DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws,rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION - The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as"supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules &Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. PETITION : # 1989-76 At a regularly scheduled hearing of the Barnstable Zoning Board of Appeals , held on October 26, 1989, notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts, the applicant, Larry D. Nickulas , through attorney Michael D., Ford, petitioned the Board for a variance from Section 3- 1 . 1 (5) , Bulk Regulations of the Residential B (RB) zoning district. The petitioner's property is located off of Craigville Beach 4 Road between Fifth and Sixth Avenues in West Hyannisport. The 40 , 058 square foot property consists of parcels`""192, 195 and 196 on assessor's map 246. It is located in the Residential B zoning district.. The petitioner intends to raze three exist9�ng structures on lots 195 and 196 which have been used as seasonal rentals and replace them with three detached single-family homes , each on a separate lot. The petitioner requires a variance from the lot, area requirements of the bylaw in order to create three undersized lots which are buildable for zoning purposes . The petitioner. has previously appeared before this Board (#1987- 14) and was granted a Special Permit to construct six condominium units on the property. That case was appealed and the decision of the Board declared void by Judge Keady of the Superior Court. Judge Keady' s decision has been appealed. Mr. Ford stated that he had been in contact with the attorney- for the individuals who originally appealed the . Board' s -decision and that his clients approved of the plan to construct three single family homes . Several of the neighbors were present and confirmed Mr. Ford's statement. Mr. Ford submitted a brief for the record which explains the facts of the case and presents the petitioner's case for a variance . Specifically, Mr. Ford claims that the structures are unique as rental units in, this area and: that they do not lend themselves to reconstuction as single family units . He also suggested that the proposod single family use would not V. „ '. { be detrimental to the area . Finally, Mr . Ford explained that the petitioner seeks to establish a conforming use on the land and seeks only a variance from the lot area requirements of the bylaw.
