Anderson RE: Overcrowding Complaint LOCUS: 323 South St, Hyannis ZONE: Single Family COMPLAINT: Contacted by the Hyannis Fire Dept on 6/27/13. The responded to a reported gas leak. Upon arrival,the HY FD notified National Grid, National Grid stated the service is not connected and then determined there was a leak at the meter. They also found that that service was illegally connected and the meter,piping & fittings were not up to code. HYFD subsequently reported to the Building Division, dangerous and unsanitary conditions (overcrowding). They reported 23 occupants; all young visitors from Ireland on student visas. Multiple bicycles were scattered around the yard. GAS LEAK STATUS The property was converted from oil heat to natural gas although no permits were issued for this work. The gas service stopped at unknown time but was later re-connected by an unlicensed relative of the owner. The gas company indicated there was no active account on this occasion and would pursue a theft of service charge. The owner was ordered to obtain the services of licensed professional to inspect and correct any and all code violations. ZONING This property is located in the SF single family zone; any other use would require zoning relief or must be officially recognized and established as legally created and therefore a lawful pre-existing nonconforming use. PROPERTY The site is located on the corner of South St and High School Rd in Hyannis. The subject dwelling is a one and half story dwelling constructed in 1875. Assessing reports the home to contain 4 bedrooms, one full bath, a half bath, and forced hot water heat by oil. PROPERTY HISTORY I am informed by the owner that this property was once a dental office. According to Mr. Ghanem, the dentist lived on site and converted part of the first floor in the front of the house as waiting room, office area, workstation(for making teeth) and an exam room. The rear of the house contained the kitchen and dining area,bedrooms upstairs. This alleged nonconforming use was abandoned long ago. i BACKGROUND Property conveyed to Roger Ghanem on 1/5/06 Mr. Ghanem sought a comprehensive permit for an Amnesty unit in August 2008. On 9/21/09,this office sent a letter to Mr. Ghanem acknowledging he received a comprehensive permit and instructing him to apply for a building permit to "create"or legitimize the space &use. All units are required to meet the code requirements in the building code A permit application was submitted on 9/30/09 for a two bedroom apartment—no construction. Application was numbered#200904626 but no"floor plans were provided. On 10/7/09 a letter was sent to Mr. Ghanem requesting clarification of the plan submitted to specifically identify the required two means of egress. Mr. Ghaem's failure to respond resulted in the deletion of that application. Mr. Ghanem subsequently, chose to also abandon the comprehensive permit by failing to maintain the requirements including bringing the unit up to code, obtaining the necessary permits and adhering to the residency requirement. He relocated his residency to Falmouth and reconfigured the South St property by effectively creating three living spaces. He added bathrooms in order separate the living quarters and accommodate a greater number of tenants sharing the subject space. On 4/12/13 the comprehensive permit was officially rescinded and duly recorded BK 25378 Pg 40. The property reverts to a single family home in accordance with the governing single-family zone requirements. SITE INSPECTION 6/27/13 The tenants willingly admitted Regulatory Services to the entire property. A local building inspector(R McK) and health inspector accompanied me (Tim O'Connell). I was informed by the tenants that 10 occupy the second floor unit and 13 reside on the first floor. We entered the side door(on High School Rd). This area is segregated from the main house. A staircase leads to the second floor apartment containing two bedrooms, a living room, a kitchen and a full bath. There is no other means of egress from this unit. Subsequently, we entered the rear door into the kitchen of the main dwelling. Every room on the first floor was littered with mattresses and personal effects. A common hall in the front of the house now contained a corner shower(only a shower). This is an open area traveling from the former living room to the front door/front room/ bedroom as well as a kitchen, bath and bedroom off to'the left side of the common space. ell TENANT STATEMENTS There was little or no familiarity between the occupants prior to their residency. They all are employed in the food service industry, They got the lead for this property at the Craigville Beach Snack Bar(owned by Mr. Ghanem). The tenants claim they called Mr. Ghanem on the evening of 6/26/13 to advise him of the gas leak. They-claim that he was"...angry, loud and abusive and said it was none of their concern". Late on the morning of the 27t', when there was no word from the landlord,the tenants called 911 to report he leak. (BPD and HYFD responded. Regulatory Services was called after their initial assessment). Tenants advised they pay $100.00 cash every week to the property owner in an envelope. (Totaling about$2300.00 a week in cash for a full house) LANDLORD STATEMENTS Mr. Ghanem reported to the site after being contacted concerning the gas leak. The HY FD notified the gas company. Mr. Ghanem informed LT John Cosmo ( and later he repeated the remark directly to me) that his unlicensed brother did the gas work. Mr. Ghanem admitted he does not get a gas bill for service at this property. He admitted the property is not a registered rental as requirement by the ordinance. He stated he does not have a written lease. He admitted that he collects the rent weekly—averaging $100.00 each. He stated that he was unaware of the overcrowding situation and had not rented to an inappropriate number of occupants. When asked why he thought he ended up with an excess of cash in the envelope every week he was unable to offer a logical explanation. STATUS Mr. Ghanem has not secured the necessary permits to correct the code issues including, gas,plumbing, electrical and building permits. Mr. Ghanem has been in to this office on more than one occasion and stated he removed some plumbing (but he does not have a license as required by the state) and has made no other effort to properly document his attempt at compliance. Until the permits are issued, the work is completed and inspected, the violation status remains open. REMEDY Obtain building permit to reconfigure and restore the property to a single-family. Obtain permit to remove the abandoned oil tank. Obtain gas permit for the work involved in the conversion from oil to natural gas. Obtain plumbing permit to remove all un-permitted plumbing or retro-fit permits. MAGISTRATE HEARING—Ghanem;323 South St, Hyannis Appeared before a magistrate on 8/16/2013. Mr. Ghanem appeared but was late. Initially the magistrate found him responsible for$1800.00. Tim O'Connell had issued 17 citations-one for each body.exceeding the maximum allowed occupancy. I had issued a single citation for the segregated unit on the second floor. Mr. Ghanem advised the magistrate that he had been seated in,the court room waiting and did not know the municipal hearings.were being held in the second session. The magistrate decided to hear the matter and ultimately found Mr. Ghanem responsible. He subsequently cut the total in half and ordered him to pay $900.00 and asked how long he would need to pay it. Mr. Ghanem replied that he would pay immediately. Later, in the hallway Mr. Ghanem stopped to talk to us (Paul was also present). I advised him that the matter was still open and that he must comply or we would be back again. He agreed but stated he could not find a plumber as when they hear about his problems with the town they walk away. I believe it more likely that the fear is the result of the illegal gas work and the investigation by National Grid. I reminded him that he could and must still obtain a building permit to restore to a single family. Mr. Ghanem is the owner of the property as evidenced by a deed recorded on January 5, 2006, at the Barnstable County Registry of Deeds, in Book 20634 and page 72. Locus & Background: The subject property is a 0.26-acre lot, initially developed in 1875 as a single-family dwelling. Today the Conventional style 1 '/2 story dwelling has 1,451 sq.ft. of living area. The lot is served by public water and town sewer that is approved for a total of three (3) bedrooms. At some point an additional living space that includes a kitchen area, living area and two sleeping areas situated in the upper level of the dwelling was added to create a separate living unit. { Relief Requested: Mr. Ghanem, as the owner of the property has applied for.a Comprehensive Permit pursuant to Chapter 40B of the General Laws of the Commonwealth of Massachusetts, and in accordance with Chapter 9 Article II of the Code of the Town of Barnstable. More specifically Section 14,the amnesty provisions of the "Accessory Affordable Housing Program" for the additional living space in the dwelling. This permit,is sought to correct the situation of an unpermitted apartment unit as provided for in Town's Accessory Affordable Housing Program provided the unit is restricted to being affordable housing for qualified persons as required under Chapter 40B. The zoning relief necessary for this Comprehensive Permit to issue is that of a variance to Section 240-13.A (1) Principal permitted uses in the Residential SF Zoning District to permit a second independent living unit in the single-family zoning district. The issuance of.this Comprehensive Permit would allow for an approximately 650 sq.ft, two,bedroom living unit to remain only if the unit is used as an accessory affordable apartment unit and the main part of the dwelling is owner- occupied. Procedural & Hearing Summary: The applicant initially made contact with the Accessory Affordable Apartment Housing Program Coordinator and completed the Site Approval Application in July 16, 2008. Notice of the site approval application was submitted to the Department of Housing and Community Development. on August 7, 2008, in compliance with 760 CMR 56.00 "Comp. Permit; Low or Moderate-Income' Housing„ Town of Barnstable,Zoning Board of Appeals Decision and Notice, Comprehensive Permit No.'2008-049—Roger M. Ghanem Based on that application, Town Manager, John C. Klimm issued the Project Eligibility letter (site approval letter) on October 16, 2008. A copy of which was also transmitted to the Department of Housing and Community Development in accordance with the requirements of CMR 760 Section 56.04. An application for a Comprehensive Permit was filed at the Town Clerk's Office on October 30, 2008. An initial public hearing before the Zoning Board of Appeals Hearing Officer was held on November 19, 2008 at which time a question of possible foreclosure arose. Mr. Ghanem provided documentation of loan modification. A re-notice for comprehensive permit was duly advertised in the Barnstable Patriot on May 22, 2009 and May 29, 2009, and notice sent to all abutters in accordance with MGL Chapter 40A. On July 22, 2009, Hearing Officer, Laura F. Shufelt opened the public hearing at 6:05 p.m. The Roger ''h present. The loan modification agreement was recorded at the Barnstable County Registry of Deeds on January 16, 2009 in book 23378 and page1. Mr. Ghanem also gave a brief explanation of the unit and cited that he understood the requirements of the program and the fact that he would occupy the.home as his principal residence and the apartment unit would only be occupied by a qualified income tenant as year round affordable, housing. Ms Shufelt reviewed the file with the applicant to assure compliance with all of the program requirements. It was also noted that the comprehensive permit is not transferable and violation of the rules is cause for a hearing to resent the permit. Public Comment was requested and no one spoke in favor or in objection to the granting of.the comprehensive permit. Ms Shufelt noted the proposed conditions that would be imposed in the permit and the applicant cited that he understood the proposed conditions and consents to abide by them. At that point, the. Hearing Officer closed the hearing for public comment and proceeded to make finding to grant the permit and imposed conditions on the permit. Findings of Fact: At the hearing on July 22, 2009 the Hearing Officer made the following findings of fact. First with respect to standing-the Jurisdictional Requirements of the applicant to apply for a, Comprehensive Permit under MGL Chapter 40B as identified in CMR 760 Sections 56.04 and the Town of Barnstable.General Ordinance Chapter 9, Article II:: 1. The applicant is Roger M. Ghanem who resides at 323 South-St., Hya6nis MA. The applicant requested a Comprehensive Permit for an existing two-bedroom apartment within the upper level of the single-family dwelling as an accessory affordable apartment unit. The conversion of the unit to:an accessory affordable unit within a single-family owner-occupied residential dwelling qualifies for the "Accessory Affordable Apartment Program" as an amnesty unit. . 2. Roger M. Ghanem owns the property as evidenced by deed recorded on July,21, 2008, at the Barnstable County Registry of Deeds, in Book 20634 and•page 72. 2 Town of Barnstable,Zoning Board of Appeals Decision and Notice, Comprehensive Permit No. 2008-049—Roger M. Ghanem 3. On October 16, 2008, a site approval letter was issued for the property by Town Manager John C. Klimm, in accordance with MGL Chapter 40B and 760 CMR 56. Notice of the site approval letter was sent to the Department of Housing and Community Development, in accordance with the requirements of 760 CMR 56.04 (2), and no issues were communicated from the Department on this particular application. Second, with respect of consistent with local needs 1. According to information submitted, at some point an independent two bedroom living unit consisting of approximately 650 sq.ft. was created. The two-bedroom living area is within the. upper level of dwelling. No valid variance or special permit was ever issued for the creation and use of that independent living unit. The studio living unit qualifies for this comprehensive permit under the amnesty program provisions of Chapter.9, Section 14 of the Code of the Town for a proposed accessory unit. 2. The applicant is aware that the unit must meet all applicable building codes to be occupied and that the Building Division and Fire Department will also be inspecting the unit for compliance with all applicable building and fire codes. ' 3. The house is served by public water and public sewer. The proposal has been reviewed by Thomas McKean, Health Director, and the property is approved for a total of three (3) bedrooms. ' 4. On August 7, 2008 the applicant signed an Accessory Affordable Apartment Program Agreement Affidavit that commits, upon the receipt of a Comprehensive Permit,to the recording of a Regulatory Agreement and Declaration of Restrictive Covenants at the Barnstable County Registry of Deeds. That document will restrict the unit in perpetuity as an affordable rental unit and requires that the dwelling be owner-occupied as the applicant's primary residence. 5. The applicant understands that the affordable unit will be rented to no more than three persons,, whose income is 80 or less of the Area Median Income (AMI) of the Barnstable Metropolitan Statistical Area (MSA) and further agrees that rent (including utilities) shall not exceed 30% of the monthly household income of'a'household earning 80% of the median income, adjusted by household size. In the event that utilities are separately metered, the utility allowance established by the Town of Barnstable shall be deducted from rent level so calculated. 6. According to the Massachusetts Department of Housing and Community Development, as of September 9, 2008, 6.8% of the town's year round housing stock qualifies as affordable housing units. The town has not reached the statutory minimum of affordable housing under MGL Chapter 40B Section 20-23 or`its implementing regulations. The Town of Barnstable's Local Comprehensive'Plan'encourages the use of existing housing to create affordable units and the dispersal of these units throughout the town. Summary: Based upon the Findings of Fact cited above, the Hearing Officer ruled that; - • The applicant'Roger M. Ghanem has standing to apply fora Comprehensive.Permit under MGL Chapter 40B and the Town,of Barnstable's Accessory Affordable Housing Program, and • The proposal is deemed consistent with focal needs because it adequately promotes the objective of providing affordable•housing for the Town of Barnstable without jeopardizing the health and safety of the occupants;provided all conditions of the Comprehensive Permit are strictly followed. All leases shall have a minimum term of one year and have provisions that require the tenant to provide any and all information necessary to.verify eligibility with the Accessory Affordable Housing Program. 9. The Growth Management Department shall serve as the monitoring agent for the accessory apartment. Annual monitoring shall include verification of tenancy, affordability, and compliance with Housing Quality Standards (HQS) 10. The applicant shall apply for a building permit for the pre-existing accessory unit. Prior to r securing an occupancy permit and certificate of compliance; the Building Comm issioner'shalI determine that the unit conforms to the approved plans as submitted with the building permit application and meets state building and fire codes..The Health Division shall determine that the property is in compliance with applicable wastewater discharge requirements..: 11. The applicant may select his own tenant. The tenant shall meet the requirements of the program as cited above and provided that person's.income is reviewed and approved by the. Growth Management Department of the Town of Barnstable as a qualified tenant. The applicant will be required to work with the,Towri to provide information..necessary to . document that the tenant qualifies. The unit-shall be rented on an open and fair basis to an income eligible individual. Whenever a vacancy occurs, notice must be given to the Growth Management Department and the unit must be,listed with the Town. 12. Every twelve months the applicant shall review the income eligibility of the tenants occupying the unit. No later than a year from the date of issuance of this Comprehensive Permit, the applicant shall file with the,Growth Management Department of the Town.of Barnstable, as. Monitoring Agent, an annual affidavit listing the rent charged,and`income level of the occupant of the unit. The applicant and/or-tenant shall provide the Town any additional information it deems necessary to verify the information provided in the affidavit. 13. Upon any report from the Monitoring Agent that the terms and conditions of this permit are not . being upheld, the Zoning Board of Appeals or its Hearing Officer shall have the.ability.to hold a hearing to show cause as to why this permit should not be revoked., . ` 4 . Upon arrival we met the residents who state the landlord was notified yesterday at 13:53 of the gas odor and told the resident it was none of her concern. She further states he became angry, loud. and abusive to her on the phone. The leak appears to be at the meter. The National Grid trouble truck arrived and confirmed a leak at the meter. He further stated that he has been at the address before and the service was not connected. They investigated the basement and determined the gas service was hooked up illegally and the meter, piping, and fittings used are not up to code. National Grid will be investigating the address for theft of services. I requested a Fire Inspector to the scene as smoke detectors are missing or inoperable. Inspector Cosmo arrived and began an investigation. In speaking with the residents, I determined that 13 people are living on the first floor and 10 live on the second floor, some of whom were still asleep upon our investigation of the interior of the dwelling. This appears to be in violation of town codes and I requested the building inspector. Additional inspectors responded including health and code enforcement. The landlord, Roger Ghanem, of 39 Antlers Shore Drive, 'Falmouth, Ma. arrived and we explained the situation. He stated he was aware of the gas leak yesterday and that it was a poor decision on his part not to call us. He also stated that the dwelling is not listed as a rental with the town, and that he gets cash weekly for rents. He has no written leases. In discussion about the gas leak he stated that his brother did the gas piping and connected the meter. He states he does not get a gas bill for the property . The National Grid crew disconnected the meter and will follow up on their investigation. We cleared the scene while town inspectors were still on location. Thomas F. When you get a chance can you send over the reports for both of theses properties? I am looking to verify the number of occupants at both locations. With regards to South Street, I am also hoping that information was included pertaining to the collection of rent(the amount and manner of collection) as well as the report that a tenant contacted the landlord regarding the gas odor the day before our response and was told not to contact the FD, etc. FYI: The South Street landlord was issued $2000.00 worth of citations for health &zoning violations. He left here yesterday with a permit application to restore to a single family and remove all un-permitted work. The property record has been flagged so that gas work will be subject to confirmation that the criminal investigation secured the evidence they require and our zoning issues are resolved. I am told that the tenants remain now even though they were informed to vacate. Tom McKean is re-thinking and deciding when to post the property as a result of a brief exchange I had with him today clarifying the situation. Pitcher's Way is also being cited for failure to register as a rental. Citations for overcrowding are pending. He has been ordered to remove all un-permitted work and the power is not being restored until that work is completed and inspected. He has an application to restore to single family and reduce the number of bedrooms in his hand. He must return a completed application but he has made contact with a contractor and electrician to rectify the problem. All necessary work to be performed will rely on a generator for the power tools& lighting. This property_ record has been flagged, too. Last year the weather wasn&rsquo;t so good and everybody was complaining,&rdquo; Ghanem said as he unloaded his white SUV of fresh products for the shore-side restaurant. Helping the bottom line besides the weather is Ghanem&rsquo;s takeover of a former competitor&rsquo;s lease next door at the&Idquo;Barnacle,&rdquo;which has allowed him to differentiate the menu at each venue as operator of both. The Grill was Ghanem&rsquo;s original start-up, and, his being from Lebanese extraction,offers a menu spiced with local and international flavor.&Idquo;Our best seller at The Grill is the chicken shish-ka-bob,&Idquo; he said, not to mention the falafel, another Middle Eastern favorite beating out American favorites,the ubiquitous hot dog and hamburger. Seafood-and what is the shore without a taste of its bounty-is concentrated at the Barnacle where the menu swims with fish and where the lobster salad roll,&Idquo;not just a little hot dog bun but a big roll,&rdquo; said Ghanem, is the best seller. As have a legion of other businessmen in Barnstable, Ghanem couldn't resist complaining about the town's recent enforcement of the sign laws."There is too much town,"he said, much like some political opinion believes there is too much federal government. He said the town had.him remove an A-sign by the side of the road and he really couldn't figure out why. "This is a seasonal business and we have to make a living,"he said."Someplace else,they look the other way,they are flexible and try to work with you." Acceleration Upon Unauthorized Transfer. If the Note holder exercises'this option, the Note holder shall give the Borrower notice of acceleration. The notice shall provide a period of not less than 30 days from the date the notice is mailed within which the Borrower must pay all sums due under the Note, Security Instrument and this Agreement. If the Borrower fails to pay these sums prior to the expiration of the 30 day period, the Note holder may invoke any remedies permitted by the Note, Security Instrument and applicable law. Borrower(s)further agree to be bound by the terms and provisions of the Note and Security Instrument, as modified hereby. 11. No Release. Nothing in this Agreement shall be understood or construed to be a satisfaction or release in whole or in part of the Note and/or Security Instrument. Except as expressly provided in this Agreement, all of the terms, covenants agreements and the Note and Security Instrument will remain unchanged and the Parties will be bound by,and comply with, all of the terms and provisions of the instruments,as amended by this Agreement. 12. Warranties. Borrower does hereby state and warrant that the above described Note is valid and enforceable in all respects and is not subject to any claims,.defenses or right of offset or credit except as herein specifically provided. Borrower does further hereby extend all liens and security interests on all of the Subject Property and any other rights and interests which now or hereafter secure said Note until said Note as modified hereby has been fully paid, and agree that this modification and extension will in no manner impair the Note or any of the liens and security interests securing the same and that all of the liens, equities, rights, remedies and security interests securing said Note shall remain in full force and effect and shall not in any manner be waived. Borrower further agrees that all of the terms, covenants, warranties and provisions contained in the original Note and Security Instrument are now and shall be and remain in full force and effect as therein written, except as otherwise expressly provided herein, until the Note is paid in full and all other obligations under the Security Instrument and this Agreement are fulfilled. 13. Further Assurances. Borrower does further state and warrant that all of the recitals, statements and agreements contained herein are true and correct and that Borrower is the sole owner of the fee simple title to all of the Subject Property securing the Note. 14. Acknowledgement by Borrower. As part of the consideration for this Agreement, Borrower agrees to release and waive all claims Borrower might assert against the Trust and or its agents, and arising from any act or omission to act on the part of the Trust or it's agents, officers, directors, attorneys, employees and any predecessor-in-interest to the Note and Security Instrument, and which Borrower contends caused Borrower damage or injury, or which Borrower contends renders the Note or the Security Instrument void, voidable, or unenforceable. This release extends to any claims arising from any judicial foreclosure proceedings or power of sale proceedings if any, conducted prior to the date of this Agreement. Borrowers have and claim no defenses, counterclaims or rights of offset of any kind against the Trust, Washington Mutual or against collection of the Loan. However, 'the Parties acknowledge that the mortgagee/beneficiary retains certain rights, including but not limited to the right to foreclose its lien against the Subject Property under appropriate circumstances.
