Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2,15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. Sarty, 11 requested a special permit to adda second floor to a dwelling that was not in conformance with the minimum side yard setback requirements. The addition would increase the intensity of the pre-existing nonconformity, thus a special permit was required. The subject property is located off of Ocean Avenue, near Sea Street Beach, and has frontage on both Studley Road and Crocker Drive. The lot contains 7,500 sq.ft, as shown on a plan of land recorded in 1946. The dwelling was a one-story, 3-bedroom ranch house with a total living area of 1,552 sq.ft; it was constructed in 1955. The house did not conform to the 10 foot minimum side yard setback requirement in the RB District. It is set back 5.1 feet at the closest point on the west side and 9.8 feet on the east side. The house was served by a four-bedroom septic system. Public sanitary sewers were scheduled to be installed in this area as part of the Stewart's Creek water and sewer project. In 2011, the Applicant appeared before the Zoning Board seeking relief to expand the house.After Board deliberation, that application was withdrawn. This proposal represented a scaled-back version of house presented in 2011. With this proposal, the two existing gable ends fronting Studley Road would be heightened to 1.5 stories and a full second story would be added, set in approximately 12 feet from the edge of the house on each side. A one-car garage addition with an 18 foot side yard setback and a 20 foot front yard setback was proposed; the garage addition conformed to all zoning requirements. Procedural&Hearing Summary Special Permit No. 2012-025 to allow expansion of a legal preexisting nonconforming single-family dwelling was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 6, 2012. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A.i The hearing was opened on May 9, 2012 and continued to May 23, 2012 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Board Chair Laura F. Shufelt, William H. Newton,Alex M. Rodolakis, Brian Florence, and George T. Zevitas. • Bk 26471 Pg 96 #37742 Town of Barnstable Zoning Board of Appeals—Decision and Notice Special permit No.2012-025-Sarty Attorney John Kenney represented the Applicant before the Board. Howard L. Sarty and representatives from the architectural, design, and construction firms were also present. Attorney Kenney reviewed the proposed elevations and floor plans. He compared the proposal to the one previously before the Board, and reviewed how the new design reduced the massing of the dwelling by eliminating a second-story dormered addition. He explained that the garage addition had been reduced to a one-car addition that complied with setback requirements. Attorney Kenney confirmed that the existing house has 3 bedrooms, currently served by an on-site septic system, and the proposed 4-bedroom house would be connected to public sewer when available. He clarified that the second story would include storage space under the dormers, as the basement is wet and unsuitable for storage. The Board commented that the revised plans responded to many of the concerns they had with the initial proposal. Public comment was requested and no one spoke in favor of, or in opposition to the request. Findings of Fact At the hearing of May 23, 2012, the Board unanimously made the following findings of fact for Appeal 2012-025, a request for a special permit filed by Howard L. Sarty, II to expand a legal preexisting nonconforming dwelling at 22 Studley Road, Hyannis: 1. Howard L. Sarty, 11 petitioned for a Special Permit in accordance with Section 240-92(B) Buildings or Structures used as single-or two-family residences. The petitioner is proposing to construct a 12'x 12' attached garage additional that will not encroach into the required setbacks and to add a second story to the main dwelling with a gross floor area of 1,240 square feet. The dwelling does not conform to the 10 foot side yard setback requirement. 2. The subject property is located at 22 Studley Road; Hyannis, MA as shown on Assessor's Map 306 as Parcel 019. It is in a Residence B Zoning District. 3. Section 240-92(B) of the Barnstable Zoning Ordinance allows for expansion of a preexisting nonconforming structure used as a single-family residence by special permit where the expansion intensifies the degree of the preexisting non-conformity and does not conform with the bulk regulations in the district. The existing structure is legally preexisting nonconfoming. 4. Site Plan Review is not required for alteration or expansion of a single-family residential structure. 5. After an evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The proposed structure is in keeping with the neighborhood and reflects the character of the existing house. 6. That the proposed expansion will not be substantially more detrimental to the neighborhood than the existing building or structure. The massing of the structure within the nonconforming side yard setbacks has been minimized. The vote to accept the finding was: AYE: Laura F. Shufelt, William H. Newton,Alex M. Rodolakis, Brian Florence, George T. Zevitas NAY: None Decision Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No. 2012-025 subject to the following conditions: 1. Special Permit 2012-025-is granted to Howard L. The additions shall be constructed in substantial conformance with the plan entitled "Plot Plan of Land located at 22 Studley Road, Hyannis, MA"drawn and stamped by Yankee Survey Co, Inc., last revised March 5, 2012 and the elevations and floor plans entitled "Additions and Alterations, 22 Studley Road, Hyannis, MA"drawn and stamped by Bruce Devlin Design, dated March 2012. 3. The number of bedrooms on the property'shall be limited to four, unless the property is connected to public sanitary sewer. 4. There shall be no further expansions or addition_ s to the dwelling and no detached accessory structures shall be constructed on the property without further relief from this Board. 5. All mechanical equipment associated with the dwelling (air conditioners, electric generators, etc.) shall be located and conform to the required setbacks for the district and screened from neighboring homes and the public right-of-way. 6. The decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit.
