Dear Mr. Perry:
We wish to call attention again to the property owned by James Walker on
Straightway North. The property abuts areas of Cobblestone Landing and
Nantucket Village. This issue was addressed in October 2003 with you and
-Mr..Thomas.Geiler.fesulting'in some clean up of the area.
Recently we have noted increased activity on that property,which was
brought-to our attention by residents who abut the property. Members of the
Board of Trustees investigated from our side of the property to validate the
.complaints. Enclosed is a list of observations made as well as copies of letters
we received from you in 2003 addressing this issue.
The Board of Trustees would appreciate it if you would give this matter your
attention and advise us of your findings. Please contact Mr. Lynn Fay,
Chairman, Board of Trustees at the above address.

Dear Mr.Walker:
Thank you for meeting with me at your property on Straighway North and for providing me with the
additional follow up documentation.
I would like you to know that some of the concerns that the trustees of Cobblestone Landing have are civil
matters and are out of this departments'jurisdiction. The unregistered vehicles and property ownership are
two.ofthe issues that fall into this category. First,any problems with unregistered vehicles are handled by
the police department. Secondly,the property bounds need to be determined by a land surveyor. Once you
get an accurate plot plan it can then be determined if there is a trespassing violation. If this is the case, it
would have to be settled legally,either by coming to an agreement or seeking a complaint through the court
system. This is not an issue that this department can become involved in.
As to the use of the property,presently there is some composting and storage of masonry materials in some
of the areas. Our records indicate that there has been no registration of a home occupation or a business
certificate of any sort.
The storage of masonry materials in a residential area would require,at the very least,a home occupation
registration, if this in fact could be obtained. Otherwise,relief in the form of a variance or a special permit
from the Zoning Board of Appeals would have to be obtained.
Composting for personal use is allowed. No permits are required for this type of activity. The accepting of
leaves and grass clippings from neighbors creates a problem in that this deems the activity a commercial
venture. This activity must cease.
While we now realize that much of this activity has been going on for some time,the fact of the matter is
that there has never-been any permitting to allow for them.

Increased activity in the subject area as observed by our abutters; specifically
dumping of dirt and mechanical screening of same and the general dumping of junk,etc.

following observations:
On the Cobblestone Landing side of the road:
• A dumpster across the center of the road
• Two mounds of plowed up dirt
• Large gravel deposit
• Large deposit of boulders
• Dump Truck blocking road at Straightway Entrance--no registration
On Mr. Walker's,side of the road
+ A vast pile of junk and used tires (80-100)just beyond the dumpster
• Another large dump of assorted debris
• Front End Loader with a mechanized sifter for screening of dirt (on going
activity)
• Just beyond, another major Dump consisting of bricks,wooden skids, abandoned
trailer, chains, several vehicle axles, and assorted used lumber
• Just beyond, a rusty snow plow blade, stripped truck body,used oil tank
• A large refuse truck with Chatham, Ma printed on driver's side door—driven
into the woods
• Another front Loader and piles of wooden fencing
• Automobile, Corvette with Maine,-Registration 5971L1 June 05
• A Jet Ski on a trailer
• A Hoist
• Several Engine Blocks

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units
or less and to allow homeowners to engage an individual for hire who does not possess a license,provided
that the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is
intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or
farm structures. A person who constructs more than one home in a two-year period shall not be considered .
a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the
Building Official,that he/she shall be responsible for all such work performed under the building permit.
(Section 109.1.1)

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply
with the State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the
