Dear Sir:
Enclosed are several photographs of an increasing drainage problem
occurring to/on our property. We are located on the corner of St. Francis
Street at 81 St. Joseph Street in Hyannis The northern part of our property
faces a kettlehole pond which previous to the recent development of 3 "water view"
homes, was an already inadequate source of drainage. Located on the northern
face of our property are, 2 drains, one on each side of the street. It is .more
than obvious that these drains can no longer accommodate the normal run-off of
a heavy rain. We believe that the development of the property abutting the pond,
built by Sean F. Daly on St. Francis Circle ( Lot # 20A, DEQE-SE-311041 ) is a
direct cause of an increased encroachment of water onto our.property.
On June 5, 1985, we had a full day of rain. The former puddle to which we
were accustommed grew to a small lake of the approximate diameter of 30 ft.
It expanded up half our driveway- to within 15 ft. of our fron door and the next
step will be into our otherwise dry cellar. It also crept over the front yard
and up to within 10 ft. of the new house across the street. Unfortunately, some
unsuspecting person has .purchased this new home. It is a split level and has
water in its cellar already. The new owners have yet to occupy it.
We .are. disturbed that such a delicate balance of nature was ignored by DEQE.
We would like the developer, Sean F. Daly•, to take responsibility either
financially or structurally, to rectify this situation in collaboration with
the Town of Barnstable if necessary. The drains could be cleaned, re-routed, or
hooked into the recently installed system on St. John's Street. The landscaping
being done has further heightened the obstruction and will result in more flooding
at the next rain.' We feel that the property should be altered to allow easy
run-off of rain accummulation.
On June 7, 1985, I spoke with Steve Seymour in the Engineering Department
and to Joe Deluz in the Building Inspector's Department. A hold was put on the
occupancy permit ( # 26875 ) applied for by the South Harbor Association and
Sean F. Daly. I would advise. that no occupancy permit be issued until a new
inspection has been performed and Mr. Daly has had a chance to make the
proper changes or accommodations for the accummulated water so that it will
not damage our property.
We are at a disadvantage in our position since we can do.nothing short of
building a dike across our driveway entrance and install a sump-pump in our
cellar should the need arise. We would hope to avoid this by preventive and
timely measures now.
