DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. Please note that I have provided two different discussions covering two different sections of the Zoning Ordinance. The facts regarding the subject lot and the adjoining lots are as follows: The Locus has been created by a merger of two lots 54 and 67 on Land Court Plan i 1328-B Sheet 2, a Land Court Plan filed in 1927. Because there are two lots,they travel through the block on which they sit. Lot 54 fronts on Shady Lane and Suomi Road, and Lot 67 fronts on Sauna Road. The Town of Barnstable Tax records show it to be 45 Suomi Road. Calculations indicate that Lot 67 has approximately 9,150 square feet of land and Lot 54 contains approximately 9,750 square feet of land. The two together contain 18,900 square feet of land or approximately .43 acres. Lot 54 fronts 132.75 feet on Suomi Road and Shady Lane; Lot 67 fronts 61.75 feet on Sauna Road. The two have merged into one lot of approximately .43 acres with road frontage totaling almost two hundred feet. The title history of the Locus,that is the combination of lots 54 and 67 in Land Court Plan 11328-B Sheet 2 is as follows: SECTION A 1. Eric W. On February 28, 1985, by Article 1 in the Town Meeting in the Town of Barnstable, the minimum lot size for the subject area was increased to 43,560 square feet. Based on the foregoing, it is my opinion that under Section 4-4.2 (1)of the Town of Barnstable Zoning Ordinance,this lot was not held in common ownership with any adjoining land at the time of the zoning change which made it nonconforming; and has at least 5,000 square feet of area and 50 feet of frontage; and conformed to the existing zoning when legally created; and was separately owned at the time of every zoning change which made-it nonconforming. As will be revealed, Locus is exempt under a different clause of the Town of Barnstable Zoning Ordinance,but let us first discuss the title history of Lots 52 and 68. Lots 62 and 58 were sold along with the two lots of the Locus by Eric W. Rosengren as Trustee of the of The Rosy Grove Trust to Eric W. Rosengren and Hilja E. Rosengren by deed dated April 30, 1951 and recorded in the Land Court Barnstable County as Land Court Document No. 34462. Eric W. Rosengren and Hilja E. Rosengren in turn sold and conveyed Lots 52, 54, 67, and 68 as well some other lots to William A. Rosengren by deed dated Sept. 3, 1958 and recorded Land Court Document No. 69826. William A. Rosengren in turn sold Lots 52, 54, 67 and 68 to Greystone Realty Corp. by deed dated February 9, 1989 and recorded as Land Court Document No. 478088. Greystone Realty Corp. then sold Lots 52 and 68 to Barnstable Holding Company Inc. by deed dated Feb. 9, 1989 and recorded as Land Court Document No. 478090. Copies of these instruments are included for your reference. Thus the split in title of the Locus Lots 54 and 67 on one hand, and Lots 52 and 68 on the other hand, occurred in 1989. On February 28, 1985, by Article 1 in the Town Meeting in the Town of Barnstable, minimum lot size for the subject area was increased to 43,560 square feet. Based on the foregoing, it is my opinion that under Section 4-4.2(2)of the Town of Barnstable Zoning Ordinance,this lot is protected on what is called Common Lot Protection. That section states as follows: Any increase of the area of frontage, width,yard or depth requirement shall not apply for a period of five years from the effective date of the change to a lot for single or two family residential use that is held in common ownership with not more that two adjoining lots, J (which is the case here); and has a minimum of 7,500 sq. feet of area and 75 feet frontage or the minimum frontage requirement for the zoning district that it is located(which is the case here), and was recorded or endorsed on a plan that conformed to zoning when it was legally created and conformed to applicable zoning requirements as of January 1, 1976(which is also-the case here). Section 2 goes on to state that "the protection afforded by this paragraph shall become vested upon the sale or transfer of the lots so protected into ownerships separate from that of adjoining lots or the building there on of a residence". When the title split in 1989 (Lots 52 and 68 were split off from Lots 54 and 67), it was within the five year period from February 25, 1'985 change in lot size. Therefore, it is my opinion that under section 4-4.2 (2)of the Town of Barnstable Zoning Ordinance,this Lot meets the requirements by having at least 7,500 sq. feet and 75 feet of frontage, and conformed to the existing zoning when legally created and was separately owned at the time of every zoning change which made it non-conforming, and the protection was vested by the sale or transfer of the lot into ownership separate from that of the adjoining lots. Therefore, it is my opinion that the Locus is "grandfathered" from Lots 68 and 52 under Section 4-4.2 (2) and may be built upon for residential purposes because the lot conforms to Section 4-4.2 (2) of the Zoning Ordinance.
