An employer is defined as"an individual,partnership,association,corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the receiver or trustee of an individual,partnership,association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer." MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable`evidence of compliance with the insurance coverage required." Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall . enter into any contract for,the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." Several apartment_complexes and multi-family dwellings are located along this portion of W. Main St. Groundwater Protection The property is serviced by Town water and a private on-site septic system. It is located in a WP Well Protection Overlay District. The Town Ordinance and Title V of the State Environmental Code (310 CMR 15.00) limit the amount of wastewater discharge and the amount of nitrogen loading allowed within zones of contribution to public water supply wells. Nitrogen loading is based upon the number of bedrooms on the property and the size of the lot. According to assessor's records dated 09/28/98 r r Town of Barnstable-Planning Department-Staff Report Appeal Number 1998-115-Devito Use Variance to Section 3-1.1 Principal Permitted Uses Assessor's records indicate that there are 5 bedrooms in this dwelling. According to the Health Division, the existing septic system consists of a 1500 gallon tank and only one leaching pit. This type of system was acceptable at one time for a dwelling of only 3 bedrooms. Two leaching pits would have been required for 5 bedrooms. Due to concerns about groundwater protection, staff recommends that the septic system should be upgraded to current Title V and Board of Health regulations, if the Board should find to grant the requested Use Variance. Local Comprehensive Plan The Hyannis Village Plan recommends that use variances not be granted within residential districts. Strategy 7.8.1 Remove the "use variance"from the residential districts. Allow only the uses which are consistent and compatible with residential uses, including home occupations. Variance Findings: In consideration for the Use Variance, the petitioner must substantiate those conditions unique to this property that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board finds to grant the requested Use Variance, they may wish to consider the following conditions: 1. The dwelling shall not be expanded in foot print nor in total area without permission from the Zoning Board of Appeals. 2. All of our questions concern 15 Sterling Road, Hyannis,. MA and its proposed use as a half-way house. Some of these questions have arisen as the result. of the answers given by members of the panel that sat with you. The questions pertaining to the 15 Sterling Road, Hyannis location are as follows: 1. In view of the apparently accepted classification of the use of the premises by Dr. Berberek and the Board of Selectmen as a group home or residence, does the Town classify this use under Section 424 or 438 .of the State Building Code? 2. If the Town does not consider this use as governed by those Sections , why is the use exempt? 3. Have plans and specifications of the building been submitted to the Town under the provisions of Section 424 .21? 4. Have provisions been made for escape routes under the provisions of Section 424.42? 5. Have provisions been made for smokestopping wood doors with automatic closers or fire retardant doors and, if so, where? 6. Has each intended occupant been certified in accordance with the human services regulations? 8 . Has the Board of Health made a final determination of the capacity and design of the septic system in view of the water table problem and the fact that there will be six residents and at least one, but usually two, adult staff members on the premises at all times? 9. Considering all of those factors , if the building contains five bedrooms , what size septic system is required and what size septic system is presently on the premises? 10. Will the Town require the removal of the second kitchen? 11. Does the Town anticipate the waiver of or intend to waive any requirements of the State Building Code as they pertain to this building? It is our position that the best interest of all of the citizens and residents of the Town of Barnstable require utmost attention to all safety codes in place in view of the intended use of this structure. . We are concerned with the protection of all residents. Since many people appear to be extremely anxious to bring about occupancy of that building as soon as possible, we request your immediate attention to these questions and a response to us with your reply as soon as possible. We would expect to have these answers prior to the issuance of any occupancy permit and feel that we should expect to hear from you within one week of the receipt of this letter.
