Two— 14 Terry Court-tenants want a business certificate signed to remove
trash. Zoning district is MS ,
• Applicants previously spoke to Robin who requested they gain approval from the landlord.
• Landlord spoke with me to be sure he couldn't incur any violations if they should violate.
• 1 explained that yes he could.
• Property has a history of complaints including trash,overcrowding.
• Bob McKechnie wrote a cease and decist in October 2017 for the use of the basement for
sleeping without proper emergency egress.
• No permits to remedy violations on record.
• Hyannis Fire went to property, see letter dated Oct 31, 2017 listing multiple violations including:
multiple bedrooms in basement with electrical cords and safety issues(lack of smoke detectors).
• The landlord Michael Mongeau (508-367-2646 give them permission see letter. It appears to be
a copy. Kathryn from Health said he is in Florida.
0 This rental property is not yet registered with the Health Division. Kathryn from Health has e-
mailed him the application and has not yet received it back.

Received a walk-in report of a BWOP at this address. Upon arrival found a small fire burning
in a makeshift fire pit in the side yard between the house and a garage. The material that
was burning was pressure treated fencing. Spoke with Russhane Cambbell the occupant of the
property and he stated he was going to cook on the fire. I advised him that cooking on
pressure treated wood was not a good idea due to the chemicals in the wood. There was no
garden hose or other devices to control the fire and the exterior faucet did not even have
water to it. We extinguished the fire with a PW extinguisher and a bucket of water from the
house using the exterior faucet which had to be turned on and off in the basement.
It was noted that vehicles parked along the street impeded us from being able to access the
last two houses on the street. It was also noted that there were four unregistered vehicles
around the property along with three registered vehicles. I called Car 805 (Lt Lanman) to
come to this property due to these conditions. Upon the arrival of Lt Lanman, he viewed the
vehicles and the roadway situation. Lt Lanman was able to access the interior of the house
with Mr Cambbell. After a short period of time Lt Lanman requested a building inspector due
to a bedroom being in the basement of this property. I notified F/A of the request. Engine 6
stood by until the arrival of the building inspector.

Narrative:
I was called to scene by Captain Farrenkopf,regarding the accessibility issues they
encountered while responding to the listed address. Engine 6 was unable to get down the
street due to illegally parked cars on both sides of the road. Investigation of the. area
noted seven unregistered vehicles, along with a scooter and a dirt bike. I spoke with the
listed tenant and after some discussion he gave me permission to enter the dwelling to check
for working smoke and CO detectors. In the foyer/mud room there was another dirt bike as well
as a gasoline powered mini-bike. Checking the first floor area I. noted there were no smoke
detectors mounted to the ceiling, although there was evidence of mounting holes and brackets.
The tenant brought me the detector that had been removed, there was no battery in it. There
was no CO detector present.
I checked the basement with similar results, brackets but no smoke detectors. There was a
working CO detector in the basement area. Further investigation revealed two "rooms" that had
been created.by floor to ceiling studs and sheets/blankets hung to create separate spaces.
One of these had a mattress with bed linens on the floor giving the impression that it was
being used as a bedroom.
I stepped outside to get some smoke detectors and a battery. I had the Captain call fire
alarm to request a building inspector to the scene. Bob McKechnie arrived on scene and was
shown the issues in the basement. The tenant at our request removed the mattress and the two
motor bikes from the dwelling.
I replaced the battery in the smoke detector and re-mounted it to the ceiling. There was .
evidence of a second detector outside the second first floor bed room, but its proximity to
the kitchen stove and a ceiling fan made it prudent to mount a replacement inside the bed
room itself. A second new detector was installed in the basement. Units cleared the scene at
the noted times.
I informed Barnstable Police and the Towns Zoning Enforcement Officer of the current
situation at this property.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 14 Terry Court, Hyannis, MA, was inspected on
October 23, 2017 by Jim Parziale, Health Inspector for the Town of Barnstable. This
inspection was conducted in response to a complaint filed with the Town of Barnstable
Public Health Division.
The following violations of the State Sanitary Code were observed:
105 CMR 410.480 (A)—Locks
Broken windows in dwelling are incapable of being secured against unlawful entry.
105 CMR 410.482—Smoke Detectors and Carbon Monoxide Alarms
Dwelling is not equipped with carbon monoxide alarms.
105 CMR 410.750 (P) Conditions Deemed to Endanger or Impair Health or Safety
Occupants are using basement area for sleeping purposes however basement is unfinished
and lacks adequate secondary egress.
You are directed to correct all State Sanitary Code violations listed above within
twenty four (24) hours of your receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served. However, these
violations must be corrected within twenty four hours regardless of any request for a
hearing. Non-compliance will result in a fine of$100.00 per violation. Each day's failure
to comply with an order shall constitute a separate violation. Should you have any
questions regarding the above violations, please contact the Town Health Division and
ask to speak with the inspector who performed the inspection.

§ 240-24.1.4• MS Medical Services District.

A. Permitted uses. The following principal and accessory uses are permitted in the MS District.
Uses not expressly allowed are prohibited.
(1) Permitted principal uses.
(a) Single-family dwellings.
(b) Two-family dwellings.
(c) Business and professional offices.
(d) Nursing homes.
(e) Medical/dental clinics.
(f) Hospitals(nonveterinarian).
(g) Bed-and-breakfasts.
(h) Multifamily housing totaling not more than six dwelling units per acre or 12 bedrooms
per acre.
(i) Mixed-use development.
(2) Permitted accessory uses.
(a) Family apartments.
(b) The following uses shall only be permitted as ancillary operations to a hospital,nursing
home,or other medical-oriented facility:
[1] Personal services,such as barber or beauty shops.
[2] Banking services.
[3] Restaurants.
[4] Pharmacies.

(1) Permitted principal uses as follows, provided, however,that a special permit shall not be
required when the applicant has obtained a development of regional impact approval,
exemption or hardship exemption from the Cape Cod Commission:
(a) Nonresidential development, including nursing homes,with a total floor area greater
than io,000 square feet.
(b) Mixed use developments with a total floor area greater than 20,000 square feet or
greater than io,000 square feet of commercial space.
(2) Multifamily housing proposing to create seven or more dwelling units per acre or i3 or
more bedrooms per acre and including at least 25%of workforce housing and totaling not
more than 12 units per acre. Multifamily housing in the MS District is not required to
provide inclusionary housing pursuant to Chapter 9 of the Barnstable Code.
C. Dimensional, bulk and other requirements. (NOTE: For hospital uses:the maximum building
height provisions set forth in the table below may be extended to no more than 85 feet or a
maximum of six stories not to exceed 85 feet;and,the maximum lot coverage requirements set
forth below shall not apply.)

(1) Setbacks.
(a) The front yard landscaped setback shall be io feet.
(b) The SPGA may reduce to zero the rear and side setbacks for buildings to
accommodate shared access driveways or parking lots that service buildings located
on two or more adjoining lots.
(2) Site access/curb cuts.
(a) Driveways on Route 28 shall be minimized.Access shall not be located on Route 28
where safe vehicular and pedestrian access can be provided on an alternative
roadway, or via a shared driveway,or via a driveway interconnection. On Route 28,
new vehicular access, new development, redevelopment and changes in use that
increase vehicle trips per day and/or increase peak hour roadway use shall be by
special permit.
(b) Applicants seeking a new curb cut on Route 28 shall consult the Town
Director/Superintendent of Public Works regarding access on state highway roadways
prior to seeking a curb-cut permit from the Massachusetts Highway Department,and

work with the Town and other authorizing agencies,such as the MHD,to agree on an
overall access plan for the site prior to site approval.The applicant shall provide proof

(c) All driveways and changes to driveways on Route 28 shall:
[i] Provide the minimum number of driveways for the size and type of land use
proposed;
[2] Provide shared access with adjacent development where feasible;and
[3] Provide a driveway interconnection between adjacent parcels to avoid short trips
and conflicts on the main road.
D. Site development standards. In addition to the site development standards set forth in §240-
24.1.10 below,the following requirement shall apply:
(1) Landscaping for multifamily housing.A perimeter green space of not less than io feet in
width shall be provided,such space to be planted and maintained as green area and to be
broken only in a front yard by a driveway and/or entry walk.

INTENT: It is the intent of this section to allow the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,'subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the
activity shall not be discernible from outside the.dwelling: there shall be no increase in noise or odor;no visual
alteration to the premises which would suggest anything other than a residential use;no increase in traffic above normal
residential volumes;and no increase in air or groundwater pollution.
After registration with the Building Inspector,a customary home occupation shall be permitted as of right subject to the
following conditions:
• -The activity is carried on by the permanent resident of a single family residential dwelling unit,located
within that dwelling unit.

• There are no external alterations to the dwelling which are not customary in residential buildings,and there
is no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.
• The use does not involve the production of offensive noise,vibration,smoke,dust or other particular
matter,odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess
of normal household quantities.
• Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment.
• There are no commercial vehicles related to the Customary Home Occupation, other than one van or one
pick-up truck not to exceed one ton capacity,and one trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containingthe Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation.
• If the Customary Home Occupation is listed or advertised as a business,the street address shall not be

Notice to correct violations of Massachusetts General Laws,Chapter(M.G.L.) 148 Fire Prevention at 14 Terry
Court in Hyannis Mass.
The property owned by you located at 14 Terry Court in Hyannis was inspected by this department on October
23, 2017 as part of a multi-jurisdictional inspection.This inspection was conducted in response to multiple
complaints of potential fire safety code violations and incompliance with M.G.L. Chapter 148 Sections 4 and 5.
Our inspection of the property revealed the following violations;
I . M:G.L,. Chapter148 Section 26E, Residential buildings or structures; installation of smoke detectors.
- The.home was found to have no working smoke detector in the basement.
- The smoke detector located outside the bedroom closest to the kitchen was found to be inoperable.
These devices shall be properly installed and maintained in compliance with 527 CMR 1.00 Chapter 13
of the Massachusetts Comprehensive Fire Safety Code.
2. M.G.L. Chapter 148 Section 26F1/2: Carbon monoxide alarms required in certain residential structures.
The home was found to have no working carbon monoxide detectors. You shall cause to be installed.
- A carbon monoxide detector in the basement of this home.
- A carbon monoxide detector outside each bedroom on the first floor, located within 10 feet of
the bedroom door.
These devices shall be properly installed and maintained in compliance with.527 CMR.1.00 Chapter 13
of the Massachusetts Comprehensive Fire Safety Code.
3. M.G.L. Chapter 148 Section 5: The property,was found to have a collection of trash,debris,furniture
and mattresses built up around the exterior of the property. We have deemed these items to be a fire
menace and you shall cause these items to be properly removed with in 24 hours after receipt of this
notice.
4. M.G.L. Chapter 148 Section 5: During the inspection, I observed conditions in the basement area that
indicated the area was being utilized as multiple bedrooms and a living area complete with microwave
and refrigerator. I noted that these electrical devices were run off of multiple extension cords and
multiple outlet power adaptors which were powered by another long extension cord.The excess.cord
was hung on the furnace piping.These devices and cords shall be removed.

5. Additionally,In the basement I noted insufficient emergency escape and egress capability along with a
number of potential health,and building code violations.These issues were pointed out to the health and
building inspectors that were on site.These conditions shall be properly corrected to comply with the
building and health codes.

Property:
The subject dwelling is a 2 bedroom, 1 bath, 1-story single-family dwelling constructed
in 1930 on 0.13 acre. It is situated on a narrow lane behind 74 Camp Street. Terry
Court accommodates this property with a 3 bay detached garage. There are two other
Dwellings on Terry Court that were not involved in,this inspection.
Background:
This property transferred to.Mongeau in 2012. On Oct. 18, 2017, a business certificate
(dba form) from Robyn Phillips/Russhane Campbell was submitted seeking to operate a
used car sales business at 14 Teriy, Court. ' A note attached identified that the applicant
(Campbell) intended to utilize the three bay garage as part of the business activity. I was
not present when the dba form was submitted. I found the proposed use is not an allowed
use and as a result the form remains unsigned. It remains'on file.
At 2 PM on 10/23/17, Officer Gallant informed me of a request for inspectional services
staff to report to the subject site. The BPD were executing a search warrant and
reported that two rooms in the basement were found to be or have been used as
bedrooms. The general conditions were deemed to be unsanitary as well as unsafe. The
dwelling was thought to be overcrowded as well. Staff was requested to report to the site
at 3 PM.
Exterior &Yard:
Found household hash & returnables uncovered and exposed to the elements on the
garage side of the dwelling. A tent like structure collapsed around additional trash. Vines
were noted to be growing inside the unit. Broken windows were noted one two sides.of
tho'dwelling . ,
We did not access the, garage unit.

Dwelling:
Entered property and accessed lower level first. Primitive unfinished basement with
typical cellar windows.
Found the following conditions:
(Violations are bolded& italicized.)
Basement
• 1 light socket and wire hanging over stairs—not secured to wall
• Missing hand rail
• Found 1 area at base of stairs studded and used to segregate space for privacy &
sleeping thus creating a small hall. No permits for construction or use.
• 2"d sleeping space is segregated from 1" area with use of hanging blankets.
• Found there to be no emergency escape provision in either space.
• 1" room obviously used for sleeping but did not appear to be occupied on this
occasion and confirmed by PD.
• 1" area contained an old mattress and clothing -on floor as well as misc. items.
• 2"a room contained a dresser, (raised) multiple mattresses and personal effects.
• An old oxygen tank was noted in the hall next to the wash & dryer.
• Broken glass was strewn throughout the basement.

The primary level contained an entry, kitchen, living room, full bath and two bedrooms.
BPD advised that 7 occupants were confirmed on this date.
There were two broken windows noted
Hot'water was confirmed to operable and available.
Property is not a registered rental with Health agent.
Property use exceeded the occupancy allowance of 2 occupants per room—per Health.
Inoperable/missing smoke & CO detectors:
Conclusion:
Property is.in violation of building and health codes as identified above.

A notice to abate was issued,by Tom McKean, Health Director and sent to the property
Owner, Michael Mongeau on 10/24/17 at 77 Traders Lane, W. Yarmouth. -
A notice of the building code violations were;sent to property owner on 10/24/2017 at the
same mailing address.

Duringsthesthird=we'ek ofOctober,Detective Chevalier applied for and was
granted a Search Warrant from Barnstable District Court authorizing the
search of 1� 'Court for Cocaine and other drug related evidence.
On October 23rd,at approximately 1 PM,investigators executed the search
warrant and detained 8 individuals at the address.During a search of the
residence,detectives-located-and-seized-32_individually wrapped bags of
crack cocaine w_eighingapproxlmate�'- ly 15 grams and a small amount of
powdered'cocalne.Detectives also located a large amount of narcotics
packaging materials,including digital scales,and$4700.00 in US Currency.

held on$4000.00 bail Russhane Campbell was held-on$40.00 bail,and
Knlght_was-not eligible for,bail due to-the outstanding defaGlt�warrants.All ;
tbree_indiQuaa�re scheduled for arraignment in Barnstable District Court
on 10/24/2017.
