Robin Sent: Monday. November 0' 2010 3.58 PM To: Finch. Nancy Subject: 7 Stetson, Hyannis Hi Nancy, I did an inspection today at 7 Stetson as a result of a rental inquiry. Our file shows this to be recognized as a nonconforming use as a duplex in an otherwise single-family zone. The apartment in question should be assessed as such but I only found 3 bedrooms on site as opposed to the four identified on the assessing record. There were only two bedrooms in the primary dwelling. The accessory apartment is similar to a studio as it has no defined bedroom (per Title 5 standards and definition). The property owner uses the accessory unit as his own and he currently is offering the primary dwelling unit to a Barnstable Housing client. I advised the owner that he should look into the abatement process once the tax bill is sent out and that I would advise you regarding the bedroom count. I also indicated that an assessor may want to or need to inspect the property before any change is adopted. Thanks for your assistance with this matter. We both agree that Mrs. T. Jakowlewa and her daughter purchased the property on.,21 April 1965. In researching the town records we find that a Mr. &Mrs. Gersh resided there as tenants in the main house at the time of purchase Mrs. Jakowlewa and her daughter had to honor the lease for a period of one year, and they lived in the little apartment during this time.-See the certified photocopy of registered voters for Januaiy 1965. It is important to note that during the next 22 years;before her death Mrs. Jakowlewa lived here 9 months out-of each year and rented the main house on a-full tiTe basis. Due to she not being a registered voter of the Town of Barnstable she is not listed in the Town records "-nor" is any one else listed'as ever having lived'there:-The long0st tenure was that of Mr. Owen Hagen (I5years) and he has since moved to some'other location within the Town of Barnstable. Some time in the middle 70's Mrs. Jakowlewa filed for a building permit for a living room to be added to the little apartment: The permit was secured and a 15 x 20°living room was added to the existing apartment and was later inspected by someone with'in the town government. You pointed out that no mention,of a kitchen was made during tl is inspection, in order to view and inspect the living room the building inspector had to-pass through the kitchen to gain access to the living larea. The same remains today, in order-to get to the living room you have to enter and pass through the kitchen. Would the inspector at that time have been looking for&kitcheii,or would he have just been thereto inspect the living room? In researching the Town records'we find tthat the town has the property listed with}3 bathrooms and a finished basement assessed at forty five thousand ($45,000.00) dollars. There are two bathrooms notthree and`who ever assessed the basement over.assessed the value by forty two thousand ($42,000.)dollars. The walls are paneled in a$2.95 per_ �. sheet'fiberboard paneling,with'°a suspended ceiling. We have included a photocopy of-Registered Voters,for 1-965 showing Mrs.t Louise B. Gersh as being a tenant at 7 Stetson Street, and a photocopy of the Real Estate Valuation List showing Mrs.Jakowlewa being the rightful-owner tofthe property at that time.
