The immediate abutters include f1' the"Pixy Radio Station"building,a commercial building now used as a convenience store,a restaurant,a car dealership,an apartment building,and multi-family properties. The property is unique in that it is '- located in both the RB Residential B Zoning District and the B Business Zoning District. It is the only property in the neighborhood affected this way. It is the only property in this area bisected by two zoning districts. It is the only residential property in the area abutted on three sides by commercial uses. As to the history of the property,the applicants bought the property in 1987 as an investment. They bought it at the"top of the market". In 1989,they went to the town and asked if this property could be ii 3 converted to an apartment use. They were issued two permits-one for plumbing and one for electrical work. The applicants were told that as long as there were no stoves in the individual units,the use would not be considered apartments and would be allowed as-of-right. Each unit has had a sink and a microwave since the time they were created in 1989. In 1997,the applicants were told they were in violation of the Zoning Ordinance and told they needed relief. They did not do anything immediately until 1999 when the Building Department again told the applicants the use was illegal and they emptied the building. It is still empty. -- In this mixed neighborhood,Attorney Gilmore stressed the relief requested is not inappropriate in view of r the need for affordable housing in the town. This dwelling has been used as affordable housing for the ' residents of Hyannis. The applicants are seeking to reduce the number of units from 4 to 3 in an effort to reduce the burden. The applicants paid approximately$90,000 for the home and have put money into the dwelling in upkeep and maintenance. To convert the dwelling to a single family use would be a monumental financial hardship. Plus,the applicants have approached realtors and were told that this — property would not hold its value if it were converted to a single family dwelling and then put on the market. To grant the relief would be within the spirit and intent of the Zoning Ordinance. If this relief is II granted,Attorney Gilmore agreed that Site Plan Review is needed for this use, i Attorney Gilmore submitted copies of a floor plan showing only three units. He also submitted photographs of the site to show how five cars can be accommodated on the property. Attorney Gilmore a also submitted photographs of the interior of the units and the surrounding commercial neighborhood. One unit has a"full kitchen",the other units have a sink and a refrigerator,and will have a stove within the - living room/kltchen area. Currently,there are four separate units,however the applicants are seeking to legalize only three units. If this relief was granted,it would allow the applicants to convert the property to ,lii three units,and then sell the property. The Town of Barnstable recently adopted a new section to the General Ordinance addressing affordable ' .-4-, m housing(Article LXIII-Inclusionary Affordable Housing Requirements). Attorney Gilmore indicated he - was not familiar with the article and would like time to review it and see if this is a possible avenue for the - - applicants to explore. Attorney Gilmore requested a continuance. The Board decided to continue Appeal Number 1999-128 to November 17, 1999 at 9:00 PM. 64 - Board Members hearing this appeal on November 17th were Gene Burman, Richard Boy,Tom DeRiemer, - Ralph Copeland,and Chairman Emmett Glynn.Alternate Board Member Ralph Copeland,who was present and heard the testimony on October 27th, replaced Ron Jansson, Attorney Bruce Gilmore represented the applicants,Colleen and James Eldredge,who were present, At the start of the hearing,Board Member Richard Boy asked if the applicant had received Site Plan _ Review Approval. Attomey Gilmore reported if this relief is granted,they intend to then go to Site Plan Review. There will be no change to the exterior of the building and a decrease from 4 unit to 3 units. The Board stated that the Zoning Ordinance requires Site Plan Review approval before the granting of a = Special Permit. The parking was discussed at Site Plan Review and they requested the parking be"reconfigured to be closer to the building in order to eliminate potential interference with Stuart Street. A total of five spaces shall be delineated on gravel pavement with curb stops." That was done and the plan was submitted to the Board. The applicant,James Eldredge,addressed the Board and reviewed rents for the units. They range from $75-$90 per week including amenities. This is considered"affordable"for the area. DC Melanson requested to have the BIRST team inspect this property after the second double overdose in a single night within 2 weeks. This property has a long history with HFD and BPD for emergency responses. The number of logged calls to this address is reported to be 37 for this summer alone. The property is a ranch now consisting of 4 units. A full dumpster, couch and over stuffed chair were outside next to the dumpster. The end unit, closeted to Spring Street (#10) is occupied by Alma Anderson, a single father of two and a large dog. Alma admittedly has served as the unofficial guardian of the property and this was also confirmed by the property owner in a subsequent conversation. Mr. Anderson advised that he no longer attempts to contact the property owner's agent to report undesirable conditions. He said he is afraid of the addicts that loiter there. He blamed the woman in unit 1 OB. - The two adjacent units are 1 bedroom units and are occupied by at least 2 adults in each (mother/daughter-IOB & one couple— 1OA). The end unit (IOC) is vacant. The vacant unit (IOC) is in disrepair. It was open to the elements and not secured. The kitchen cabinets have been damaged and doors are missing. The stove is away from the wall. The unit is littered with drug paraphernalia, discarded clothing and personal items. A bare mattress was on the floor. The side and rear yards are really a narrow path that winds around to the back but stops at Alma's unit. One cannot travel all the way to Spring Street or back around to Stuart. There is a section of fence along the rear perimeter that allows one to pass with great care —this area is overgrown. A section of fencing is pulled down allowing one to pass through to 41 Spring Street with care. The side and rear yard along the vacant unit around to the back is littered with broken glass, trash, needles and empty Narcan containers. Tim condemned unit C. Report in street file. I also required him to remove the couch and chair and empty the dumpster. We agreed to talk on Monday. I told him that I would be dispatching an inspector to confirm it was done in accordance with our discussion. Monday 9/21/2015 Spoke to Adam. He stated that the property has been secured and cleaned out. The chair and couch was removed. He is unable to meet today but will be in on Tuesday. I advised him about the missing smokes & CO detectors. He replied that the rentals are inspected by Health annually. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 27, 1999, and continued to November 17, and December 15, 1999, at which time the Board granted the requested relief with conditions. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-128-Eldredge Variance to Section 3-1.1(1),Section 3-3.1(1)(1)&Section 3-2.1(J)(b)(d)(e)(i) Attorney Gilmore described the area surrounding the property in issue. The immediate abutters include the"Pixy Radio Station" building, a commercial building now used as a convenience store, a restaurant, a car dealership, an apartment building, and multi-family properties. The property is unique in that it is located.in both the RB Residential B Zoning District and the B Business Zoning District. It is the only property in the neighborhood affected this way. It is the only property in this area bisected by two zoning districts. It is the only residential property in the area abutted on three sides by commercial uses. . As to the history of the property, the applicants bought the property in 1987 as an investment. They bought it at the"top of the market'. In 1989, they went to the town and asked if this property could be converted to an apartment use. They were issued two permits-one for plumbing and one for electrical work. The applicants were told that as long as there were no stoves in the individual units, the use would not be considered apartments and would be allowed as-of-right. Each unit has had a sink and a microwave since the time they were created in 1989. In 1997, the applicants were told they were in violation of the Zoning Ordinance and told they needed relief. They did not do anything immediately until 1999 when the Building Department again told the applicants the use was illegal and they emptied the building. It is still empty. In this mixed neighborhood, Attorney Gilmore stressed the relief requested is not inappropriate in view of the need for affordable housing in the town. This dwelling has been used as affordable housing for the residents of Hyannis. The applicants are seeking to reduce the number of units from 4 to 3 in an effort to reduce the burden. The applicants paid approximately $90,000 for the home and have put money into the dwelling in upkeep and maintenance. To convert the dwelling to a single family use would be a monumental financial hardship. Plus, the applicants have approached realtors and were told that this property would not hold its value if it were converted to a single family dwelling and then put on the market. To grant the relief would be within the spirit and intent of the Zoning Ordinance. If this relief is granted, Attorney Gilmore agreed that Site Plan Review is needed for this use. Attorney Gilmore submitted copies of a floor plan showing only three units. He also submitted photographs of the site to show how five cars can be accommodated on the property. Attorney Gilmore also submitted photographs of the interior of the units and the surrounding commercial neighborhood. One unit has a"full kitchen", the other units have a sink and a refrigerator, and will have a stove within the living room/kitchen area. Currently, there are four separate units, however the applicants are seeking to legalize only three units. If this relief was granted, it would allow the applicants to convert the property to three units, and then sell the property. The Town of Barnstable recently adopted a new section to the General Ordinance addressing affordable housing (Article LXIII - Inclusionary Affordable Housing Requirements). Attorney Gilmore indicated he was not familiar with the article and would like time to review it and see if this is a possible avenue for the applicants to explore. The Board asked the applicant to look into the issue of a possible lodging house use on this site. The Board also asked the applicant to verify the proposed plan complies with the state sanitary code with regard to minimum size of living units. The property in issue was before Site Plan Review on December 9, 1999 and received Site Plan Review approval fqr three units. The parking was discussed at Site Plan Review and they requested the parking ' be"reconfigured to be closer to the building in order to eliminate potential interference with Stuart Street. A total of five spaces shall be delineated on gravel pavement with curb stops." That was done and the plan was submitted to the Board. Board Member Richard Boy did not feel the site had adequate parking. He felt the parking on the plan did not reflect what was really on the ground. The applicant, James Eldredge, addressed the Board and reviewed rents for the units. They range from $75 -$90 per week including amenities. This is considered "affordable" for the area. Gloria Urenas, representing the Building Commissioner, indicated the Building Department has no problem with allowing three units on this property based on their affordability for Hyannis residents. Public Comment: No one spoke in favor or in opposition to this appeal. The property is also unique in that it is bisected by a residential district and a business district. It is the only property in the neighborhood affected this way. 7. There is a hardship to the owner as they bought this property believing this use was an allowed use. 8. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. It is not clear whether the submitted floor plan represents existing conditions or the layout of the 3 proposed living units. The application states that no construction activity is proposed. Will each of the 3 living units have a separate fully functional kitchen with a stove or will there be a shared, common kitchen? If only one shared kitchen is being proposed, this could be a lodging house situation rather than an apartment building,which normally has separate kitchen facilities for each individual unit. Staff suggests the applicant be prepared to address this issue before the Board. Will this be a lodging house or an apartment building? Staff also suggests the applicant submit a floor plan clearly delineating each of the proposed units with a breakdown of the square footage of each unit. The renting of rooms for not more than 3 non-family members by a family residing in a single-family dwelling is permitted as an accessory use in the RB District. If the applicant is proposing a lodging house rather than an apartment building, relief may not be required. However, if a lodging house is being proposed, a family residing in this dwelling would be required to obtain a Lodging House License from Licensing and there could be no more than 3 non-family members in addition to the family renting the rooms. Also, the renting of rooms to no more than 6 lodgers in one multiple-unit dwelling is permitted as a conditional use in the RB District, provided a Special Permit is first obtained from the Zoning Board,of Appeals. The applicant has also applied for a Variance,from subsections(b), (d),•.(e),:and (i)of the multi-family s° dwelling provisions. However,`it appears that subsections(a), (0 and (g) also cannot be t iet: Subsection (g)requires 1.5 off street parking spaces per each apartment unit. Three apartment units require 5 on- site parking spaces..There is very little room on this site for parking. There appears to be enough space • for 1 or 2 vehicles in the existing driveway.: On a recent site visit(10/20/99), staff observed several vehicles parked on Stuart Street,which is a paved, private dead end way. The only other properties which use Stuart Street for access are the 2 lots to the south (Parcels 038 and.042). Staff suggests the applicant be prepared to provide the Board with a proposed parking plan. Site Plan Review The applicant has not been before Site Plan Review. Only single-family and two-family dwellings are exempt from Site Plan Review, multi-family dwellings are not. However, if a lodging house is being proposed for not more than 3 non-family members, Site Plan Review would not be required. Surrounding Land Uses The property is located in an area of town with a mix of different land uses. Commercial buildings are located to the west and southwest. An apartment complex(Cromwell Court Apartments) is located to the northwest. Single-family residences are located to the north, east and south of the subject site. A multi- family dwelling on the locus would provide a transition from the more intensive commercial uses to the west and southwest and the single-family neighborhood to the north. Local Comprehensive Plan The Hyannis Village Plan recommends providing transition zones between residential and non-residential districts but also recommends that use variances not be granted within residential districts. Policy 7.7 Establish and strictly enforce buffer zones between commercial and residential districts. Maintain these buffer zones as transition zones between residential and non-residential districts and/or uses. Strategy 7.7.2 Provide for a limited amount of multi-family residential uses between the boundaries of designated commercial and residential areas to buffer more intense uses from less intense uses.... 2 ti Town of Barnstable-Planning Department-Staff Report Appeal Number 1999-128-Eldredge Variance to Section 3-1.1(1),Section 3-3.1(1)(1)&Section 3-2.1Q(b)(d)(e)(i) Policy 7.8 Maintain existing residential district boundaries and restrict non-residential uses from encroaching into the residential neighborhoods. Strategy 7.8.1 Remove the "use variance"from the residential districts. Allow only the uses which are consistent and compatible with residential uses, including home occupations. The locus is unique in that it is bisected by a business district and a residential district. The proposed multi-family dwelling is a residential use that appears to be consistent and compatible with this particular area of town. However, staff is concerned with the small size of the lot(0.13 acres)and the proposed number of units(3)and required parking(5 spaces). Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that- justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Eldredge, Petitioner Facts 1. Petitioner, James C. Eldredge, is a resident of South Dennis, Barnstable County, Massachusetts and the owner of record of 10 Stuart Street, Hyannis, Barnstable County, Massachusetts. 2. 10 Stuart Street, Hyannis, identified as Assessor's Map R327, Parcel Number 043, is located within RBB zoning district. 3. On or about July 14, 1999, petitioner submitted an Application to Petition for a Variance of Section 3-21J(b)(d)(e)(i) and Section 3-3.1I. Background 4. The petitioner purchased the property on January 12, 1987 (Book 5542, Page 295) from William J. Wier. At the time of the sale, the property was used as a single- family residence. 5. Shortly after purchasing the property, the petitioner contacted Joseph Daluz (former Building Inspector for the Town of Barnstable) to inquire whether the property could be converted to a multi-family unit. The petitioner showed a proposed plan at the meeting and Mr. Daluz approved. Electrical and plumbing permits were pulled. 6. During remodeling, Mr. Daluz confirmed that the property could have an unlimited number of refrigerators and microwaves. However, stoves and kitchen sinks were not permitted, as they would constitute a kitchen, according to the building code. 7. . For approximately ten (10) years, the property has been rented to four boarders, and taxed as a multi-family dwelling. 8. Approximately a year and half ago, the petitioner was contacted by the building department via letter to cease renting the locus. R 9. At the petitioner's request, a representative from the Building Department toured r the locus and found that petitioner could resume renting the premises. Since there were doors connecting each room, the petitioner was not in violation. 10. Subsequently, the petitioner placed the property for sale and listed it with a relator as a multi-family dwelling. A potential buyer contacted the Town Building Inspector to confum the property was in compliance with the zoning. Gloria Uranous, the Town Zoning Enforcement Officer, contacted the petitioner and informed him the multi-family use was noncompliant and must cease to be rented to multiple families until a variance is obtained. Argument 11. Petition requests a variance to Sections 3-2.1J(b)(d)(e)(i) and Section 3-3.lI of the Town of Barnstable Zoning By-Law. The property is unique in that it abuts and is partially bisected by a business zone. All the adjacent properties to the west are either commercial or multi-family buildings, including Cromwell Court. The petitioner, based on the reliance of the building inspector's office in 1989, believed his conversion was legal and spent a considerable amount of money making the conversion. Conclusion Petitioner respectfully requests the Zoning Board of Appeals to grant this variance.
