The facts regarding the lot are as follows: 1. The lot was originally created on a subdivision plan of land dated June 16, 1986 and recorded with the Barnstable County Registry of Deeds in the Land Court Division as Land Court Plan 39483-C. 2. On July 6, 1989 Lot 8 was conveyed to Brian T. Dacey as Trustee of Bayside Investment Trust. This deed is registered as Document No. 493,549 with Certificate of Title No. 118,809. This conveyance was made during the eight-year plan protection period afforded lots created by a subdivision plan pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 6. 3. I have caused the title to all of the abutting parcels of land to be researched at the Barnstable County Registry of Deeds. I can find no deed for any of these lots conveying title into Brian T. Dacey as Trustee of Bayside Investment Trust from July 6, 1989 forward. Based on the foregoing, it is my opinion that under Section.4 - 4.2 4) of the Town of Barnstable Zoning Ordinance Lot 8 as shown on Land Court Plan 39483-C is a legally created lot which has been sold into separate ownership and control from any adjoining lot within the eight years from the endorsement of the original subdivision plan and is exempt from any dimensional or bulk zoning changes.and does not lose its status as a single buildable lot under zoning. I have enclosed herewith a copy of the summary sheet setting forth a summary of the title to Lot 8 as well as the title to all of the abutting lots for your review. I have also enclosed a copy of Assessor's Map 57 showing locus as well as a copy of Land Court Plan 39483-C for your review.
