Many structures however, do not require Building Permits. The Shed Registration form is used for sheds under 120 sq ft that do not require BPs, to ensure that these structures meet Zoning setback requirements. Absent note 2, and the sheds would have to meet Zoning setback requirements, as required elsewhere in town. Building Code requirements: Apparently, if a shed is placed on a lot line it has to be fireproof, however, if it is setback 3-feet it does not have to be fireproof. Even with a 3-foot setback, the back wall of the shed will be difficult to maintain without trespassing on the adjacent property, and without destruction of adjacent property vegetation. It is recommended that if the Board agrees to hear this issue this evening, that approval of lots for the issuance of Building Permits be subject to all of the requirements in Steven Seymour's letter dated 9/10/07. Please note that MGL Section 81-U and your own Subdivision Rules and Regulations allow the developer the option of choosing among specified security mechanisms, subject however, to the following qualifier: "...sufficient in the opinion of the Plannin_g Board to secure performance of the construction of ways and the installation of municipal services required for lots in the subdivision shown on the plan, and the Planning Board may require the applicant specify the time within such construction shall be completed." Any release of lots should be subject to approvals as follows: 1. All of the recommendations in the memo from Steven Seymour dated September 10, 2007. 2. Approval of the security by the Town Treasurer as to surety and the Town Attorney as to form. 3. The Letter of Credit must contain language stating that it is self-renewing. We have language required in past Letters of Credit and will provide that information to the applicant. 4. The town must be able to call the Letter of Credit at a local, Cape Cod branch of the chosen bank. 5. The sewer easements referred to in Steven Seymour's letter need to be approved by the Engineering Division and recorded by the developer prior to the issuance of additional Building Permits. 6. The remaining 9 lots should be placed under a Planning Board Covenant and the recorded covenant returned to the Planning Board prior to the issuance of any additional building permits. If Mr. Morin wishes to change any of these recommendations, then this item should be continued to the meeting of 9/24/07 for further review. This is a complex building project. Morin, Trustee of Schooner Village Realty Trust notes that"waiver to securities including bond, cash, and covenants" was requested (page 1 of special permit) and that Condition 18 granted waivers (page 11), specifically for Subdivision Road Inspections, although there is no mention of a waiver for securities. The Planning Board, at its meeting of December 11, 2006 voted unanimously to allow 10 of the 29 lots within this Subdivision to be built upon: Lots 2, 3, 7, 8, 13, 17, 22, 23, 26 & 27 only. The Board allowed this action based upon satisfactory review of work to be completed before the end of the current year to allow for the applicant to take advantage of the "2006 Phase" of the building permits reserved for this development, specifically due to the affordable housing requirement that for every 5 houses built one needs to be affordable, i.e. 10 lot releases with 8 market and 2 affordable. The review of"work completed before the end of the current year" is satisfactory. The balance of the lots will be allowed to be built upon once the roadway is completed or a performance bond is posted in at least the amount of$173,000 which is the cost estimate of work yet to be done plus contingency. have attached the Registry of Deeds recording information for the special permits and subdivision plans for Schooner Village and Settler's Landing, both of which are subject to the approved building permit"Phasing Plan".
