Dear Mr. Feliz:
A review of our records, including the permitting history and the Zoning Board of
Appeals records, indicates that the present use of your property located at 51 Straightway
North is limited to that of a single-family home; any other use, specifically an
independent accessory dwelling unit is illegal.
You are hereby ordered to discontinue all other uses and immediately restore the subject
property to a single-family residence. A building permit is required in order to
reconfigure the space and convert the property to its original state. This work shall be
completed by November 14, 2005. You will notify this office accordingly and
subsequently arrange for a site inspection to confirm the restoration.
You should be aware that you have the right to appeal this decision. If you so choose, I

indicated separate living quarters.
• I sent a letter to Demick Feliz, a former owner.
• Mr. Kingsley indicated that he purchased this property just a couple of months
ago.
• Mr. Kingsley is married and currently has one child.
• I was advised that a friend from the Dominion Republic is staying with him.
• The friend pays no rent but does contribute to the utilities and has full access to
the house.
• I advised Mr. Kingsley that he is allowed to have three unrelated lodgers as a
matter of right so long as they have unrestricted access to the entire property.
• I found Mr. Kinglsey to be very cooperative.
• He invited me to see the house any time and speak to all residents.
• I have his business card and cell phone number(508) 360-1102.

• None of the names are common, which concerns me as he previously and clearly

• Mr. Kingsley called back. The list of names includes his girlfriend, Ausra
Krasnauskaite,but not his child, Hector, Jr. That leaves 4 other names—all
unrelated. A site visit will be scheduled for the week of 11/14/05.

• I met with Mr. Kingsley at the subject property this afternoon. I toured the entire
house and found: 2 bedrooms upstairs, 1 bedroom on the first floor and one in the
basement. There was a storage room on the left hand side of the stairway(going
down), a laundry room to the right side - in the middle of the basement, on the
other side was a small bathroom directly ahead, a bedroom on the left side, small
bedroom on the right and a small storage area to the right of that room. Except for
a refrigerator in the common laundry room, there was no evidence of another
kitchen—no stove, no counter top,no cabinets. There was no organization
indicating that a second kitchen would be installed although the floor plan as it
exists today could easily accommodate a conversion. Mr. Kingsley purchased the
o and intends to make improvements house about 4 months ag as his time and
budgets allows. The friends staying with him share the expenses but do not pay
rent. In the summer, he advises that family members from the Dominican
Republic visit for the season. We discussed the parking issue. In the warmer

months, he will try to have the vehicles park on the sides of the house (drive
around the back)but in the snowy months it will be too difficult to shovel out
such a long route. I advised that most complaints we receive revolve around the
number of automobiles and the fact that those vehicles tend to be parked in areas
traditionally landscaped- like the front yard. Mr. Kingsley intends to have more
landscaping work done next year. He has made everyone park in stacking
formation for that reason.
• Again, I found Mr. Kingsley to be very cooperative. I informed him that at this
time,without the second kitchen I do not feel that there is a violation. I made no
comment on the legality of the bedrooms (with regards to code issues) as my
mission here was limited to a determination as to whether or not an independent
dwelling unit exists within the legal single-family use. Over-crowding issues (if
they apply) have been typically been referred to the BOH and do not fall within
my jurisdiction. This property is on town sewer.
