Based on a number of inspections,stakings and certifications, our firm has determined that the above project has been constructed substantially in accordance with the approved Site Plan f) dated 12/18/00 with only the following modifications. I I. The two garages were extended into the front yard setback 3.8' and 6.8' respectively, This modification was shown on a sketch plan prepared 1/6/03 and it is my understanding that this modification was subsequently approved by the L13A, in part because the original 40B petition requested and was granted bulk regulation relief. 2. The plans were revised 8/22/02 to provide decks and stairways off of the back of the units.This plan was approved by the Mass DEP which issued a Superceding Order of Conditions on the site.The stairways were constructed per this plan,except that the decks on units A and B extend 0,6'and 3.5' respectively into the.rear yard setback, and the stairway down from unit C extends 10.6' into the rear yard setback. Please note I have not yet examined the planting plan and quantities of landscaped material required for Conservation,but this will be required prior to them issuing the Certificate of Compliance. The basis of our survey is both current and former research our firm has done in the area and a plan done by the firm of Baxter and Nye recorded in PB 501 PG 90(attached with sketch). We have also measured from the town monument at the intersection of Massachusetts Avenue the deeded distances along Scudder Avenue and found our work to be correct per the deeded frontage distance calls. As you may be aware, a gentleman who owns land somewhat to the east of the affected area has disputed our fitrns work, apparently basing his concerns over a scaled distance off an old plan and an errant pin set out in the Scudder Ave layout. We suggest he hire his own private land surveyor to confirm the work of Baxter and Nye and our firm,as clearly no town land is involved in this dispute. Once the Barnstable Housing Authority is satisfied that the terms of the Regulatory and Monitoring Agreements with regard to the gross proceeds from the sale of the sixth market unit have been fulfilled and the building commissioner otherwise signs off on the unit's eligibility for certificate of occupancy, we can orchestrate the procedure for the exchange of the certificate of occupancy.for said gross proceeds.
