The purpose was to follow up on the original inspection last week concerning the alleged operation of a business(from an unidentified address). I did speak to the subject property owner of 28 Sauna, Mr. Galvin who assured me that he is a long time contract employee for a large construction company and is not running a business. Last week, he invited me to return this week to re-check the site as he understood the complaint and promised to take steps to improve the conditions. I returned yesterday with the owner's consent but without a prearranged or specific appointment. Mr. Galvin had agreed to improve the over all the appearance of the yard in order to address any visual misconception that he he is running an trucking business from his home. I found the site to be significantly improved with the simple removal of a large dump truck and a little reorganization of his personal vehicles and equipment. We photographed the site on this day as well as last week. Based on the current conditions as identified above, I found there to be no violation and I am closing out the complaint. The Board of Appeals found Attorney William Baird represented the petitioner who is seeking variance relief for the property located at Map 269, Lot 132-3, Lot. 66 Sauna Road, Hyannis in an RB zoning district for a parcel containing 11,250 square feet and. frontage of 75 feet. The lot was established in 1928 on a subdivision plan dated October,. 1.928,' shown on said plan as Lot 66. The petitioner and Roger .W. Roy, tenant-in-common took title to the lot in October, 1986. The lot is locaed in zone of contribution three (3) to a public supply well, and the area is not sewered; however, the petitioner has a the benefit of a Variance from the Board of Health for on-site septic system. The applicant is seeking a variance from width requirements, Section J, Appendix A of the Zoning By-law, , Intensity Regulations, lack of compliance of the 100 foot width requirement. Dexter Bliss made a motion to grant the relief sought based on the finding that if not allowed to use the lot, it would be a substantial hardship, the lot is long and narrow,, the surrounding lots are all built upon, this creates a unique situation due to the fact that the shape of the lot cannot be built upon because of surrounding structures, which constitutes variance criteria as sited in Chapter 40A, Section 10 of the Zoning By-law; also if the lot fronted on the street lengthwise the petitioner would have adequate width on which to con— struct a house - the motion was seconded by Richard Boy. Helen Wirtanen, Ron Jansson, Dexter Bliss and Richard Boy voted to grant the variance based on the findings; Gail Nightingale voted to deny the petition siting that she felt the prior owner was responsible for this.
