Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal 2001-132 - Little Variance - Section 3-1.4(5) Bulk Regulation - Minimum Lot Area Summary: Granted with Conditions Petitioner: Nancy L.Little Property Address: 80 Straightway North,Hyannis,MA Assessor's Map/Parcel: Map 271,Parcel 007 Zoning: Residential C-1 and Groundwater Protection Overlay District Background & Review: Appeal 2001-132 is that of a variance to bulk regulations for minimum lot area in the RC-1 Zoning District. The lot at issue is a 39,362 sq.ft. lot (0.90-acres) fronting on Straightway North. Since 1985,the. district minimum lot size has been 1-acre. Prior to that increase the district requirements were 15,000 sq.ft. of lot area. The subject lot is a part of a lot created in 1974. On August 29, 1989 a deed was recorded transferring the northern portion of Lot 2 (0.90 acres) from Frederic A. Walker and Miriam L. Walker to Nancy L. Little for$40,000. The deed was recorded at the Registry of Deeds in Book 6861, Page 143. The deed referenced a plan entitled"Plan of Access Easement in Barnstable,Massachusetts, prepared for Frederick A Walker", dated 05/30/89, drawn by Levy Eldredge&Wagner Associates,Inc. That easement plan is recorded in Plan Book 461, Page 12. There is no earlier plan of the lot. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 12, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 28, 2001, at which time the Board found to grant the variance with conditions. Board Members deciding this appeal were Daniel M. Creedon, Gail Nightingale, Richard L. Boy, Ralph Copeland, and Ron S.Jansson. Attorney John W. Kenney represented the applicant. He presented the history of lot development in the area, and noted that this particular lot was created by deed without a recorded plan. He noted that the lot is only short 4,200 sq.ft. in area. The district requirement is one acre. The area is not within the Resource Protection Overlay District that now requires 2-acre lots. No one spoke in favor or in opposition to the variance. . Findings of Fact: " At the hearing of November 28, 2001,the Board unanimously found the following findings of fact: 1. The applicant is Nancy L. Little. The property is shown on Assessor's Map 271,Parcel 007, and is commonly addressed 80 Straightway North, Hyannis, MA, in a Residential C-1 Zoning District. The property is in the Groundwater Protection Overlay District but not within the Resource Protection Overlay District. 2. The applicant has applied for a Variance under Section 3-1.4(5) Bulk Regulation. The variance to bulk regulations is for minimum lot area in the RC-1 Zoning District. The lot is a 39,362 sq.ft. lot (0.90-acres) fronting on Straightway North. Since 1985,the district minimum lot size has been 1-acre. Prior to that increase the district requirements were 15,000 sq.ft. of lot area. 3. The lot was created by deed in 1974, being a part of a larger 1.78-acre parcel. Zoning of the area changed in 1985,to one acre lot area. No plan of the lot was recorded until 1989, four years after the change in zoning to one acre. 4. The 1989, recorded plan is designated an easement. The Planning Board signature on this ANR was for the creation of an easement and not for the legal creation of an undersized lot. 5. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 6. This relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance, as evident'in that no one has testified in opposition to the grant of the variance. 7. Although there is a considerable larger parcel to the north of the subject lot,the lot is considerable larger then the typical developed lots within the area. 8. Taxes have been assessed against the lot as a separate lot from the mid-70's according to the Assessor's records. Decision: Based on the findings of fact, a motion was duly made and seconded to grant a bulk variance to minimum lot area of the RC-1, allowing an undersized lot of 39,362 sq.ft.to be considered developable under zoning. The grant of this variance is subject to the following conditions: 1. If required, an Approval Not Required(ANR) Plan shall be prepared and submitted to the Planning Board for its signature. That plan shall reference this variance. That plan, if needed, and this variance decision shall be recorded at the Registry of Deeds. 2. Development of the lot shall conform to all other requirements of the zoning and applicable health regulations without variances. The vote was as follows: AYE: Daniel M. As quoted from the "law", an employee is defined as every person in the.service of another under any contract of hire, express or implied, oral or written. An employer is defined as an individual, partnership, association, corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required.
