Two new names have been added to this business certificate since the original registration in April 2005. Apparently, at least one person does not live at the 130 Sea Street address but claimed to live somewhere on Camp Street. One of these men phoned yesterday and spoke to Sally at length. He later came into the Building Dept. Subsequently,he appeared in the Clerk's office at the very end of the business day. As a result of the conversation with Sally yesterday and later with Sue today, it was concluded that the applicant sought to amend the DBA form in order to obtain a state license as we have all been informed that the state now requires applicants to provide copies of proper business certificates. Although this action(adding other names not in residence) violates the requirements of the home occupation ordinance including the handwritten requirement to abide by it on the original form, we concluded that there is not much that can be done at this juncture. The amendments had already been made in the Clerk's Office and distributed to the applicant leaving us without much recourse. Sue relayed how she later had second thoughts about the amendments on her way home last night. We decided not to pursue the issue at this time because we do not want to impede the applicant's right to obtain a necessary state license required for a legitimate income. Ultimately, we agreed that all amendment requests will be shared and researched to eliminate deliberate violations of the home occupation ordinance. In the event that we receive complains concerning 130 Sea Street and specifically involving this business, we will seek immediate remedy. (14) If the customary home occupation is listed or advertised as a business, the street address shall not be included. �(15) No person shall be employed in the customary home occupation who is not a permanent resident of the dwelling unit. (16) Customary home occupations shall not include such uses similar to, and including the following: (a) Barber- and beauty shops. (b) Commercial stables or kennels.20 (c) Real estate or insurance office. (d) The sale of retail or wholesale merchandise from the premises. (e) The sale of antique or secondhand goods. (f) Service or repair of vehicles, and gasoline or diesel powered machinery. (g) Contractors storage yards. (h) Veterinary services. (i) The manufacture of goods using heavy machinery. (j) Medical or dental practice. (k) Fortune-telling or palm reading. C. Home occupation by special permit. A home occupation may be permitted in the RC-1 and RF Single-Family Zoning Districts,provided that a special permit is first obtained from the Zoning Board of Appeals subject to the provisions of §240-125C. herein, and _ subject to the specific standards for such conditional uses as required in this section: (1) All of the requirements of Subsection B(1) through (12) above. (2) There.is no more than one nonilluminated wall sign not exceeding two square feet in area, listing only the occupants'name and occupation. (3) Not more than one nonresident of the household is employed. (4) Home occupations shall not include the uses listed in Subsection B(16) above. (5) The Zoning Board of Appeals may permit the home occupation to be located within an accessory structure located .on the same lot as the single-family residential"dwelling unit. (6) Approval of site plan review is obtained. 20. Editor's Note:See Ch.376,Stables. 240:86.2 04-01-2005 it § 240-46 ZONING § 240-47.1 (7) The special permit shall be issued to the applicant only at his or her residence, and shall not be transferable to another person, or to another location. §240-47. Shared elderly housing. [Added 4-27-2000] The Zoning Board of Appeals may grant special permits to allow for the use of structures as shared housing to provide care and shelter for persons with special needs due to age or disability. Said special permits shall be issued only with respect to owner-occupied single-family residences to be occupied by not more than six persons not less than 65 years of age or in approved instances persons of lesser age in need of special care, in addition to the family residents in the dwelling, and shall be conditioned upon the maintenance of proper licensed status as a shared residence under the laws of the commonwealth, and upon such other requirements as the Zoning Board of Appeals deems appropriate with respect to safety, parking, screening and other amenities designed to. mitigate the impact of the use upon the neighborhood, and may be 'conditioned as to time and ownership in the discretion of the Board. § 240.47.1. Family apartments. [Added 11-18-2004 by Order No. 2005-026] The intent of this section is to allow within all residential zoning districts one temporary family apartment unit occupied only by a member(s) of the property owner's family as accessory to an owner-occupied single-family residence. A family apartment may be permitted, provided there is compliance. with all conditions and procedural requirements herein..... A. Conditions. A family apartment shall comply with and be maintained in full compliance with all of the following conditions: (1) The apartment unit shall not exceed 800 square feet or 50% of the square footage of the existing single-family dwelling, whichever is less. The Zoning Board of Appeals may allow up to 1,200 square feet by a special permit finding. In any case, the apartment shall be limited to no more than two bedrooms; (2) Occupancy of the apartment shall not exceed two family members; (3) The apartment shall be located within a single-family dwelling or connected to the single-family dwelling in such a manner as to allow for internal access between the units. The apartment must comply with all current setback requirements for the zoning district in which it is located. (4) At no time shall the single-family dwelling or the family apartment be sublet or subleased by either the owner or family member(s). The single-family dwelling and family apartment shall only be occupied by those persons listed. on the recorded affidavit. (5) When the family apartment is vacated, or upon noncompliance with any condition or representation made including but not limited to occupancy or ownership, the use as an apartment shall be terminated. And Mary E. Komar, Petitioners Chapter 40A §6 provides in part, "Any increase in area, frontage, width, yard, or depth requirements of a zoning ordinance or by-law shall not apply to a lot for single and two-family residential use which at the time of recording or endorsement, whichever occurs sooner was not held in common ownership with any adjoining land, conformed to then existing requirements and had less than the proposed requirement but at least five thousand square feet of area and fifty feet of frontage." Barnstable Zoning Ordinance section 4-4.2 Nonconforming Lots provides: 1) Separate Lot Exemption: Any increase in area, frontage, width, yard or depth requirement of the Zoning Ordinance shall not apply to a lot for single or two-family residential use which at the time of recording or endorsement: A) was not held in common ownership with any adjoining land; and B) had a minimum of 5,000 sq. Ft. of area and 50 feet of frontage or the minimum frontage requirement for the zoning district in which it is located; and C) conformed to the existing zoning if any when legally created; and D) was separately owned at the time of every zoning change which made it nonconforming. The sole question presented here tonight is whether or not lots A and B on a plan for Annie H. Bearse dated September 9, 1940 recorded in 1940 in Plan Book 64 page 3 I'are separately owned. Facts: Prior to November 22, 1940 Annie H. Bearse owned all the land shown on the plan. On that date she conveyed Lot C to John S. Bearse with a right of way over the z 12 foot way to Sea Street. (See deed'attached) On May 26, 1949 she sold lots A and B and the right of way to Barbara Burch reserving a life estate. (See copy attached) 1 On September 26, 1966 Barbara Burch granted an easement in the 12 foot way to the Cape & Vineyard Electric Company and New England Telephone and Telegraph Company. (See copy attached) In 1985 the town ran a sewer extension down Sea Street past the property which shows the 12 foot way. (See portion of plan). Barbara Burch conveyed both lots to your petitioners on December 30, 1996 by deed in Book 10547 Page 153. Since 1940 the town has assessed Lot A and B as separate lots with separate tax bills with a 12 foot way separating them. The new owners,Mr. and Mrs. Komar are moving into the area from Mt. Kisco, New York and intend to reside on the premises. They would like to erect a small house on lot B for guests and members of the family but do not wish to be committed to a family apartment. In reviewing the Staff Report we found no encroachment from lot 280 as is revealed by the plot plan, a copy of which is attached hereto. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, Town of Barnstable-Planning Department-Staff Report Appeal.No. 1997-65 Appeal Action by Administrative Official - Komar Appeal No. 1997-66 Variance Pursuant to Section 3-1.1 5)Bulk Regulations - Komar • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Staff Review: Zoning History According to Assessor's records, the house on Lot 102 was built in 1770 and the house on Lot 104 was built in 1942, so both predate zoning in this area. The following information is provided to give background for the "Adjacent Lot Question" and "Undersized Lot Area" and "Frontage and Access" Sections of the Staff Report. In 1925, Article 20 established that the Board of Selectmen, acting as the Board of Survey, had the authority to sign plans for division of land in the Town of Barnstable. The Board of Survey could impose requirements for improving roads to an accepted standard. Lots 102 and 103 appear on a Subdivision Plan of Land for Annie H. Bearse by Bearse& Kellogg dated September 9, 1940, which shows them as Lots A and B (see attached plan.) This plan was recorded in the Barnstable Registry of Deeds in 1941, but it was never signed by the Board of Survey. In 1951, the first comprehensive zoning was adopted in Hyannis, with this area defined as RA Residential A Zoning District. The RA Zoning District had a minimum lot size of 7,500 sq. ft. and minimum lot width of 75'. For the Board 's information, in 1960 the locus was rezoned to RA-1, Residents A-1 District, then to District RA with the 1969 comprehensive rezoning of the town. This zoning existed up to August 31, 1971 which then rezoned the locus to its present RB District(Article 19)with one acre minimum area requirement and 100' lot width required. Adjacent Lot Question: Lots 102 and 103 have had the same owner for many years. However, it is questionable whether these are truly adjacent lots as defined by the state Zoning Act or the town's Zoning Ordinance. The land immediately adjacent to Lot 102 is shown as a 12'wide"Way." According to Frank Schlegel of the Engineering Department, Lot 102 has never been taxed for the land shown as the"way". This suggests these should not be considered to be adjacent lots, nor should they be considered to have"merged." Undersized Lot Area: No zoning requirements for lot area were in effect when these lots were created in 1941. Both Lots 102 and 103 have the minimum 5,000 square feet required for lots in separate ownership to be considered buildable under Massachusetts General Laws Chapter 40A, Section 6. The attached GIS map shows that there are many lots in this area which are between .25 and .5 acre, with some smaller, and some containing more than one dwelling. To provide some space between the house on this lot and the house on Lot 104, it is recommended that the house on Lot 103 be set back a minimum of 50'. It is noted that a portion of the house on Lot 280 appears to be located on Lot 103. It is recommended that the applicant pursue a land swap with the owner of Lot 280 or find some other means of resolving this situation. Frontage and Access: This plan shows access to Lot 103 being provided by a 12'wide way between Lots 102 and 103. There is a dirt driveway which circles behind the house on Lot 102 which is outside the"Way" shown on the plan. This driveway gives access to Lot 104 but is almost nonexistent in front of Lot 103. Particularly in the area of Lot I Town of Barnstable-Planning Department-Staff Report Appeal No. 1997-65 Appeal Action by Administrative Official - Komar Appeal No. 1997-66 Variance Pursuant to Section 3-1.1 5) Bulk Regulations - Komar 103, it does not meet any of the standard definitions for adequate access to an ANR lot in.the Subdivision Rules and Regulations(public way, way shown on an approved Subdivision Plan, or existing way providing adequate access.) However, the Zoning Ordinance does not contain any definition for frontage. Some type of usable, legal access to Sea St. must be provided to Lot 103. For Lot 103, staff suggests it may be more appropriate to provide access by way of an easement along the north side of Lot 102. The owner of Lot 104 has erected a chain link along the property line between his lot and Lot 103 and appears to have enjoyed sole use of the way as a personal driveway for many years. A large thicket of very tall (10') shrubs, including Cape Cod Bridal Veil, which provides some privacy between Lots 102 and 103 would have to be removed if the"Way"were used for access. The applicant should be prepared to provide a deed or easement showing rights of access for Lot 103 over the way or alongside of the house on Lot 102. If this cannot be provided, the applicant should file a subdivision with the Planning Board to ensure there is legal frontage for the rear lots.. Summary of Zoning Issues: • Lot No. 102: With regard to its area of.33 acres, no zoning requirements were in effect when Lot 102 was first created in 1941. This lot has an existing house which was constructed in 1770. • Lot No. 103: This lot was also created in 1941 when there were no minimum area requirements. It is strictly speaking not adjacent to Lot 102 because there is a"way" between the two lots, which has never been included in the taxable land of Lot 102. Lot 103 was created by a plan which was not signed by the Board of Survey, and no improvements to the road were required. Frontage is questionable, but the applicant was never requested to make improvements. Staff Recommendation (Appeal No. 1997-66): If the Board finds to grant the relief requested in Appeal No. 1997-66, they may wish to consider the following conditions: 1. All uses of Lot 103 must conform to uses permitted in the RB Residential B Zoning District. 2. Construction shall conform to all setbacks and other bulk requirements of the RB Residential B Zoning District except that lot area may be reduced to .29 acres, lot width may be reduced to 65' and any construction shall be set back a minimum of 50'from the front lot line. 3. All requirements of the Building Division, Health Division, Conservation Division and the Fire District must be met. 4. Any home constructed on this lot shall be connected to town sewer. 5. All runoff must be contained on the lot. 6. The property shall be accessed from,a driveway to be improved with hardening and surfaced with gravel except that an apron of the first 20' from Sea St. layout shall be paved. This driveway shall run to the north of the house on Lot 102 and shall be constructed prior to the applicant obtaining a building permit. A plan of the driveway shall be reviewed by the Engineering Department prior to construction. 7. A copy of a recorded easement in favor of Lot 103 over the existing driveway for Lot 102 shall be provided to the Building Commissioner and the Zoning Board of Appeals before a building permit is granted for Lot 103. Front Room Ceiling (2nd floor frame) - Reinforce beneath the 9i existing closet joist w/ 2 ea 211x 8" S-P-F. Install a pair of 211x 6" beneath and in-line w/ the unsupported partition wall z above. Glue & nail assemblies togther, solid block joists at the support walls. 6 Den Room Floor (1st floor frame) - Open (remove) floor boards and install span-reducing girt of S-P-F stock on piers or strip and remove old joists replacing w/ new S-P-F stock. • Rear Room Ceiling (Storage floor frame) - Reinforce existing native 311x 6" w/ 1 ea 211x 6" S-P-F Glue & nail assemblies togther. Install Simpson A35 angle clips at joist ends. a Rear Kitchen Wall/Foundation - Strip away entire chimney and all rotted wood framing. Strip back inside corner same way. Clean up footing line and place new concrete foundation. wall. Re-build walls and floor w/ new framing stock. a Rear Storage Room (roof frame) - This has been cut open for the installation of a closet. The rafters at this location need a new header installed. The trimmer rafters need companioning w/ new 211x 6" S-P-F stock. Glue & nail assemblies. Once the header and trimmers are done install new 211x 6" collar ties on all rafter frames. Set height to provide clear headroom. e Bearing Headers - Stairway and interior openings can be rein- forced w/ 3/4" plywood or 211x 8" members notched into existing board walls.
