We are pleased with your efforts to assist us in a usually quiet
neigh!,orhood that hr s some problems. I received the copies of the letters
from the police enlef and also the building inspector, We still have a few
questions. On the parking issue ,the zoning takes in the parking spaoes
behind the restaurant againsTf the house , however` ,'the rest of the house
lot Is not zoned for bti.siness . They park .all around this house and hate
installed lights for tnis reason ana also nave signs for Villa parking on
the front of the residence.
Also, the letter states that side walk cafes- should have a set back
of at least ten feet from the street or walk or access way. This one is
right on the edge of Newton Street and is also a dan6,-roue corner ,. I feel
that any safety official would do something about its location. These are
things that need someones attention ,we, invite your. investigation.
We feel it is the wrong area for business thats trying to expand, we
felt the same way when she asked for Beer and Wine, the next time it was
full liquor and now sidewalk cafes. We- have lived with slot of restaurants
in the same location for many years _ , we-,-had no problems, no street parking
and no parking lots, plus no complaints. I feel if something is not
done about these conditions now, are problems will only get bigger in
the weeks to come.
Do what you can for us, we are praying for a quiet season, and we are
not chronic complainers.

Dear Board Members:
Recently_, at my request, the Town of Barnstable Engineering Depart-
ment made a survey of Newton- Street, Hyannis, in reference- to the Villa
Vecchione restaurant. The survey indicates that the restaurant awning
is located in the Town street layout. The Board-of Health has jurisdiction
over outside cafes -and printed regulations are available. Section (a) of
the regulations reads: "The dining area must be setback ten (10) feet from
the property line, sidewalk, or public access way (parking lots, etc.). A
divider, such as a small fence, shrubs, etc. , must mark the designated set
back.".- These regulations are enforced by the Board of Health and any questions
should be referred to that office.
The survey further indicated that the 200 foot business area extends
behind .the restaurant and would permit the few parking spaces next to the
house at the rear of the restaurant.
Since the Town of_ Barnstable .zoning by-law does not contain any parking
requirements .for the business area it is my opinion that the Police Depart-
ment would have jurisdiction over- the parking of automobiles ..in the. "NO
PARKING" areas and violations should be reported to that department.

they lost their parking on that side of the building. They
bought the house in the rear of the restaurant and. put parkin
around that house . Now is it possible for theca to keep baeki
into our residential area without any restriction from the
town officials , can she still buy more houses and make them
parking areas also and just invade the neighborhood.
I know that at one time here anyone opening restaurants arl -
night spots were always asked how much off street parking the
had. It was mandatory. over.---

OUTSIDE CAFES
The Board of Health may grant variances from any of its' regu-
lations providing the applicant for such variance can prove satis-
factorily to the Board that the granting of said variance would not
be inconsistent with accepted public health practices and would not
create nuisances to public health or to the environment.
The following are some of ''the criteria that must be met prior to
the Board's consideration of a variance from Regulation 14, Town of
Barnstable Health Regulations:
(a) The dining area must be set back ten (10) feet from the
property line, sidewalk, or public access way (parking lots,
etc. ) . A divider, such as a small fence, shrubs, etc. , must
mark the designated setback.
(b) The dining area must be part of the restaurant property
whether leased or owned. The dining area must be mentioned
on the described premises as in the case of a Common Victual-
ler's License.
(c) Sufficient restrooms, both for customers and employees, must
be furnished counting the additional outside seating as re-
quired by the State Plumbing Code and Town of Barnstable Health
regulations.
(d) A self-contained drainage system designed to eliminate odors
will be required for all outside dining area. Conveniently
located hose bibs must 'be available for washing down the
dining area.

(e) Provision must be made by the applicant to protect against
the entrance of rodents, flies, roaches, and other vermin,
into the outside dining area and into the parent establish-
ment. "
(f) Trash dumpsters shall be situated no closer than 50 feet
from. an outdoor dining area. If such a dumpster is in the
line of sight from the dining area, it must be hidden from
view by
a stockade or other such fencing. The area around
the dumpster and stockade must be kept clean and free of
litter. Dumpsters must be kept closed with adequate covers
designed to prevent entrance of rodents and vermin and
completely free of odors.
(g) The patio or other dining area surface must be of such con-
struction or material as to be readily cleanable and not be
susceptible to inordinate amounts of dust, mud or 'debris.
(Brick, tile, concrete, or similar type washable surface,
would be examples of acceptable material) .
(h) Table tops must be so designed and of such material and
workmanship as to be smooth., non-porous, easily cleanable
and durable; and shall be in such repair as to be readily
maintained in a clean and sanitary condition.
(i) Silverware, used for dining outside, must be handled in such
a way that contamination of the eating surfaces by the hands
of food handlers is negligible. (Rarely- enforced by Managers) .

REVISED SUPPLEMENT TO. MINIMUM SANITATION STANDARDS
FOR FOOD SERVICE ESTABLISHMENTS
Adopted February 21, 1975
The following regulations are promulgated by the Town of Barnstable
Board of Health, in accordance with the provisions of Chapter 111,
section 31, as amended, of the Massachusetts General Laws, and are
being adopted to supplement, clarify and augment the provisions of
Article X. Minimum Sanitation Standards for Food Service Establishments,'
of the State Sanitary Code. Applicants shall refer to the State Sanitary
Code for basic requirements.
REGULATION 3 - FOOD PROTECTION
3.1 All food served buffet style shall be enclosed in such a manner
to prevent contamination from patrons.-
REGULATION 10 - PLUMBING
Grease traps must be provided at restaurants, nursing homes, schools,
hospitals, bakeries, or similar establishments as determined by the•
Board of Health. The capacity of the grease trap shall be calculated
by the kitchen flow rate of 15. _gallons per seat, or chair, per day
but in no case shall be less than 1000 gallons. This applies• to es-
tablishments connecting to . Town sewer, or establishments with on-site
sewage systems.
REGULATION 11 - TOILET FACILITIES
All food service establishments shall provide adequate, conveniently
located toilet facilities for its' employees. Each food service
establishment with a -seating or standing capacity of over fifty (50)
patrons shall provide toilet facilities for employees that are separate
from the toilet facilities provided for patrons. Separate facilities
must be provided for male and female employees and male and female
patrons.
Each food service establishment shall be provided with adequate,
conveniently located hand washing facilities for its ' employees
equipped. with hold and cold or tempered running water, hand cleansing
soap or detergent from- a dispensing unit, and sanitary- towels - or
ther._hand.-dr-yng_ devises.,.. Common,.towels. are .prohibited. This hand-

washing'-facility shall be located in 'th•e' food 'preparation area:
The hand wash sinks in the restrooms for patrons, or employees, can-
not be considered as the hand wash facility for employees, but are
required for all toilet facilities.

REGULATION 14 - VERMIN CONTROL
Outdoor cafe-type restaurants will not be permitted in the Town of
Barnstable.
REGULATION 22 - MOBILE FOOD SERVICE
Push-calf type food service vendors will not be permitted in the
Town of Barnstable.
Mobile food units shall operate from a commissary, or other fixed
food service establishment that is constructed and operated in
compliance with Article X, of the State Sanitary Code, and Town of
Barnstable Health Regulations.
Mobile food units serving foods not packaged for individual servings
and/or involving the use of utensils shall provide a potable water
system under pressure. . The system shall be of sufficient capacity
to furnish enough hot and cold water for food preparation, utensil .
cleaning and sanitizing, and handwashing. A double compartment sink
must be provided for washing and sanitizing utensils. A separate - -
hand wash sink must, also be provided. ,
Mobile units garaged outside of the Town of Barnstable must. furnish
written certification from their local Board of Health verifying
that they operate from a licensed food service establishment.
REGULATION 23 - VENDING MACHINES
Any establishment with vending machines dispensing food or drink
must be licensed by the Board of Health.
PENALTIES Any person who shall fail to comply with an order issued
pursurant to the provisions of these regulations upon conviction is sub-
ject to the same fines prescribed in Regulation 39.2, of Article X, of
the State Sanitary Code.
INVALIDATION If any section, paragraph, sentence, clause, or phrase
of these rules and regulations should be decided invalid for any reason
whatsoever, such decision shall not affect the remaining portions of
these regulations, which shall remain in full force and effect; and to
this end the provisions of these regulations are hereby declared
severable.

Gentlemen: -
Miss Vecchione has given me a copy of your letter to her.dated
August. 12, 1982 concerning her property at 3 Sherman Square,
Hyannis. She has .told me that. on Friday, August 20th, the
Peterson Awning Company will do all the necessary work to move
the side awning at her property so that none-of it is.within the
. .road layout of Newton Street. She will also move entirely within
her property lines on that date, or at the latest, over that week-
end, any other structures or material that are. within the road
limits, such "as flowers or dividers.
The Board of Health regulation in respect to the 10 foot setback
for .outside. dining presents a somewhat different problem. " This
new information as. to the location of the street line will require
Miss Vecchione to, make changes in the .layout of the outside dining .
area. She .is working now on Ia new layout, and I anticipate that
we will be_a.sking the Board of Health for a variance of the 10 foot
setback requirement. to some degree, I'm writing today to the Board
of Health advising them of this, and we ask your recognition that
the awning problem is being solved- immediately and that we are
working diligently on- the setback question. .

where the diming area is not the full 10 foot setback from the property line
as mentioned in the criteria for outside cafes issued by your Board.
Miss Vecchione is working now on a revised plan of the .layout of her outside

Dear Miss Vecchione:
The Board of Selectmen has received a copy of the letter to Joe Daluz,
Building Inspector, from your Attorney Frank Green in reference to your pro-
perty. It is our intention to respond to a written ccrnplaint received by
the Board of Selectmen as it relates to zoning. Your attorney has advised
'Mr. DaLuz of the violation and that he also advised you to remove the awning
from within the Town street layout. In addition, the Board of Health has
regulations fof out door serving and that criteria includes a set back of
10' from the property line.
Now that we have evidence that supports the ccoplaint, it is the deci-

Dear Joe:
Thank you for forwarding to me the information that you had concerning
this restaurant.
It seems clear that a portion of Villa Vecchione's awning is within the
town layout of Newton Street, and I have told Miss Vecchione that she
should make arrangements with the awning company to have it moved entirely
onto her property. I understand that she will arrange this with the.
Peterson Awning Company or some other company specializing in this work,
and I will let you know as soon as I can what the company's schedule will
be.
I believe your other concern and that of the Board of Health is the question
of the ten foot setback for the outside serving area. I will meet with her
as soon as po6sible and then get back to you with a response.
