Summary of Evidence: _ The applicant represented by Michael Mara; presented the petition for a special Permit to allow for an addition - of 190 ft. to an e:-:isting non-conforming bui ] ding (Building B) and to enclose an existing 154, sq.ft,. deck. The applicant di --cussed the history of the two buildings on this site and further stated that the Building "A" , the ,main ; a house, was moved to this site around the turn of century from its original . locat.ion at High School Road. Also, at the same time a portion of another- building was moved and -. attached to buiIdirig "A" by making it a .single building. The building has been used as a guest house since 1930 . Mr. Mara also stated that applicant has owned the building since 1979 and has been operating it as a guest house. He also stated that the building "B" was moved to this site in 1949. Both buildings pre-existed the adoption of zoning by the Town of Barnstable. The applicant stated that the site now has .six (6) parking spaces . The Board questioned the' use° of the proposed addition- to the building "B" . '.The applicant stated- that the additional . ' space will be for the owner' s daughter and ion- in- law, - w11 is handicapped.- -The enclosed deck area will be a der, and a rehabilitation -room for her son- in- law and the building will be handicap accessible. . The addition to the front of the building will expand the kitchen and living room area. The Building wi-11 be used as a family apartment. The Board also discussed the adequacy of parking spaces . It was noted that the uses on this site requires 7 parking spaces . The Board discussed that there is enough space between two buildi.ngs .to provide fiv,e . DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm.structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor.
