Appeal No.__._1.9$1..-.72'_._._------- ___ Page ------------....2 of .....3.:.:._:.:_ , On January 28_ _ _ ___ _ _ _ 19 82__.__, The Board of Appeals found Atty. Philip M. Boudreau represented the petitioner who is a prospective grantee under a purchase and sales agreement for a parcel of land located at 586 Straw- berry Hill Rd. , Hyannis/Centerville in a residence D-1 , residence B, and Business zoned district. There is a dilapidated house now existing on the locus which the .petitioner proposes to demolish. This house Has had use for low income housing through the Barnstable Housing Authority. A recent fire in this dwelling has made it uninhabitable -and what was originally an unattractive piece of property is now even less attractive. The locus is divided into zones allowing business use and residential use and can accomodate neither in a reasonable manner. The land comprises approximately 1/3, acre of land and is adjacent to the lot on which th'e Board allowed the construction of an office building by. the Centerville Corporation. In the immediate vicinity of the locus there are many commercial uses including an office for- electrolysis, condominiums, and other varied business uses. The architectural style of the proposed building would be cape cod style and the same- as now exists on the abutting lot which has the building constructed by the Centerville Corporation. This style of building blends both a business and residential appearance and would not be detrimental to the neighborhood and would provide a convenience to the neighbor- hood. Mr. Boudreau asked that the Board allow the petitioner a variance as requested. Speaking in favor of the petition was Joe DaLuz, building commissioner for Barnstable who said that the proposed building would•be an asset to the neighborhood. Mr. William E. Dacey, Jr.� spoke in favor of the petition based on the architectural design of the proposed building which would be similar to the building existing on the front lot. No one spoke in objection to the petition and the Board took the matter under advisement. The Board found that the locus is divided into three zoning districts, RB, RD-1 and Business and that it is unsuitable for residential use .in a reasonable manner. The bisection of the locus into zoning. districts which allow business and residential use cause it to be unique to the area in which it is located and the Board found compliance with the requirements of Sec. 10 of Chapter 40A. , M.G.L. and Sec. Q. 2 (c) of the Barnstable zoning by-laws. The Board found that the proposed building would have an architectural style similar to the office building existing on the adjacent A (cont.)
