Si erely yours, Dennis Ring, cc: Elizabeth Hartsgrove Craig Fleming IRA Building Permit Narrative For 162 Sea Street Hyannis, MA 9/7/2017 This narrative is being submitted in accordance with the Building Department's request as part of a Building Permit application for a Change of Use, and modification to an existing egress component at 162 Sea Street, Hyannis owned by Southworth Willowbend, LLC. Specifically, the application includes designation of an additional bedroom and converting a door, which currently leads to an un-guarded roof-top,to a window. Since approximately 1999,the property has been licensed and used as a Lodging House, originally limited to "No More Than 14 Lodgers" (see attached License). Since 2005,the property has been continually rented as lodging space to approximately 8- 10 employees of Willowbend Country Club that occupy the premises from March through November. Southworth Willowbend, LLC and its affiliate Southworth Park, LLC, acquired the property in 2012 as part of its acquisition of the country club, and since that time the occupant load has never exceeded the 14 person limit specified in the 1999 License. In reviewing Town records, we noted that at some point in time, the criteria on the License changed from a maximum number of lodgers,to a maximum number of lodging rooms, specifically, 7 rooms (see copy of current License).The purpose of this application is to affirm that at some point since taking ownership, a previously un-declared space, began to be used as an 8th bedroom, and we are seeking permission to continue the current use and bedroom count (see attached plans). In accordance with IBC Chapter 3, Section 310, and the Massachusetts Amendments thereto, the current use and occupancy of the property meets the requirements of the R-2 Use Group as A Boarding House (Non-Transient)and Congregate Living Facilities. The use & occupancy is also consistent a Lodging House as defined in MGL. Chapter 140, Section 22. The IBC and Massachusetts Amendments further provide that R-2 occupancies, including Congregate Living Facilities with 16 or fewer persons are permitted to comply with the construction requirements for Group R-3. Based on the allowance of the R-3 construction requirements, we propose to eliminate the un-safe condition of the doorway leading onto the un-guarded roof, as it is not a required means of egress per the Code. According to Table 1015.1, a separate exit from the 2"d floor is not required because the occupant load of the space does not exceed 10 persons.The f main staircase in the house provides the required exit access to the 2 exit doors located on the main level of the house. In summary, by way of this Building Permit application, we seek to affirm the use of the previously un-declared space as an 8th bedroom, and to replace the existing doorway in the 2"d floor hall with a window to eliminate un-safe access to the un-guarded rooftop. Per requirements of the Building Code and the established Use Group,the occupant load will not exceed 16 persons, or whatever limit may be set by the Licensing authority. No construction is required for the change of use. The replacement of the doorway, if permitted, will consist of removal of the current door& exterior trim, closing in the opening to fit a vinyl replacement window, insulating the wall cavities in the vicinity of the new construction, replacement of exterior trim and interior finish work. William Humphrey described the proposal to create a bed and breakfast for 14 lodgers with service of meals to the lodgers. He noted that the property.was previously utilized as a bed and breakfast lodging facility known as, "Elegance by the Sea". The structure had run into disrepair and was foreclosed upon. Over the last two years the structure has been repaired and rehabilitated and it is now the petitioner's intent to utilize it as a bed & breakfast, serving meals for intimate dinning. The Board questioned if this could evolve into a private club, and and they questioned the applicant's .previous experience and knowledge in running a bed &breakfast operation.. The applicant cited that they had no previous experience in lodging but did have experience in the restaurant business. The Board noted that the proposal, with the variances requested, including the question of non-owner occupancy, was far from the intent and spirit of the bed &breakfast provision of the Ordinance, and perhaps in excess of what should be permitted. The Board cited that what is being proposed appears to be more of a small hotel and not a traditional bed &breakfast. It could evolve into a private club, or open to the public as a business. This is not the intent of the bed & breakfast provision of the ordinance. The Board cited that the applicant needs to show variance conditions and hardship for the relief to be granted. The Board stated that it appears this is a commercial establishment being imposed in a residential neighborhood and the relief could be more of a use variance.given the degree of divergence from the spirit and intent of the Zoning Ordinance. The proposal is that of a commercial inn and has little resemble to the traditional bed & breakfast family operation. The Board recommended that the applicant should have assistance in his presentation.and should have sought advise prior to applying to the Board. The applicant requested that Appeal Number 1998-54 and 55 be permitted to be withdrawn without prejudice, Public comment was requested and no one spoke in favor or in opposition to the request. Decision: At the Hearing of April 15, 1998, a motion was duly made.and seconded to grant the Applicant as requested a withdrawal of Appeal Number 1998-55 without prejudice. There are eight bedrooms within this residence, requiring a total of 10 off-street parking spaces. The site plan shows a total of 10 spaces proposed for this site (see attached site plan): However, spares.8, 9 and 10 appear to be located within the required north side setback. Spaces 8 and 9 are also located within the required front setback. There is a minimum 20' front, 10' side and.10' rear setback required in the.RB Residential.B Zoning Districts. Subsection (g) of the Bed & Breakfast provisions requires that no parking be located in any required building yard setback. There appears to be sufficient room for additional parking on the south side of the property and the rear yard area. Grass overflow areas can also be utilized for parking provided these are maintained with a grass cover in,good condition. The location of spaces 8, 9 and 10 are on the private driveway of the neighbor to the north. The applicant supports that the neighbors driveway is actually located on her property. Required off-street parking located along the north side of the subject site would not meet either the setback or screening requirements of Section 3-1.1(3)(F). Subsection (g) requires parking areas to be screened from adjoining residential properties by a fence or dense plantings,,not less than.five feet in height. Staff suggests that no parking be allowed in this area. The property consists of two sub-lots (Lot 1, Parcel 107.001 & Lot 2, Parcel 107.002). The house is located on Lot 1. Lot 2 is currently vacant but was previously occupied.by an accessory structure. The applicant proposes to locate the required parking on a portion of both these lots. Staff suggests that these lots be combined to allow sufficient area for parking on the same lot as the proposed use. Special Permit Findings: The standards for Granting a Special Permit require the following findings of fact to be made by the Board (Section 5-3.3(2): • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, (Bed&Breakfast in a Residential B Zoning District is a Conditional Use allowed by a Special Permit Pursuant to Section 3-1.1(3)(F) of the Zoning Ordinance), • that a site plan has been reviewed and found approvable in accordance with Section 4-7 (The site plan was found approvable on March 27, 1997, by Site Plan Review Committee- Site Plan Review No. 97- 11), and, • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning. ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Suggested Conditions: If the Board finds to grant the relief as an expansion of a legal pre-existing non-conforming use pursuant to Section 4-4.5(2). they may wish to consider the.following conditions: 1. For the purpose of this section, children under the age of(twelve) 12 years shall not be considered in the total number of guests. c) No cooking facilities including but not limited to stoves, microwave ovens, toaster ovens, and hot plates shall be available to guests, and no-meals except breakfast shall be served to guests. d) The owner of the property shall be responsible for the operation of the property and shall be resident when the Bed'and Breakfast is in operation. The owner shall file an affidavit with the Building Commissioner on an annual basis in the month of January stating that the property is the principal residence of the owner and that the owner is resident all times that the Bed and Breakfast is being operated. If the affidavit is not filed,.the operation shall cease forthwith and any Special Permit issued shall be considered null and void. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 15, 1998, at which time the Board granted the request with conditions. Board Members hearing this appeal were; Richard Boy, Gene Burman, Ron Jansson, Gail Nightingale, and Chairman, Emmett Glynn. Hearing Summary: Karen Driscoll the applicant and William Humphrey presented the appeal to the Board. The Board discussed the nature of the two appeals and it was agreed that both Appeals Number 1998-54 and 55 would.be heard concurrently. The Board questioned the issue of standing. William Humphrey cited that he was a part owner of the property with Eugene R. Guerrera. The Board,reviewed the lease presented to the file and determined it to be adequate for standing. I Town of Barnstable-Zoning Boafd•of Appeals Notice-Withdrawn Without Prejudice-Driscoll Appeal No. 1998-54 Special Permit Section 3-1.1(3)(F)Conditional Uses-Bed and Breakfast William Humphrey described the proposal to create a bed and breakfast with 14 lodgers to be able to serve meals to the lodgers. He noted that the property was previously utilized as a bed and breakfast lodging and was known as, "Elegance by the Sea". The structure had run into disrepair and was foreclosed upon. Over the last two years the structure.has been repaired and rehabilitated and it is now the petitioner's intent to utilize it as a bed &breakfast, serving meals for intimate dinning. The Board questioned if this could evolve into a private club, and questioned the applicant's previous experience and knowledge in running a bed & breakfast operation. The applicant cited that they had no previous experience in lodging but did have experience in the restaurant business. The Board noted that the proposal, with the variances.requested, including the question of non-owner occupancy, was far from the intent and spirit of the bed & breakfast provision of the Ordinance and perhaps in excess of what should be permitted. The Board cited that what is being proposed appears to be more of a small hotel and not a traditional bed & breakfast. It could evolve into a private club, or open to the public as a business. This is not the intent of the bed & breakfast provision of the ordinance. The Board cited that the applicant needs to show variance conditions and hardship for the relief to be granted. The Board stated that it appears this is a commercial establishment being imposed in a residential neighborhood,'and the relief could be more a use variance given the degree of divergence from the spirit and intent of the.Zoning Ordinance. The proposal is that of a commercial inn and has little resemblance.to the traditional bed &breakfast family operation. The Board recommended that the applicant should have assistance in.his presentation and should have sought advise prior to applying to the Board. The applicant requested that Appeal Number 1998-54 and 55 be permitted.to be withdrawn without prejudice. Public comment was requested and no one spoke in favor or in opposition to the request.. Permitted as-of-right: -Single and two-family dwellings - Lodging up to 10 persons by the family residing in dwelling a • August 31, 1971 Area Rezoned to RIB. Permitted as-of-right: -Single-family dwelling -Renting of rooms to not more than 6 lodgers by the family residing in the dwelling • November 7, 1987 The number of lodgers as-of-right was reduced to three. Special permit required for up to 6 lodgers as a conditional use. • February 20, 1997 Three room, six guest Bed &Breakfast allowed by special permit as a conditional use. Staff Review/Comments: Pre-existing Non-conforming Use Discussion: Staff would suggest that if the affidavits submitted by the applicant document to the satisfaction of the Board, a legal pre-existing non-conforming use- lodging for seven or more prior to the inception of zoning - the applicant may be entitled to a special permit for expansion of a non-conforming use pursuant to Section 4-4.5(2). Staff would further suggest that under this provision, there would be no need for the variance relief requested because the Board could roll the relief for the number of lodgers and the service of meals to lodgers within the Special Permit. Staff did cite this option to the applicant prior to application to the Board and recommended some assistance be sought in the proper permitting of the relief desired. If rights do exist as a non-conformity, those rights should be preserved: Although advertised as a conditional permit being sought, staff would suggest that the Board could grant a Special Permit under the non-conforming section_ as advertised, given that the form of relief-a Special Permit-and the desired relief remains the same as advertised. The need for a variance is removed and meeting that higher standard of proof is eliminated. t Also of note is that the Provision (a) of the Bed & Breakfast section of the Zoning Ordinance requires the premises be owner occupied. In this particular case, the applicant is a lessee of the premises and not the owner. l Land Use: The property is serviced by Town water and sewer. Significant improvements have recently been made to this property both to the interior and exterior of the residence and to the grounds. The property was in a state of disrepair and the owner of the property has recently restored much of the building. As the Board is aware, the Glenmere Neighborhood has been undergoing revitalization through private residents efforts and initiatives. Sea Street is a mixed use area containing numerous B&B. lodging, multi family and limited retail and restaurant use., Given that the services of meals as requested would be for guests only, it could be viewed as an accessory use to the B&B operations and not necessarily the addition of a new use to the premises. Site Plan Review: ` The proposal was reviewed by Site Plan Review on March 27, 1997, and the plans were deemed approvable and forwarded to the Zoning Board of Appeals. a 2 Town of Barnstable-Planning Department-Staff Report-Driscoll Appeal No. 1998-54-Special Permit Pursuant to Section 3-1.1(3)(F)-Bed and Breakfast Appeal No. 1998-55-Variance to Section 3-1.1(3)(F)subsections(b)&(c) Parking The Zoning Ordinance requires 1.2 parking spaces per bedroom for Bed & Breakfasts. There are eight bedrooms within this residence, requiring a total of 10 off-street parking spaces. The site plan shows a total of 10 spaces proposed for this site(see attached site plan). However, spaces 8, 9 and 10 appear to be located within the required north side setback. Spaces 8 and 9 are also located within the required front setback. There is a minimum 20'front, 10' side and 10' rear setback required in the RB Residential B Zoning Districts. Subsection (g) of the Bed & Breakfast provisions requires that no parking be located in any required building yard setback. There appears to be sufficient room for additional parking on the south side of the property and the rear yard area. Grass overflow areas can also be utilized for parking provided these are maintained with a grass cover in good condition. The location of spaces 8, 9 and 10 are on the private driveway of the neighbor to the north. The applicant supports that the neighbors driveway is actually located on her property. Required off-street parking located along the north side of the subject site would not meet either the setback or screening requirements of Section 3-1.1(3)(F). Subsection (g) requires parking areas to be screened from adjoining residential properties by a fence or dense plantings, not less than five feet in height. Staff suggests that no parking be allowed in this area. The property consists of two sub-lots(Lot 1, Parcel 107.001 & Lot 2, Parcel 107.002). The house is located on Lot 1. Lot 2 is currently vacant but was previously occupied by an accessory structure. The applicant proposes to locate the required parking on a portion of both these lots. Staff suggests that these lots be combined to allow sufficient area for parking on the same lot as the proposed use. Special Permit Findings: The standards for Granting a Special Permit require the following findings of fact to be made by the Board (Section 5-3.3(2): • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, (Bed&Breakfast in a Residential B Zoning District is a Conditional Use allowed by a Special Permit Pursuant to Section 3-1.1(3)(F) of the Zoning Ordinance), • that a site plan has been reviewed and found approvable in accordance with Section 4-7 (The site plan was found approvable on March 27, 1997, by Site Plan Review Committee-Site Plan Review No. 97- 11), and, • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Suggested Conditions: If the Board finds to grant the relief as an expansion of a legal pre-existing non-conforming use pursuant to Section 4-4.5(2). they may wish to consider the following conditions: 1. The property shall be developed in accordance with the submitted site plan, with the exception of parking spaces 8, 9 and 10. These parking spaces shall be relocated to the south side of the property in the general vicinity of the remaining off-street parking, but shall not be located in required yard setbacks. 2. The property shall be maintained so that the appearance of the building and grounds remain that of a single-family residence. r 7. This relief is granted specifically based upon the existing structure located on the site. If that structure is removed or significantly altered to any degree, this Special Permit shall expire. 8. The total number of bedrooms or size of the dwelling shall not be increased or expanded without further relief from the Zoning Board of Appeals. 9. A fence not less than 5 feet high shall be erected and continually maintained along the southern boundary of the property to screen the proposed parking area from the adjoining residential property to the south. 10. An approved ANR from the Planning Board shall be required to re-combine Lots 1 and 2 into a single lot. 11. Exterior lighting shall be low level, and shall not cause its illumination to fall onto adjacent properties. 12. Signage shall not be interior illuminated and shall not exceed four sq. ft. in area. 13. The locus shall comply with all Town of Barnstable Building and Health Divisions Regulations, licensing, and Fire Department Requirements. For the purpose of this section, children under the age of(twelve)12 years shall not be considered in the total number of guests. c) No cooking facilities including but not limited to stoves, microwave ovens, toaster ovens, and hot plates shall be available to guests, and no meals except breakfast shall be served to guests. d) The owner of the property shall be responsible for the operation of the property and shall be resident when the Bed and Breakfast is in operation. The owner shall file an affidavit with the Building Commissioner on an annual basis in the month of January stating that the property is the a principal residence of the owner and that the owner is resident all times that the Bed and Breakfast is being operated. If the affidavit is not filed, the operation shall cease forthwith and any Special Permit issued shall be considered null and void. The requirement for filing of an affidavit shall not apply to Bed and Breakfast operations legally established prior to October 1, 1996. e) The single family residence in_which the Bed and Breakfast operation is located shall be maintained so that the appearance of the building and grounds remain that of a single-family residence. . f) If the property is not served by public water, the applicant shall provide evidence to the Zoning Board of Appeals that the proposed use will not have any detrimental impact on any private water ° supply on-site or off-site: g) No parking shall be located in any required building yard setback, and parking areas shall be screened from adjoining residential properties by a fence or dense plantings, not less than five feet in height.
