Dear Kerry,
Service of the enclosed notice is requested in hand if possible to T..F. Scott Darling, III at 16
Sauna Road, Hyannis, MA. .
In the absence of in hand service, please:
a) Make service by leaving a copy at 16 Sauna Road, Hyannis. This property is owned by
Mr. Darling and is believed to be a usual, if part time, residence.
b) In addition, please send a 'copy to Mr. Darling at the Somerville address shown on the.
letter.
This office has provided the town building inspector's office (David Mattos) with a copy of the
demand, so mailing to the building inspector is not necessary.

Re: DEMAND FOR REMOVAL OF UNLAWFUL ENCROACHING STRUCTURE
Dear Mr. Darling;
Your neighbor, Linda Russell Holmes, has retained this office to effect the removal of a fence
constructed without authority on our client's property by you in violation of our client's rights
and the zoning laws of the Town of Barnstable.
As shown on copy of CapeSury plan entitled "Sketch Plan Showing Existing Fence
Encroachment" dated June 23, 2004, a copy of which is attached to this letter as Exhibit "A" (the
'Plan"), Nis. Russell-Holmes'property, which is located at 38 Shady Lane, Hyannis, is identified
as Lots 57, 58 and 59. The rear portion of your property, which is located at 16 Sauna Road, is
shown on the plan as'Lots 64 and 65. The existing fence encroachment is clearly identified on
the plan.
Although you were informed of the existence of the encroachment by letter from Attorney Laura
McDowell-May dated August 19, .2004 (copy attached as,Exhibit "B"), you have failed to
remove the fence or to respond to Attorney McDowell-May's letter.
If you acknowledge constructing this fence and that it encroaches upon Ms. Russell-Holmes's
property, we urge you to contact,this office within thirty (30) days from receipt of this notice to
arrange for removal of the fence and restoration of Ms. Russell-Holmes's property to its original
condition.
If you allege that the fence was not constructed by you and/or that it does not encroach upon our
client's property, we invite you to submit written verification of your claim to this office within
fourteen (14) days next following receipt of this notice.

Failing a timely and appropriate response, be advised that Ms., Russell-Holmes will remove the
fence and restore her property to its original condition,holding you responsible for all costs and
expenses for removal and restoration or otherwise arising out of your illegal actions, including
but not limited to court costs.and legal fees, if any, as maybe imposed.by a'court of competent
jurisdiction.
HEREWITH FAIL NOT AT YOUR PERIL.
