On February 25, 2018, Health Inspector Donna Z. Miorandi, R.S. received a call from the Hyannis Fire Department to respond to the property owned by you located at 45 Spring Street, Hyannis (a/k/a 40A Spring Street, Hyannis). The following violations of 310 CMR 15.000, the State Environmental Code, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage and the Town of Barnstable Code were observed: 310 CMR 15.303(1) (a): Septic system is in hydraulic failure. Raw sewage was observed ponding on the ground Town of Barnstable Code 4 353-9: Discharge of sewage onto the ground. (1) You are directed to keep the on-site sewage disposal system pumped as many times as necessary(daily if needed)to keep it from overflowing onto the ground. 310 CMR 15.354: Abandonment of Systems: Cesspool present at said location. You are directed to correct the violation'listed above within thirty (30) days of your receipt of this notice by obtaining a septic abandonment permit from the Town of Barnstable Health Department and properly abandoning the septic system. The following procedure shall be used to abandon a system: (a) Within 14 days to discontinuance of use of a system, the facility owner shall apply to the Approving Authority to abandon the existing system citing the reasons(s) abandonment is necessary, and where connection to municipal or private sanitary sewer has been made, a copy of the sewer connection permit shall be submitted with the application; Q:\Order letters\Sewage Violations\45-aka 40A-Spring St Hyannis Feb2018.docx < r� • (b) Upon receipt of the Approving Authority's written approval to abandon the system, the septic tank shall be pumped of its entire contents by a licensed septage hauler; and (c) The tank shall be excavated and removed from the site, or the bottom of the tank shall be opened or ruptured after being pumped of its content so as to prevent retainage of water and the tank shall be completely filled with clean sand or other suitable material approved in writing by the Approving Authority. You may request a hearing before the Board of Health if written petition requesting same is received within ten (10) days after the date the order is served. Non-compliance will result in a fine of$100.00 per violation. Each day's failure to comply with an order shall constitute a separate violation. Posted Feb 25,2018 at 9:52 AM Updated Feb 26,2018 at 6:24 AM HYANNIS - A woman with"serious"burn injuries was taken to Massachusetts General Hospital this morning following a fire at a Spring Street home according to Hyannis fire P g g P g � g Y personnel. A firefighter was also treated for a minor injury at the 45_Spring St.. e; which.was reported at 3:30 a.m., according to Hyannis fire Lt. Curtis Pike. When firefighters arrived at the scene, they found the fire had spread from the Spring Street house to the exterior of second home, a multifamily unit on Ridgewood Avenue, Pike said. Firefighters initially were told that people were trapped inside the Spring Street house, a single-story residence,but everyone was out by the time crews arrived. The fire did not reach the interior of the Ridgewood Avenue home, Pike said. The woman, whose age Pike did not know,was first taken to Cape Cod Hospital before being transported by ambulance to Boston, Pike said.A child and a second family were assessed for injuries at the scene but were not taken to the hospital. The fire started in a back bedroom of the Spring Street home.; the cause is currently under investigation, Pike said. Crews from the Centerville-Osterville-Martsons Mills,Yarmouth and Barnstable fire departments assisted at the scene; Cotuit and West Barnstable firefighters covered the Hyannis Fire Department's calls during the incident,.Pike said. Many homeowners w-ho use this exemption are unaware that they are assuming the responsibilities of a supervisor . In this case,our Board cannot proceed against the unlicensed person as it'would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of it Supervisor. Anderson RE: Compliance Inspection LOCUS: 45 Spring Street,Hyannis Owner: Gary Franklin Inspected on 8/21/2014 with Tim O'Connell and Officers Jennifer Parkas Ellis & Officer Sturgis of the Community Impact Unit. Officer Ellis informed me that there is a tent in the rear yard of 45 Spring that is rented to two adults and is currently occupied until there is room inside the house. Reported to the site with all aforementioned parties and found a tent in the rear yard. One male adult(Marvin) was inside on a double bed. He had a radio/stereo, TV, refrigerator, microwave oven, cook equipment,personal belongings and toiletries and food. The bed was neatly made and area was cozy with all of the comforts one would expect to find inside a dwelling but for a bathroom& shower. Marvin explained he has a key to the main house which gives him access to the bathroom and kitchen. His power is supplied by extension cords plugged into a garage structure just beyond the tent. Marvin also explained that there was prior rentals dispute with this landlord when he owned the house next door(just recently sold). Marvin and his wife were being evicted but were able to produce rental receipts. According to Marvin,there was no room in the property that Mr:Franklin retained (at#45) so he made a written'agreement with Marvin and his wife to provide them with$2000.00 from the proceeds of the sale for moving expenses when the sale was completed. In the meantime,he would provide them with a tent in the rear yard of 45 to include power,bathroom and kitchen privileges for$60.00 a week. Marvin provided a copy of this notarized document and I have installed in the street file. I photographed the tenant and yard including the power source and extensions cords. I asked Marvin to show us that actually he had access to the house. He unlocked the side door and brought us upstairs to the second level where a vacant bedroom was. He also showed us a common bathroom and small kitchen. The house was very clean. I asked Marvin if this was a sober house and replied in the negative and added that he had just had a beer himself no more than an hour ago! For some unknown or undeclared reason, the landlord is not moving Marvin into the house. Tim contacted the landlord and advised him to get rid of the tent. After some discussion, Tim agreed to give him until 9/1/2014 as written notices would delay the enforcement until that time frame anyway. Pursuant to our conversation, we obtained records from the assessor's office. They are enclosed. The assessor says that, in 1973 the property was actually visited by the assessor's office. At the time, it was found to be a Duplex (i.e. single family and one conversion unit). The first floor contained 4 rooms and a bathroom. The second floor contained 5 rooms and a bathroom. They maintain a separate card for the cottage. That card and the assessing sheet is enclosed. We copied the relevant pages for the years 1945, 1946, 1947, and 1948. Our review of the"Town of Barnstable List of Persons" for those years and the following years, lead us to the conclusion that the Main House was used as a duplex in 1945 & 1946. The cottage was added as a separate rental unit in 1947. The cottage was listed as 45A Spring Street, beginning in 1947. We will contact the Electric Company to see if they have records. This property is owned by Elizabeth Gage. It consists of a two story house, a separate apartment a the back of the property, and a garage. The property has been used as a Three Family property since 1946 with first floor, the house being one unit, the second floor another, and the cottage the third. Elizabeth Gage's Mother passed away, and Miss. Gage has considered selling the property. Brokers have blinquired as to its status, and Miss. Gage requested that I research the situations. That the mother could be made clear. My research has been at the Registrty of Deeds and at the Town Hall in Barnstable. The issue is whether or not 45 Spring Street, has the benefit of a pre existing, non conforming use, i.e. as a Three Family Complex. I have researched the issue of when 45 Spring Street Hyannis was first used as a Three Family Property. It appears that this use began in 1947. I have researched this determination by going to the Vital Statistics Office, at the Barnstable Town Hall. They have a set of records called, "Town of Barnstable List of Persons." This book is similar to an anual census, and lists the residents at each address in the Town of Barnstable. I reviewed the records beginning in 1943. For the years 1943, 1944, 1945, and 1946, it appears that the property was used as a Two Family Complex. In 1944, Sylvia Davidson and Demitra Kevernetes were at that address. In 1945 William Kevernetes and William and Marie Cole were listed. In 1946 Gerald J. Bourquin, Christine Bourquin, and Xenophon and Calliopi Limber were residents. In 1947 however the listing changes, and in addition to 45 Spring Street we see a listing for 45 A Spring Street. In 1947 Xenophon and Calliopi Limber and Lawence and Patricia Vermette are shown as being at 45 Spring Street. Roger and Caroline Vezina are now listed as being at 45 A Spring Street. In 1948 we see Lawrence and Patricia Vermette and Ralph and 2. Blodwan Fuller at 45 Spring Street and Barbara Anderson at 45A. It appears that 45A is the apartment located at the back of the property. In List of Persons, it continues through 1970. A review of them shows that 45 Spring Street was used for Two Families, and 45A Spring Street was a One Family apartment through the 1950's and 1960's. In addition to these records, I have spoken to an6tained an affidavit from Lester D. Mason. Who owned the adjacent property from 1966 through 1969. He also worked as a J P P Y g Property Manager for one of the owners, beginning in the early 1960's. In his affidavit, he attests to the fact that while Jack Furman and Sylvia Furman owned the property, it was used as a Three Family complex,. And while it was owned by Carol Lee Howes, later Carol Lee Bearse from 1966 through 1970, it was used as a Three Family. Where my clients mother purchased the property in 1970, from Carol Lee Bearse and Peter Bearse it was a Three Family. This can be established through the Testimony of her daughter, Elizabeth Gage. Who joined her mother on the deed in 1974. Mrs Irene Gage continued to use the property in that fashion until she died. Since Mrs. Gage died, Elizabeth has continued to use the property in the same fashion that her mother did. My research leads me to the conclusion that 45 Spring Street, which includes 45A Spring Street, has been consistently used as a Three Family Complex since 1947. My wife and I lived there with our children until 1969 when we sold the property and moved to Eldridge Ave. While we lived at Spring Street, we became familiar with the property known as 45 Spring Street. This property was owned by Carol Lee Bearse and her husband, Peter. They had also bought the property from Jack Furman. They used their property as a Three (3) Family complex. Carol Lee and her husband occupied the first floor, another couple were on the second floor, and the cottage, tied to what was my garage, was occupied by a third tenant. While we owned our property at 53 Spring Street, 45 Spring Street was always used as a Three (3) Family property. I also state that I worked as a property manager for Jack Furman being in the early sixties. I was familiar with 43 Spring Street which at all times while Jack Furman owned it and I was his employee,he used as a Three (3) Family residence.
