Equipment is delivered at night and weekends and sheet metal and pipe cutting and welding take place in the front yard of the property. Onsite storage occurs. Three unregistered vehicles in the front yard store equipment for this sheet metal and HVAC business. This has continued for over half a decade and the town has been regularly informed. Once cold weather arrives the work is moved into the basement with accompanying dangers. For example,the electric Fine from the home to the electric pole caught on fire after dark a few years ago.This can be checked out with the fire department. Isn't the reason commercial activity is required to take pace in a commercially . zoned area is for safety and to prevent disruption to residents in residential areas. The accompanying noise from late deliveries of piping and sheet metal,,cutting of metal, and on-site welding is unsafe, disruptive and reduces our property values. The town Health Department has diligently worked to regularly remove hazardous waste and.trash from the property only to have it reappear days later. This past weekend activities are an example of what regularly takes place on.the property. Saturday the police arrived and spoke to the employees about the multiple unregistered vehicles in the front of the property and the status of the property.The Police Officer can attest to'the quantity and type of materials in the front yard. Subsequently most of the bags were removed but residual junk remains on the'lawn and the commercial activities will resume until this business is relocated. The front yard commercial work continues during the weekend and increases in volume, number of employees involved and is disruptive for most of the weekend. Isn't it time to move this commercial activity out of a residential area and into a commercially zoned. area? Aren't there many commercial,areas in Barnstable to which this business could be moved? Hasn't the owner told the town many times over the last half decade that he is'looking'? Isn't it time to issue a cease and desist order? At the time there were no answers. The town has allowed a commercial business to operate in,a residential area for a number of years. . There is no commercial address for North Atlantic Mechanical. If deliveries,storage, welding, and other commercial activities are allowed to continue on a residential property can that property truly be cleaned . up and safe? There are two vans which are used for commercial storage and a truck used to store junk and debris. Wouldn't it be wonderful to have this issue finally resolved and have the commercial business.moved to a commercially zoned area? The debris from the Work is disposed of in the trash bins that are kept on the front lawn by the street where the trucks pull over at night, as you can see from the photo. In the mornings, the truck you see is just.one of those which picks up the material and moves it. While I was taking the photos from my front lawn one of the female neighbors there came out and threatened to come over and beat me up. A recording was started after the verbal threat, but does show the type of bullying that is regularly done to our family. The town Councilors' office suggested we put together a summary of what has been happening at the property over the last 2 years so we would all have the same understanding of it. We appreciate all that you have done so far. This situation has affected the real estate value of our property and the use of our home. You have to realize that what you see in the attached photos is the only view from our home. Who would like this across from their home? Summary: Health Department records show that beginning.2013 regular phone calls regarding neighborhood concerns that the residence at 20 Sunset Terrace Hyannis has violated health department regulations. The residential property is regularly used as a storage and transfer station for old and new commercial heating/cooling equipment and debris from a business conducted onsite. Items include: furnaces, hot water heaters, commercial A/C units, 250 gallon oil tanks, metal pipes/cement, stacks of PVC pipe, motors, large metal sheeting used to fashion system piping,onsite, as well as other items. Items are stored from the street edge to the back property line and then across the side of the front lawn. The area is zoned residential. (Please see photos attached) Additionally,several rubbish barrels are always located in the front of the house and are the only view we have from our front living room window. And 2 unregistered vehicles. ( enclosed photos.) All material is stored outside, near and visible from the street,which as you let us know is indirect violation of the Town Ordinances: * Chapter 54-3 regulating outdoor storage...:"personal.property shall be kept within enclosed structures or screened from public view." * Chapter 54-5 Storage and removal of rubbish,garbage and refuse, Section C: "Receptacles shall be located in such a manner... to provide maximum screening from thestreet,..may be placed in the open near a street within 24 hours of scheduled collection and disposal by a contractor.......and returned to a screened location within 24 hours thereafter." * Chapter 5472 Compliance with other town and state regulations (water supply protection, solid waste) The chemicals that may leak.from these old units could contaminate the 4 nearby groundwater wells used for town drinking water. The attached map shows this residential property is within the protective zone for these town wells and very close to them. Once chemicals enter the groundwater during storms it is not possible to retrieve them and it only takes a very small amount to affect the drinking water. Sand and gravel at the Cape percolates and transfers chemicals at a very rapid rate. Since this is a residential area it does not have the safeguards for collecting runoff required by Federal and state stormwater permits in commercially zoned areas. This neighborhood is posted with town signs re: protection of the water supply. (photo attached) We have spoken with one of your health agents Jim Parziale a number of times and he seems like a very nice young man however, at.this point perhaps another health inspector with more experience would have the ability to resolve this situation which has continued for 2 years. For the last 2 years we have not been able to open the window shades that look out into our front yard due to the landfill view. A sheet metal business has been conducted on the property and a record.of an electrical house fire from this type of work being conducted inside the house required the fire department and electric company to respond during the middle of the night a couple of months ago with the electrical company replacing the entire electrical line going into the house from the pole after it had caught on fire. This is a highly dangerous situation using commercial torches on residential property to fashion sheet metal. Jim's record notes from 2013 continually downplay the magnitude of this situation on what is regularly stored there and refers to it only as trash and one or two items, not as multiple and diverse commercial items from a business. Our photos of the residential property for this entire period show commercial heating and cooling items, constructions debris, as well as trash. New items are delivered and the old materials ripped out of the buildings being worked on are stored at the property sometimes for weeks at a time. This is a residentially zoned area in a drinking water protected area. Jim mentioned he had spoken to someone at the house but was unclear on who it was and it has taken nearly 2 years for a violation to be issued. When you and I spoke at the town hall a few weeks ago you were surprised that this situation had not been brought to your attention given the length of time it was going on and we thank you for prompting action on this. It has been very difficult to reach Jim during the office hours listed.on his business card and he has had little time to talk on the phone so we appreciate your assistance. This situation has affected the real estate value of our property and the use and enjoyment of our home. We know from speaking with you directly that you feel this situation has gone on way too long and should be resolved for health and safety reasons, and we all agree that this situation is just wrong on a number of levels. The caller stated that you have impeded the access on Hemeon by storing various items,including an unregistered vehicle,old pallets and a wood-pile over your property line and into Hemeon Road. It may very well be that you are unaware of the.exact bound's or even the existence ofHemeon Road as I can' see from the aerial photographs the area appears to be heavily vegetated. With that being said,it is obvious to all that staff is unable to determine property lines when performing site inspections therefore I am writing to make you aware of this complaint and,to" afford you the opportunity to take corrective measures(if necessary). A proactive response may serve to avoid possible legal action. Relocating the material and items alleged to be in Hemeon Road would certainly be the easiest and least expensive option for all parties. Failure to address this issue may result in a civil complaint initiated and pursued by the caller.
