I had no money so I did all the work myself, coordinating those efforts with all building commissioners through the years,Herb Stringer,Joe Daluz. Ralph Crossen,Tom Perry, Paul Roma and Jeff Lauzon. I had some surgery on 1/31 and needed some help with these two units,occupied respectively 10 and 8 years by the same tenants. They were a mess. Three days were required just to remove general debris. I was confident that we were engaged in cosmetic restoration of damages and not engaged in any Improvements which required a permit. I replaced some light switches which were unsightly,intend to replace broken/unusable kitchen sinks, covered sub flooring with laminate,replaced some unusable kitchen cabinets but engaged in no additions, merely restoration and cosmetics. That said,I was not as"hands on"as past projects. I ask for an appointment in order to determine what I need to do in order to restore my identity with the Department_ I have owned Craigville Realty, Inc.,since 1972 and always complied with any requests/instructions from The Town. I am keen on doing my duty and finishing these units as they are earmarked for two subsidized tenants for whom the. Housing Assistance Corporation is desperately seeking accommodations. 149 Sea Street is not under the radar as far as Town Records are concerned. These premises have been part of the Affordable Accessory Apartment Program for many years and included in the inventory of affordable housing units for the Town. These apartments are inspected annually the Tn of Barn Board of Health. I have queried my foreman about the two electrical boxes in the downstairs kitchen. He reports that the former connection(s) was/were below the kitchen counter, and he asked our electrician to run accessible outlets for a microwave and a GFI from that old outlet. I will have that electrician, very well respected in the Town, to have them '"blessed/sanctified" by the elec inspector. If there is any problem with that process, we will. have them deactivated, capped and sealed off against use. I will have keys to all the apartments, although we are only engaged in preparation of the vacant units, 3 and 4. We have suspended activity, especially replacement of the basement staircase as you inclination was that we needed to file a permit for that purpose. Well, we did some clean-up and organize remaining materials. My philosophy for restoration of our units between tenants is that we are able to engage in any cosmetic restoration/repairs from the walls in/ceilings down/floors up. In these units, we needed to replace the kitchen cabinets, rip up wall to wall, paint EVERYTHING and replace kitchen sinks. You alluded to the attitude of some inspectors as sinks needed permits, and I await your instruction in that regard. We have mounted some cabinets, replaced flooring with laminate and painted, painted, painted. We have not made any efforts re the bathrooms. See you there. Cordially, Martin C. Tim O'Connell (Health) accompanied me to address the trash and inoperable bathroom. After a discussion with Sgt. Jean Challies concerning the state of the property and its 32 calls since Sept. 1", 1 suggested that property owner meet with us. Jonathan Tyler appeared about an hour later. He declared that he did not know one single person milling about and assumed to be living in the rear unit. It was estimated that about 10 or 12 people were living here. Not one person was on the lease but some claimed to have paid Andrew rent. The landlord claimed that nobody paid any rent and he had commenced with the eviction process. Jonathan Ty ler subsequently y asked Sgt Challies to arrest the squatters. She told him that he would have to trespass them. Jonathan immediately ordered her to trespass them and as a result, all parties were given 30 minutes to collect their personal items and leave the premises. They were advised at that time and as each one left, that if they returned to the site they would be arrested. Bags and items were brought outside and deposited in front of the front unit of 149A. While packing, Andrew advised Sgt. Challies that he would surrender his girlfriend's dog, Spazz to Animal Control. (Andrew later changed his mind but the ACO had already responded by that time and installed the male dog in the back of the van. The ACO refused to release the dog to Andrew as Spazz is licensed solely to his girlfriend, Elizabeth Ables who remains incarcerated). One is now known as 149A Street—the rear property owned by J Tyler and the subject of this report. The dwelling bordering Sea Street is owned by Traywick. Both structures are very old—reportedly circa 1900. I responded to a health complaint with Jaime Cabot, Health Inspector on 12/15/09 regarding 149A Sea Street. As a result of reviewing the available material with the Building Commissioner and having seen the properties, it is my opinion that both dwellings were at one time contained on one lot and subsequently divided- thus the two 149 Sea Street addresses. Later, the A was added to distinguish the front and rear buildings probably for emergency purposes and mail delivery. The BC indicated that he agreed this is a logical turn of , events. This locus was formerly in the RA district which allowed for 2 family dwellings. I believe that both dwellings morphed into 2 families as a matter or right under the RA zone and before any change restricting the site to a sf use. No building permits are in the file for the creation of the second unit but that is not unusual given the time frame. I am unable to find or ascertain whether or not there is a separate file for the 149 Sea Street property owned by Traywick. The rear property is a registered rental. The condition of said property is poor to fair: There are some structural & safety concerns—chimney(poor shape),bulkhead access and basement (electrical cords, wiring and oil-fired furnace should be checked, did not find permits for newer installation). Who is the person describe in the below email, complaining about'149 A Sea Street not 146A. First of all, there has been only 4 complaints with the health division on this property dating back to 2014. So the quote "....deplorable conditions that no one addresses ..." is false. I was summoned to property in 2014 along with Zoning Officer Robin Anderson and we had the back house cleared of squatters and vagrants after a lengthy investigation along with multiple site visits with BPD. I had owner in court multiple times and in front of a magistrate on show cause hearings due to 2014 complaint. He was ordered to keep back house vacant until unit is repaired and re-inspected by myself. Currently it seems not occupied and construction is visibly under way.Although I did not enter back unit. Furthermore, other complaints on 5-20-5 and 6-20-15 were swiftly investigated and resolved. Building permits are a Building Department problem. Not a Health problem. Although I did observe in View Point that owner did apply for a re-side permit on 8-5-16. He has a functioning septic system (2005-470 4BR) which was ordered to be installed per BOH in 2005.The front apt is a one bedroom apt and is the source of the current complaint per Mr.Velluti's testimony this morning. He stated people are in and out at all hours of day/night. I explained this is a police matter or may not be a problem at all, depending on why they are stopping by so frequently. I then summoned occupant from front apt and he stated only he and his wife live there and friends do stop by. I explained that there is to be no overnight guest due to the small dimensions of dwelling unit. He agreed. Mr. Velluti then explained Police are called to this property constantly due to the front Apt. I suggested he ask Police to look into Chapter#160 Chronic Problem Properties. This will hold owner responsible and seems to be the center of the problem (illegal activity)at this property. I - I have talked with owner via phone conversation (yesterday) and explained that no one is allowed in the back unit for living purposes and if I do find this is to be true he will be issued a ticket along with being brought back in front of magistrate. I did observe some debris and trash at property that I will have owner clean up. I will try to schedule a site visit tomorrow(8-10-16) with Robin and owner to take a more comprehensive look at back unit and to addresses any other problems (i.e trash, debris and proper permits)on site. If there is any other course of action on this property you would like me to take please advise. Although, me and Robin have spent a plethora of.time and resources on this property and take offence to below email and its references to "...no one seems to care..." quotes. Norman Sylvester. Reported to this site on 10/21/2014 as the result of a direct request by Sgt Jean Challies last week. It is also noteworthy that Tim O'Connell had been detained at an intersection by a sergeant working a detail to inquire about this property as well. I arranged a BIRST inspection for the afternoon of 10/21/14. The inspection commenced with entry into unit B of 149A(rear structure). This dwelling contains two units—identified by residents as Unit A& Unit B. We were greeted by a young man who asked if were there because of a noise complaint. He explained that they were jamming and admitted they were a little loud. We asked if he was the tenant but he denied living there and said he was just hanging out jamming with the others. A large dog ran out from inside the house and although curious about us did not act aggressively or otherwise threaten us. Later, I observed that he was quite happy to be playing in the yard tossing and chasing a dog toy. Lt Sylvester explained we were there for safety compliance inspections and asked if the tenant was present. Andrew Lyons (2/26/82) appeared and stated that he resides there but the official tenant is his girlfriend(Elizabeth Ables). She was arrested two weeks ago and is expected to be away for 6 weeks and then off for a psych evaluation. He says she has a lot of problems and needs help. We entered the property through the side door into (presumably) a seasonal mud room. There was a locked door straight ahead and entry into the kitchen on the left. This room was filled and littered with clothing—some in bags - some clothing scattered loosely around. The kitchen was un-useable by every day standards. Food was everywhere, dirty dishes scattered all over the place, the oven door was missing the exterior panel and the counters were full of miscellaneous food items and dishes. The living room was occupied with two "guests"watching videos. This room was also disheveled. The upstairs contained three bedrooms and a bathroom. All rooms had mattresses (no sheets) and clothing and personal effect in each room. The lack of housekeeping is typical of what is normally found in drug houses. Missing fixtures, large holes punched in doors and walls, general filth, naked bedding on the floor, l__ a lack of proper bedroom furniture and inappropriate storage of clothing and food are conditions noted in drug houses. This lends credence to the complaints of the neighbors concerning drug use, sales and prostitution. (Photos on file) On our way out of the kitchen I turned to ask Andrew what was behind the door in the "mudroom". The door was locked and Andrew stated that Haley Corrigan resides there. She is a problem and is responsible for"a lot of drama". They want her to leave but she refuses. She was reportedly not there at the time we were on site but was said to be . applying for a job somewhere. We walked around the side/rear of this unit and found the rear door to have a bar nailed across it to prevent it from being opened (photo on file). This space did not appear to have the proper useable egress required of bedroom and so Patrick issued an exit order. Andrew signed for the copy and I instructed him to tape it to her door. Before we left, he informed us that he does not have a land line and cell phone was stolen last week, We proceeded to the front unit-Unit A (facing Sea Street as you drive in). The entry is on the left side behind the fence gate. It is a one bedroom unit with a kitchen, bathroom and living room. Three adults were in the living room, one woman in the bathroom. The man hat greeted us said he was napping. He later told us he has lived here for 9 years. The room was found to be filled with personal effects,bikes, books and portable heaters and fans. An extension cord was found to be running underneath a scatter rug (immediately ordered to be corrected by Lt. Sylvester). The front door entry was filled with stored items (photo on file); this was also ordered to be corrected. The kitchen ceiling was covered with plastic. The tenant explained that the ceiling was soaked from the bathroom tub upstairs and had caved in. In fact,the plastic was so full of water it had given way and flooded his kitchen area a couple of days ago. The landlord is not responsive. The following issues must be addressed at 149A Units A&B • Eliminate the rear"bedroom" created in the mud room by removing all un- permitted work performed in order to create the space. Unit B Exit order on file. • Remove un-permitted replacement slider and replace unit to code with a permit. Unit B • Repair plumbing in upstairs lav or otherwise prevent water leakage channeling into the downstairs ceiling. Unit B • Repair the ceiling in Unit A • Confirm tenants maintain clear path to front door. Unit A • Confirm tenants removed all extensions cords running underneath throw rugs. McDonough 48 Cerdan Avenue Boston, MA 02131 RE: A=307 062 149A Sea Street, Hyannis Dear Mrs. McDonough: At the request of your tenant, Ms. Sullivan, an inspection was made of the fireplace in the dwelling located at 149A Sea Street, Hyannis. There is a wooden beam which appears to support the mantle and brick veneer wall which is exposed to flames within the fire box. The beam is badly charred and is a definite fire hazard. I have informed the tenant not to use the fireplace until it is either repaired or replaced. This department is unable to document any history of permits or inspections at this site. If you have any records concerning the construction of this chimney or of inspections performed please forward copies of same to this office.
