DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws,rules and regulations. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. SPECIAL PERM I VAR P DECISION AND NOTICE ------------------------------------- --MAY-It-P2ZO-------- APPEAL : #1989- 19 PETITIONER: RONALD RUFO AND JAME SILVA ------------------------------------------------------------ At a regularly scheduled hearing of the Barnstable Zoning Board of Appeals, held on March 23 , 1989, notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts, the petitioners, Ronald Rufo and Jame Silva, petitioned the Board for a Special Permit, pursuant to the Barnstable Zoning Bylaws, Section 4-4.3 , Reconstruction of Damaged Non- Conforming Buildings. The petitioner seeks a Special Permit to allow the L renovation of ,a non-conforming building. Subject. building is one of four residential structures on a . 57 acre parcel of land located off of Sea Street in Hyannis. All four buildings are rental property. The petitioner contends that the building in question (building #4 on a plan drawn by the petitioner) is sinking because it does not have a foundation. Petitioner,, seeks to construct a concrete block foundation and 'to construct a 7 x7 foot addition on one side of the building and a 10 x 6 foot addition on the other side of the building. The addlitions will square off an Irregularly shaped building. The petitioner indicated that at some future time he intends to construct a second floor. The Board took the matter under advisement pending an inspection of the site. FINDINGS OF FACT: Based upon the information submitted, the Zoning Board of Appeals, by a motion duly made and seconded, made the following findings of fact: O 1 the building is one of four non-conforming rental structures on the lot; 2 the . 57_ acre parcel is crowded with four buildings and parked automobiles ; y`r i 3 construction of the foundation and the two small additions would not be detrimental to the neighborhood and would not derograte from the intent of the bylaws. Petitioner seeks to construct a concrete block ..foundation and 'to construct a 7 x7 foot addition on one side of the building and a 10 x 6 foot addition on the other side of the building. The additions will square, off an Irregularly shaped building. The petitioner indicated that at some future time he intends to construct a . second floor. The Board took the matter under advisement pending an inspection of the site.
