Appeals , held on January 10 , 1991 , and continued from a prior meeting of December 13 , 1990 , notice of which was duly published and forwarded to all interested parties , pursuant to Massachusetts General Law (MGL) Chapter 40A, The applicant , Edward A. Zullo , through Attorney Thomas .Hannon ,l . requested to withdraw Appeal No . 1990-59 without prejudice. ' During the course of this Repetitive Petition, an earlier 1961 Special Permit No . 1961 -30 , was presented to the Board of Appeals and it is the Board ' s understanding that this permit may still be in full force and effect under the provision of the Zoning Ordinance and MGL Chapter 40A. Given this earlier Special Permit , the need for the applicant to be before the Board may not exist . Decision: Based upon the -info.rmation provided at a meeting held on January 10 , 199.1 , by a motion duly made and seconded, the - .Zoning Board of Appeals voted to allow the applicant to withdraw without prejudice his application for a Special Permit No . 1990-59 . The vote on this motion was as follows : Ayes : BURMAN , BURLINGAME, BROWN , JANSSON . Nays : None . The applicant is allowed to withdraw without prejudice and to pursue his remedies with the Building Commissioner ' s Office . The applicant - i's seeking a special permit to% reconstruct a three-family apartment building which was destroyed .by fire in April 1988. Attorney Hannon explained that Mr. Zullo had purchased the property with his son- in- law in 1985 and a permit was issued to remodel the building in 1986. The project was not completed and in April of 1988 the building was destroyed by , fire. Attorney Hannon stated that Mr. , Zullo wished to rebuild 'a three-family apartment on the same footprint as the original foundation. It was pointed out to Attorney Hannon that Section 4-4 . 3 of the zoning bylaw requires that reconstruction of a damaged non-conforming building commence within 12 months of such fire or catastrophe . Mr. Hannon indicated neither he nor his client was aware of the time limit . The Board indicated concern that a three family apartment was an intense use of such a small lot (6,480 square feet) . FINDINGS OF FACT: Based upon the information provided, the Zoning Board of Appeals made the following findings of fact: I The applicant applied to the Board under the wrong section of the zoning bylaw but because the public was notified, the problem is not fatal to the public hearing and, therefore, a new public hearing is not required; and, 2 that reconstruction of a three-family apartment on the same footprint, with no increase in square feet, number of apartments or bedrooms would not be more detrimental to the neighborhood than the previous building. As the applicant's building burned down in April , 1988, more than twelve months have passed. The applicant is requesting permission to begin the permit and reconstruction process again. In addition, Section 4-2.7, Off-Street Parking of the zoning bylaw requires 1 . 5 parking spaces per dwelling unit and 1 visitor space per 10 required dwelling unit spaces. Mr. Sargoni has informed us that the property located at 459 South Street, immediately abutting his property to the East, has been in a demolished and dilapidated condition as a result of a fire which occurred on that property. Our examination of the property reveals that it is in a seriously dangerous condition, including exposed nails, burned beams, broken glass, rusted materials, loose foundation materials, and an open and exposed cellar of approximately 8 to 10 feet in depth. The fence located on the property has been torn down and the site is open to public access . Aside from the esthetic problems associated with the property immediately adjacent to Mr. Sargoni ' s commercial restaurant establishment, the condition of the property presents a public nuisance and endangers the health, lives and safety of the public, especially small children and pedestrians .
