Activity Request: The applicant is proposing a new second floor family
apartment addition (estimated at 1,084 SF) to an
existing one story residential dwelling.

Background:
This decision concerns the Appeal submitted by Mr. H. Paul Sieger to the
Zoning Board of Appeals for a special Permit under section 3-1.1 (3)D) , to
allow a Family Apartment at 119 Skating Rink Rd., Assessors Map 291, Lot 56,
Hyannis, in an RB zoning District. The lot is served by public water and has
a private septic system.
According to the Assessor's Records, the lot is 0.29 acres and is developed
with a one-story single-family dwelling with a gross area of 1,931 sq.ft. The
principal dwelling contains 3 bedrooms and .1 Bath. The records indicate the
structure was built in 1969.
According to the submitted plans the family apartment unit is to be developed
as a now second floor addition of 9.30 sf {gross area measured as 1,084 sf at
second floor elevation by Planning Department}. A new kitchen, full bathroom
and two bedrooms (the studio space is treated as a bedroom) , and a new deck
and exterior stair are included. The apartment is to be occupied by Mr.
sieger.'s sister.
Procedural Summary:
The application was filed in the offices of the Town Clerk on may 11, 1993,
8:49 AM and at the Zoning Board of Appeals office. A public hearing duly
noticed under M.G.L. Chapter 40-A was opened on June 10. 1993, at which time
the hearing was held,. closed, and a decision rendered by the Board. The
petition was heard by Board members: Gail Nightingale, Ron Jansson, Dexter
Bliss, Elizabeth Nilsson and Chairman Boy.

Decision and Notice
The petitioner presented his Appeal before the Board. He submitted a plan
indicating the interior of the proposed family apartment and the elevations of
the existing home. This plan was revised by the applicant and was labeled at
the meeting as "File Copy ZBA 6-10-93" . The family apartment will be the
year-round residence of his sister who is moving from New York to live with
the petitioner.
The Board questioned the applicant on the actual square footage of the family
apartment. The petitioner indicated that it would contain 930 sf. The Board
discussed the size and reviewed the Plan submitted indicating the family
apartment has a gross of 1,084 sf. and exceeds the permitted amount of
expansion for a family apartment which is fifty percent (50%) of the existing
dwelling size of 1,931 sf.
The question of the units location within a designated Groundwater Protection
District was discussed and the petitioner said he would upgrade the existing
septic system to a Title V. The Board explained that this area not only
required that type of a system but is also governed by the Town's General
ordinance "Regulation of Wastewater Discharge" commonly known as ,the 330
Rule".
The public was requested to speak and no one spoke in favor or in opposition
to the petition.
FINDING OF FACTS:
Based upon the evidence submitted and the testimony given at the public,
hearing, the Board unanimously made the following findings:
1. There was testimony given by the applicant that the gross living area for
the family apartment will not exceed 50% of the existing dwelling.
2. The applicant will assure that the septic system meets the Health
Department requirements for a Title V septic system and shall conform to the
Town's General ordinance "Regulation of Wastewater Discharge" (the 330 Rule) .
3. The applicant understands and has agreed to comply with all of the
requirements of section 3-1.1(3) (D) "Family Apartments" of the zoning
ordinance. The apartment unit is to be occupied by the applicants sister as
her primary year-round residence.
Conclusion:
Accordingly, based upon the findings of the Board, a motion was made and
seconded that Appeal No. 1993-33 for a special Permit to allow the Family
Apartment be granted in accordance with Plans submitted prepared by Chaunce H.
Powers Architect, and dated June 1, 1993 - indicated as "File Copy", zba,
6/10/93" and subject to the following condition:
1. The petitioner shall comply with all regulations of the Town of Barnstable
Health Department and shall obtain a septic permit in conformance to Title v
and the Town's General ordinance "Regulation of Wastewater Discharge" (the 330
Rule) .

2. The petitioner shall secure a building permit form the Building Department
to permit the development of the Family Apartment not to exceed fifty percent
of the present gross floor area of the home or 965 sf. The Final Plans
developed for the building permit shall also be submitted to the Zoning Board
of Appeal File #93-33.
3. The apartment unit shall be maintained at all times in compliance with all
of the requirements of section 3-1.1(3) (D) "Family Apartments" of the Zoning
ordinance.
The vote was as follows:
AYES: Gail Nightingale, Ron Jansson, Dexter Bliss, Elizabeth Nilsson and
Chairman Boy
NAYS: None
Order:
Appeal No. 1993-33 for a Special Permit to allow a family apartment has been
granted with Conditions. Appeals of this decision, if any, shall be made
pursuant to MGL Chapter 40A, Section 17, and shall be filed within twenty (20)
days after the date of the filing of this decision in the office of the Town
Clerk.

Conclusion:
Accordingly, based upon the findings of the Board, a motion was made and
seconded that Appeal No. 1993-33 for a Special Permit to allow the Family
Apartment be granted in accordance with Plans submitted prepared by chaunce H.
Powers Architect, and dated June 1, 1993 - indicated as "File copy", zba,
6/10/93" and subject to the following condition:
1. The petitioner shall comply with all regulations of the Town of Barnstable
Health Department and shall obtain a septic permit in conformance to Title V
and the Town's General Ordinance "Regulation of Wastewater Discharge" (the 330
Rule) .

2. The petitioner shall secure a building permit form the Building Department
to permit the development of the Family Apartment not to exceed fifty percent
of the present gross floor area of the home or 965 sf. The Final Plans
developed for the building permit shall also be submitted to the Zoning Board
of Appeal File #93-33.
3. The apartment unit shall be maintained at all times in compliance with all
of the requirements of Section 3-1.1(3) (D) "Family Apartments" of the Zoning
ordinance.

Order:
Appeal No. 1993-33 for a Special Permit to allow a family apartment has been
granted with Conditions. Appeals of this decision, if any, shall be made
pursuant to MGL Chapter 40A, Section 17, and shall be filed within twenty (20)
days after the date of the filing of this decision in the office of the Town
clerk.

Any person aggrieved by this decision may appeal to the Barnstable
Superior Court, as described in Section 17 of Chapter 40A of the
General Laws of the Commonwealth of Massachusetts by bringing-an
action within- twenty days after the decision has been filed in the
office of the Town Clerk.
