapter 40 A, Section 10,the requested relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the Variance to the provision of Section 3-2.1(J)Multi-family Dwellings (Apartments),with the following conditions: 2 r 1. This Variance is granted to permit the development of a single,one-bedroom apartment only to be located within the existing structure at 146 Rosary Lane,Hyannis,MA. The apartment unit shall be located and built as per the layout plan presented to the Board—a copy of which is contained in the file and initialed by the Acting Chairman. 2. This Variance for the construction of the apartment unit can only be exercised by the applicant. 4. If the business use or area should change in any manner that would require more parking,the applicant or successor shall be required to designate a minimum of one on-site parking space to the apartment use only. 5. Development of the apartment unit shall be required to meet Board of Health Title V requirements. 6. Development of the apartment unit shall meet all Building Division and Fire Department requirements.
