The purpose of this letterls to inquire whether it is your position that the rear building is a lawfully protected non-conforming four residential apartment building. I have reviewed your file and it appears that there is no information therein by which you may conclude whether or not the'.rear building is a' lawfully 'protected non-conforming apartment building containing .four apartment units as presently used. You have asked me to review the zoning history-of the site and supply you with any evidence available concerning the historic use of the rear building. As you know, the Town adopted zoning in`1929 thereby dividing the town.into two districts, one residential and the other being a non-residential district which at the time of the adoption of the bylaw was devoted to business. or industry. It appears that no comprehensive zoning was adopted until 1949 by which the Town was divided. into,.two,districts, residential and business. From 1949 the property was and has been to the present in various residential zones, in all cases requiring special permits for the construction and use of an apartment building. I have checked with the zoning board of appeals and they have .no record of any special permit having been granted for the property. However; it appears, as above set forth that the rear building was constructedl in 1940 at a time when there was no zoning regulation .in place relating. to apartment buildings. Enclosed are statements from the current owner whose-family:purchased the property in 1984 from Richard and Joan Murphy and from Richard Murphy who acquired.the property in 1968 from the Prada family who had owned the property since 1941. The statements indicate that4rom 1968 to the present the rear 'building has been operated as a four residential apartment building. In addition, the broker, Bernard Klotz, has indicated that a personal inspection of the rear building leads one to.-believe that, because of the finish work and layout, the rear building has always contained four residential apartments from the date of its original construction. According to the information presented to me there is no evidence of abandonment of any of the apartments from the date of the construction of the building in 1940 to the present. Also enclosed is some information from the Town website and from the. Board of Health records and copies of the current leases for each of the four apartment`units in the rear building which may be of some assistance. This variance will allow you to continue to utilize.-the third level at 217 Sea Street, rear building, Hyannis for human habitationtl with' the lower floor-to-ceiling height currently in existence there. The State Sanitary Code requires a minimum floor-. to-ceiling height of seven feet (84 inches) in every habitable room.
