This makes it look like a larger space on the right and smaller space on the left than what is actually there. The scale is the town's scale, but the town's GIS has the lot lines shifted which shifted the building on the lot. The aerial I sent earlier is an actual photograph from Google maps with cars already on the lot. I copied the cars to the additional proposed spaces on the lot, showing the site works. The measurements I have are actual measurements that I took of the site.. They are from the fence line to the building. There is 26 feet on the left of the building, 16-17 feet behind and 23 feet to the right of the overhang on the side of the building. This is not really a change of use as the site is retail right now and the yard is already being used'for significant storage (lawn mowers, ride on tractors, etc.). The buyer would like to store 3 landscaping trucks on the site - so that is likely a lighter use than what is already there and will clean up the yard considerably. Check out the overhead shot on the town's GIS - the entire dirt area is cluttered with equipment. The owner of McNulty's Service Center had put up signs on and around the building (on both Town&private property)to show the new location and address of the business. Mr. Robinson left them there for a while and had asked that they be removed and received no satisfactory response. Mr. Robinson had a new tenant coming in and asked for my help. On June 20, 2003 I left a message on the McNulty's.answering machine explaining the signs must be removed and also did a site visit. I visited the site again on June 23, 2003 and noted the signs were still in place. I then went to McNulty's new location at 119 Thornton Drive with Building ' Inspector Jeff Lauzon to speak with the owner Chris McNulty. I explained to Ms. McNulty the signs are illegal'&must be removed immediately because they are prohibited signs listed in the Zoning Ordinance §4-3.3(13, 14, 16). McNulty's was given 14 days to remove the illegal signs. Mr. Robinson came into the Building Department on July`9, 2003 to inform me the signs were still in place; 17 days - from the date I gave the owner notice to remove the signs.Later that day I went to the site to remove the signs. There were about 4 or 5 signs I brought back to the Building Department and left them in the back against the fence so the owner could clearly view them for pick up. I came back to the office and repeatedly tried to call McNulty's with no answer and no answering machine to leave a message. A few days later Angela Whelan called me while I was in the field asking if I knew anything about the signs because Ms. McNulty was in the office asking. I explained they were in the back near the fence. When I returned to the office the signs were gone. I asked Angela if they had taken their signs and we both assumed they had because we hadn't heard any further from them. A week or so later I received a phone call from the Police Department that she is trying to press charges for stealing the signs. As quoted from the"law",an employee is defined as every person in the service of another under any contract of hire,express or implied,oral or written. An employer is defined as an individual,partnership,association,corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing,agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority.
