GAIL NIGHTINGALE and othersv MEMORANDUM OF DECISION INTRODUCTION Plaintiffs brought this action pursuant to G.L. c. 40A § 17, as an appeal from a , decision of the Barnstable Zoning Board of Appeals in which plaintiffs were denied'a special permit to construct and operate an open-air.parldng lot. . X _ FINDINGS OF FACT' Lewis Bay Motel-Restaurant Marina,`Inc. (Lewis Bay) is the record owner of a parcel of real estate located t 53 South Street, Hyannis, Ma s chuse "(Lot 125), and a parcel located directly across the street with an address of 110 School Street (Lot 121). At 53 South Street, three buildings which had been used as a hotel/motel Walter Hedlund. ' Ron Jansson, Eugene Burman,.Emmett Glynn_and Richard Bov,.as members of the h Barnstable County Zoning Board of Appeals.` 2 were demolished in 1961. At that time, a special permit was obtained to construct another motel. However, since the lot had contained a hotel prior to the enactment of the zoning by-law which limited use of the lot, the use of the lot as a motel had the status of a pre-existing non-conforming use. Despite the owners applying for the special permit, the use of the lot as a motel retained this status. In 1963, Lewis Bay constructed a motel on the property which operated in conjunction with the Levis Bay Lodge, which was located at 110 School Street. The lodge contained a restaurant and bar area as well as twenty-nine lodging units. In 1991, both structures Nvere subsequently razed leaving two vacant_lots. However, Lewis Bay maintained its innholder's license for 110 School Street which allowed plaintiff to serve alcohol on the premises. Meanwhile, officers of Lewis Bay were considering what use should be made of the lots. A restaurant and inn (The Dockside) located on Lot 122 was moved to Lot 121 at 110 School Street and plaintiffs applied for a special permit to operate a forty-eight space parking lot at 53 South Street which would constitute a change from one non-conforming use to another. Plaintiff, Hedlund, brought the application as duly authorized officer on behalf of Lewis Bay. Within its decision, the Board determined that the non-conforming status of the lot was changed to a permitted use conditional under the Special Permit. Prior to trial, cross-motions for summary judgment were brought and it was ruled by 3 the hearing judge (Xifaras, J.) that the motel in question was a pre-existing, non- conforming use rather than a conditional permitted use and a partial summary judgment was allowed for the plaintiffs on March 14, 1995. The decision on that issue became the law of the case and the consideration of the Board's decision by this Court was limited to its denial of a special permit based upon the substitution of one non-conforming use to another non-conforming use. After a hearing, the Zoning Board of Appeals (the board) denied plaintiffs' application finding that the special permit would not be in harmony with the general purpose and intent of the zoning ordinance and it would be more objectionable. DISCUSSION AND RULINGS The court is to determine the validity of the Board's decision based on the facts as found by the court. Garvev v. Board of Appeals of Amherst, 9'Mass. App. Ct. 856 (1980). The burden of proof is on those requesting the special permit. Planning Board of Northborough v. Board of Appeals of Northborough, 356 Mass. 732 (1969); Tebo v. Board of Appeals of Shrewsbury, 22 Mass. App. Ct. 618, 619 (1986). Under the applicable zoning ordinance, 4-4.2, one non-conforming use cannot be substituted for another unless the proposed change is no more objectionable or substantially detrimental to the neighborhood and a special permit is obtained from the board. 4 In that neighborhood, South Street may be considered as the main road running parallel to Lewis Bay and the streets (Ocean, Pleasant and School) that lead to the bay are accessed from South Street. The neighborhood is one of a mixed use of business, residential, and marine-related activities. The Steamship Authority docks and parking lots constitute a dominant presence off South Street and bordered by Pleasant and School Streets. The authority is in the process of constructing an additional terminal building at the water end of School Street which connects to the Authority's terminal and parking area off South Street. Over the years, the popularity of seasonal travel to the islands has increased and the Authority's parking capacity at the terminal docks was not adequate to meet the need for customer parking. As a result, a number of commercial lots came into being on the north side of South Street extending up Pleasant Street toward Main Street in Hyannis and on School Street. Some have permits dating back to the 1970's and others have been ruled to be illegal with one now being under Court injunction to prevent further parking. Recently, a lot contiguous to a part of a lodging house on School Street was given a limited permit by the zoning board. It is unusual in that the permit is linked in duration to the life of the present owner who is an elderly woman. The court may consider the Board's decisions inr similar requests for special permits. Colangelo v. Board of Appeals of Lexington, 407 Mass. 242, 245-246 (1990). 5 For a period of years, the planners for the Town concerned with the heavy traffic focus of the Authority's terminal have sought to create satellite parking locations with shuttle services to relieve the parking and traffic stress on these waterfront streets and access roads. Agreements have been entered into between the Town and the Authority to limit parking in the area and to pull it away from the waterfront in order to create a waterfront that is linked to a more pedestrian use from Main Street and less vehicular use. This future vision and scheme for the use of the waterfront has been the subject of much public discussion, meetings and promulgation of proposed plans; factors that would not have been lost in the minds of local authorities such as the zoning board. Lot 125, the subject of the Board's consideration, is slightly over one- half acre in size on the corner of South and School Streets. It is directly opposite the present site of the Dockside Restaurant and Inn (Lot 121). A major portion of the lot is paved over as it had a parking lot as an accessory use to the motel. The proposed plan for the 48-car parking lot would screen the site with fencing, evergreens and trees along with upgraded sidewalks on that corner lot. If one were to assume that the neighborhood was going to remain in its present state of mixed use with the odd commercial parking lots, some of them on lawn areas on the front of lodging houses or other residential structures, the proposed use of this lot could not be said to be any more objectionable than some of the present day 6 utilizations of lots in the surrounding area. The court may not substitute its judgment for that of the Board. Garvey, supra. In order to determine whether or not an existing use is within the protection of the non-conforming use provisions, the court may examine whether the use is different in quality or character as well as degree of the present use, Kreger v. Public Bldgs. Commissioner of Newton, 353 Mass. 622 (1968), and whether a current use is different in kind in its effect on a neighborhood. Powers v. Building Inspector of Barnstable, 363 Mass. 648 (1973). Nevertheless, a local board is not bound to consider simply what is but is entitled to consider what will be as long as the future concept is not unduly speculative so as to render the findings and decision of the board arbitrary or capricious. In light of-,vhat is happening in that area and the changes which reasonably appear to be in the making, the decision of the Board cannot be said to be unreasonable or arbitrary. The decision of the Board is not to be disturbed by a court unless the decision was based on legally.untenable grounds or was unreasonable, whimsical, capricious or arbitrary. Federman v. Board of Appeals of Marblehead; Siciliano, 35 Mass. App. Ct. 727, 730-731 (1994); Board of Assessors of Worthington v. Commissioners of Hampshire County, 416 Mass. 404, 407 (1993). At trial, the defendant Board argued that the plaintiff had abandoned the prior non-conforming use and therefore, could not in any event utilize the ordinance of substituting one non-conforming use for another. 7 Loss of the right to continue a non-conforming use will occur if the landowner abandons the use. Derby Refining Co. v. Chelsea, 407 Mass. 703, 708-711 (1990). Abandonment is a question of fact. Id. at 711. "[T]he concurrence of . . . (1) intent to abandon and (2) voluntary conduct . . . which carries the implication of abandonment" will constitute abandonment. Id. at 708. Surrender of licenses or their renewal may be evidence of intent. Id. at 709-710. Clear indicia of abandonment includes changing property to a conforming use or demolishing buildings. Id. at 710. Much was presented at trial concerning the continued existence of the innholder's license by the plaintiff for the former inn on Lot 121 and whether that innholder's license cloaked the use of lot 125. After the razing of the structures on both lots, the plaintiff continued its innholder's license. Clouding the issue of intent and coverage of the license are the addresses on the licenses as continued. To clarify that issue, recourse has to be made to the property described on the license and not merely the address. The property description clearly refers to the operation on Lot 121 and not the operation on Lot 125, no matter the disparity in the addresses listed. Prior to the razing of the lodge and motel on the two separate parcels, the commercial operation of the two sites was through-one entity. The motel units on Lot 125 were limited to motel lodgings and the lodge operated on Lot 121 providing food, lodging and alcoholic beverages. It is that innholder's license that the Dockside F ; t 8 Inn on Lot 121 now operates under. When the Dockside parking reaches capacity, the parking area on Lot 125 is used for the overflow. Under these circumstances, a clear finding of fact that there was an abandonment as recognized under case law cannot be made. The intent to abandon the non-conforming use of Lot 125 is simply not that clearly delineated. While it is a close call, it is not definitive enough to rule that it is more probably true than not true that there was a clear intent to abandon. CONCLUSION The fact that the Board cannot prevail on its theory of abandonment does not detract from the Board's prevailing on its decision that the proposed use would be more objectionable than the prior non-conforming use. The plaintiff argues that the findings of the Board in denying the Special Permit are deficient in form as the same lacks substance and reasons for the denial. It is well-recognized that denial of a Special Permit by a zoning board does not require a degree of articulation of reasons or basis as that required of an approval providing, of course, that the denial is based on tenable grounds. The discretion of a Board of Appeals "must not be exercised arbitrarily, however, '[t]he board must act fairly and reasonably on the evidence presented to it' and must set 'forth clearly the reason or reasons for its decisions."' Vazza Properties, Inc. v. City Council of Woburn, 1 Mass. App. Ct. 308, 311-312 (1973) (citations omitted). I find and rule that the decision of the Board in denying r. 9 the Special Permit was not unreasonable, capricious or arbitrary nor based on legally untenable grounds. It was noted at the site visit 41 vehicles, 1 school bus and 1 boat on a trailer parked on the property. I also observed two individuals in one vehicle (Toyota highlander) and one individual in the second vehicle (Lexus SUV) enter the lot at 53 South Street. All three individuals walked over to your establishment, one directly to the takeout window. I observed money being exchanged and . then the individual joining the other two in the group. After questioning the three gentlemen if E J g g P q 9 they had paid for island parking, they confirmed that they paid $15.00 for each vehicle to be parked while they went on the ferry: I proceeded to the service takeout window and talked to the employee who was at the window at the time the payment was received, who stated his name was "O'Neill". I asked Mr. O'Neill if he had taken payment for island parking on 53 South Street, which he confirmed he did. I returned to the property at approximately 8:15am with Consumer Affairs Officer Therese Gallant. As CAO Gallant went to question Mr. O'Neill about the acceptance of money for parking at 53 South Street, I witnessed: • an additional 2 vehicles parked on the lot; • signs on the dashboards of approximately 7 vehicles stating "Nantucket Sound Parking 7/13/16"; • Approximately 11 number of vehicles with paid parking receipts displayed on the dash;Two vehicles with phone numbers listed on handmade signs on the dash; and • One vehicle with "Holly Management" written on a handmade sign on the dash After further questioning Mr. O'Neill and investigation conducted by myself and CAO Gallant,.it z is evident that the Dockside Restaurant, located at 110 School Street, Hyannis is conducting an unlicensed private parking lot operation,on 53 South Street.
