We have looked into whether a special permit for a variance has been issued by the Special Permit Granting Authority and it is our understanding that no such, permit is in existence, and if one is, then the residents of Schooner Lane were not informed of a public meeting for such request. The fence at 110 Schooner Lane is over the maximum height restriction Article III Section 240-24.1.5 C Paragraph (3). In addition to this fence at 110 Schooner Lane, there is another fence recently constructed at 141 Schooner Lane that we believe may also be in violation not so much for its' height but more for the setback rules for a corner lot - Article IV Section 240-41 "Vision clearance on Corner lots." Attached are photos of the fences in question showing the actual height of the fence at p q g 9 110 Schooner and the location of the fence at 141 Schooner showing it at a corner. Since the Building Division is responsible for the enforcement and implementation of all zoning within the Town of Barnstable we respectfully request that you inform the owner(s) of the above properties that the non complying structures be removed immediately and to apply via the proper process for a special permit to construct such structures. Please be advised that if such special permit is requested in due course then it is the intention of the residents, here under represented by this letter, to vehemently oppose such application with the zoning appeals board. (h) Materials and design of paving, lighting fixtures, retaining walls, fences, curbs, benches, etc., shall be of good appearance, easily maintained, and indicative of their function. (5) Parking and loading design standards. (a) Parking facilities shall be landscaped and screened from public view to the extent necessary to eliminate unsightliness and monotony of parked cars. (b) Parking facilities shall be designed with careful regard to orderly arrangement, topography, landscaping and ease of access, and shall be developed as an integral part of an overall site design. (c) Any above-grade loading facility should be screened from public view to the extent necessary to eliminate unsightliness. (d) Outdoor storage shall not be permitted. ARTICLE IV F-e-� c `e a Supplemental Provisions §240_41.Vision clearance on corner lot""s. 5 d't._'p In residential districts, on corner lots, no fence, wall or structure, planting or foliage more than three feet in height above the plan of the established grades of the streets shall be allowed in any part of a front or side yard herein established, that is included within the street lines at points which are 20 feet distant from their point of intersection measured along said street lines which will materially obstruct the view of a driver of a vehicle approaching a street intersection. § 240-42. Planning Board standards/certain subdivisions. The Planning Board, as part of its review of subdivisions within 500 feet of the major arteries known as Routes 28, 132, 149 and West Main Street, is hereby authorized to: A. Prescribe, in distance and composition, a vegetation buffer strip between said major arteries and a proposed subdivision. B. Locate streets within a proposed subdivision so that: (1) Ingress and egress onto the aforementioned major arteries is safe, efficient and convenient; (2) A minimum number of roads intersect any such artery. Roads intersecting a major artery on the same side of the artery should, if possible, be not less than, 500 feet apart between side lines. Roads intersecting a major artery on the opposite sides of such an artery should, if possible,be not less than 150 feet between center lines. i 240:125 05-15-Zoos § 240-24.1.4 ZONING § 240-24.1.5 NOTES: t The third story can only occur within habitable attic space. Z See also setbacks in Subsection C(1)below. (1) Setbacks. (a) The front yard landscaped setback shall be 10 feet. (b) The SPGA may reduce to zero the rear and side setbacks for buildings to accommodate shared access driveways or parking lots that service buildings located on two or more adjoining lots. (2) Site access/curb cuts. (a) Driveways on Route 28 shall be minimized. Access shall not be located on Route 28 where safe vehicular and pedestrian access can be provided on an alternative roadway, or via a shared driveway, or via a driveway interconnection. On Route 28, new vehicular access, new development, redevelopment and changes in use that increase vehicle trips per day and/or increase peak hour roadway use shall be by special permit. (b) Applicants seeking a new curb cut on Route 28 shall consult the Town Director/Superintendent of Public Works regarding access on state highway roadways prior to seeking a curb-cut permit from the Massachusetts Highway Department, and work with the Town and other authorizing agencies, such as the MHD, to agree on an overall access plan for the site prior to site approval. The applicant shall provide proof of consultation with the listed entities and other necessary parties. (c) All driveways and changes to driveways on Route 28 shall: [1] Provide the minimum number of driveways for the size and type of land use proposed; [2] Provide shared access with adjacent development where feasible; and [3] Provide a driveway interconnection between adjacent parcels to avoid short trips and conflicts on the main road. D. Site development standards. In addition to the site development standards set forth in § 240-24.1.10 below, the following requirement shall apply: (1) Landscaping for multifamily housing. A perimeter green space of not less than 10 feet in width shall be provided,.such space to be planted and maintained as green r � r r area and to be broken only in a front yard by a driveway and/or entry walk. Single-family dwellings shall comply with the following requirements: (1) Parking and signage. All development within the SF District shall comply with applicable parking and signage requirements contained in Article VI, §§ 240-48 I 240:58 05-15-Zoos l , § 240-24.1.5 ZONING § 240-24.1.6 through 240-58, and Article VII, §§ 240-59 through 240-89, inclusive, of the Barnstable Zoning Ordinance.
