Ring"Ctr. �. _• . , • On August 6, 1981 the Zoning Board of Appeals granted the owner, ARC Club Inc. (aka ARK Club Inc.') a special permit (No.'71981-38) to re— initiate a non-conforming use (a fraternal clubhouse) which had been discontinued for a period of more' than two years, and -that such re- institution of the club use in a residential zone would not be a detriment to the neighborhood nor derogate the spirit and intent of the zoning by-laws. The special Permit was conditioned upon 1) the use was limited to lodge members only; . 2) On-site parking shall be provided for 20 vehicles; 3) The building shall be -one-story andconstructed .on' the existing 40 ft by 60 ft. foundation;. and 4) there -shall- be' no alcoholic beverages served at this site in accordance with lodge'`regulations as explained by the petitioner. This ZBA Decision was appealed.by four plaintiffs on August 26, 1981, and on January 29, 1982, it was "ORDERED and ADJUDGED" by- a Justice -of the Superior .Court (superior Court No. 41412) that the, decision of the Board of Appeals did not exceed its authority, and that no modification - of Boards decision was required. .Further, The Court, found that the Zoning Board did not. err in .the, application .of the zoning by-law which';; allowed ''re-establishment 'of a 1.non-conforming use which has been discontinued for two (2) years".
