Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."
Applicants
Please fill out the workers' compensation affidavit completely,by checking the boxes that apply to your situation and,if
necessary,supply sub-contractors)name(s),address(es)and phone number(s)along with their certificate(s)of
insurance. Limited Liability Companies(LLC)or Limited Liability Partnerships(LLP)with no employees other than the
members or partners,are not required to carry workers'compensation insurance. If an LLC or LLP does have
employees,a policy is required. Be advised that this affidavit may be submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit or license is being requested,not the Department of
Industrial Accidents. Should you have any questions regarding the law or if you are required to obtain a workers'
compensation policy,please call the Department at the number listed below. Self-insured companies should enter their
self-insurance license number on the appropriate line.

policy information(if necessary)and under"Job Site Address"the applicant should write"all locations in (city or
town)."A copy of the affidavit that has been officially stamped or marked by the city or town may be provided to the
applicant as proof that a valid affidavit is on file for future permits or licenses. A new affidavit must be filled out each
year.Where a home owner or citizen is obtaining a license or permit not related to any business or commercial venture

The subject property is located on Third Avenue,West Hyannis Port. According to the Assessor's record,
the lot is a 0.23-acre lot developed with a one-story,three-bedroom,single-family dwelling building
sometime around 1985. It has a living area of 1,131-sq.ft. The property also has an enclosed porch and
green house. The total gross area and footprint of the building is 1,410-sq.ft. The existing structure does
not comply with the required side yard setback for the district and in fact infringes into the neighboring lot
addressed 58 Third Avenue.
The applicant is proposing to completely demolish and remove the existing single-family dwelling and
reconstruct a new single-family dwelling.The proposed new single-family dwelling will comply with all
required setbacks for the district. The proposed new structure is to be a 1&%-story, four-bedroom single-
family dwelling with an estimated 2,032 sq.ft. and an attached garage of 336 sq.ft. The total footprint is
1,540 sq.ft. resulting in a lot coverage of 15.4%.
Procedural& Hearing Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
November 07,2002. An extension of time for holding the hearing and for filing of the decision was
executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was
duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was
opened January 22,2003, at which time the Board found to grant the appeal.
Board Members deciding this appeal were,Gail Nightingale,Ron S.Jansson,Thomas A.DeRiemer,Jeremy
Gilmore,and Chairman Daniel M. Creedon. Attorney Stanley P. Nowak represented the applicant before
the Board: He presented the proposal for the demolition of the existing dwelling and reconstruction of a
new single-family dwelling that would conform to all of the requirements of zoning except that the lot was
undersized. He stated that a new Title V on-site septic system had been approved and installed for the
dwelling. In addition,he noted that the demolition would also cure the infringement of the existing
structure into the neighboring lot. At this time the public was invited to comment. No one spoke in favor
or against the proposal.
Findings of Fact:
At the hearing of January 22,2003, the Board unanimously made the following findings of fact:
1. The property at issue before the Board in appeal 2003-006 is addressed as 68 Third Avenue West
Hyannisport,MA,as shown on Assessor's Map 246 as Parcel Number 088-002. It is located in a
Residential RB Zoning District.
2. The Residential RB Zoning District today requires a minimum lot area of 1-acre. The subject lot is a
legal non-conforming lot. It has only 0.32-acres and when created in 1985 it met the legal minimum lot
area requirement.
3. The lot was developed around 1985 with a one-story, three-bedroom, single-family dwelling consisting
of 1,131 sq.ft. of living area. The property also has an enclosed porch and green house. The total
gross footprint of development is 1,410 sq.ft. The existing structure q g does not comply with the required
side yard setback for the district and in fact infringes into a neighboring lot.
4. The applicant is proposing to demolish the existing single-family dwelling and reconstruction of a new
single-family dwelling. The proposed new single-family dwelling will comply with all required setbacks

with an estimated 2,032 sq.ft. and an attached garage of 336 sq.ft. The total gross area of the new

5. The applicant, Martin Traywick has applied for a Special Permit in accordance with Section 4-4. 3 (2)
and finding under MGL Chapter 40A, Section 6,to permit the demolition of an existing single-family
residence on a non-conforming lot and construction of a new single-family dwelling in compliance with
required setbacks. The proposed new dwelling is a reconstruction and it does not intensify the alleged
nonconformity. In fact it cures an infringement of the dwelling into a neighboring lot. The proposed
new dwelling will conform to all seatback requirements of the district in which it is located.
Decision:
Based on the findings of fact,a motion was duly made and seconded to grant the appeal to permit the
demolition and reconstruction with expansion of a single family dwelling on an undersized non-conforming
lot. The reconstruction shall remove all non-conformities in structure location and the reconstruction shall
conform to all required setbacks for the zoning district and is subject to the following conditions:.
1. Location of the dwelling shall be as shown on a plan submitted to the board entitled"Plot Plan of Land
&Proposed New Foundation located in Barnstable,Mass # 68 Third Avenue," drawn by Carmen E.
Shay and dated 10/25/02.
2. The dwelling shall be built substantially in conformance to plans presented to the Board consisting of 8
sheets,all of which have been initialed by the Chairman and labeled"Traywick Residence, 3=d.Ave.
West Hyannis Port". A copy of which is included in the file.
3. The structure shall not exceed 1 &3/a -stories as shown on the plan. The total living area of the
structure shall not exceed 2,032 sq.ft.,and the total number of bedrooms shall not exceed four. The
basement,attic and the 336 sq.ft garage shall not be livable area. The approved construction in

accordance with the aforementioned plans shall be considered the full build-out of the lot. There shall
be no future expansion of the structure in footprint or in total gross area of building without permission
from the Zoning Board
4. The only permitted use of the property shall be a single-family dwelling as proposed. There shall be no
future accessory use and no future conditional uses permitted on the property.
5. The property shall be served by an on-site Title V septic system.
6. Demolition and reconstruction shall comply with Health and Building Divisions requirements.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that

a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the
Building Official,that he/she shall be responsible for all such work performed under the building permit.

with the State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION "
The Code states that: "Any homeowner perfomiing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the
unlicensed person as it would with a licensed-Supervisor, The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit
application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a
d and adoot such a form/certification for use in vour community.

known as Lot 4 on a plan of land for Martin Traywick, Trustee dated February 25, 1985
and recorded in Plan Book 420, Page 64 at the Barnstable County Registry of Deeds. (see
attached)
According to the plan, Lot 4 abuts lots numbered 5 and 6 on said plan and an
unnumbered lot on the North owned then and now by Frances& William McGurk and
which is shown on the above plan for reference but not as a part of the plan.
The abutting parcels are shown as assessors'parcels 88-2 (Lot 5), 88-3 (Lot 6)and
87 (McGurk Lot)respectively on Map 246. (see attached)

According to the above plan, Lot 4 contains 10,000 square feet. It is therefore my
understanding that the first zoning change that affected the buildability of this parcel was
the change to acre zoning on March 1, 1985.
Conveyancing History
Locus:
Lot 4 (parcel 246-88-1) is presently owned by the Preparatory Realty Trust,
Thomas N. George, Trustee,by virtue of a deed dated December 10, 1990 and recorded at
Book 7381,Page 319. The previous owner, Seagull Research Foundation Trust, Martin
C. Traywick and Kay W. Traywick,Trustees,purchased this lot as well as the abutting
Lots 5 and 6 from Harold E. Magee, Guardian of Dorothy Fawcett by a deed dated July
15, 1986 which is recorded at Book 5199,Page 51.
Abutters:
Lot 5 (parcel 246-88-2)with buildings thereon, was conveyed to Martin C.
Traywick by virtue of a deed dated March 28,2002 and recorded at Book 14989,Page
125. The previous owner, Thomas N. George,purchased the property by a deed dated
December 10, 1990 and recorded at Book 7381,Page 321. The previous owner to that
transaction, Kay W. Traywick,purchased the property by a deed dated September 5, 1986
from Seagull Research Foundation Trust, Martin C. Traywick and Kay W. Traywick,
Trustees and recorded at Book 5294, Page 032.
Lot 6(parcel 246-88-3) was conveyed to Robert D. Witham and Carol E.
Witham by virtue of a deed dated October 1, 1991 from Martin C. Traywick as an
individual, and recorded at Book 7733,Page 087 and this lot has since and remains in
separate ownership from the Locus. Martin C. Traywick obtained ownership of the lot by
virtue of a deed dated October 1, 1991 from Thomas N. George which was recorded in
Book 7733, Page 86. Thomas George obtained ownership by virtue of a deed dated
December 10, 1990 recorded in Book 7381, Page 321. The previous owner to that
transaction, Kay W. Traywick,purchased the property by a deed dated September 5, 1986
from Seagull Research Foundation Trust, Martin C. Traywick and Kay W. Traywick,
Trustees and recorded at Book 5294, Page 032. Their ownership is reflected in the
original deed cited above from McGee and Fawcett dated July 15, 1986.
An Unnumbered lot(McGurk Lot) (parcel 246-87)abuts the Northern line of
Locus. This lot has been in the McGurk family since September 6, 1960 by virtue of a
deed recorded in Book 1092, Page 301 (see attached) and this lot has since remained in
separate ownership from the Locus. It has never been owned by the owner of Locus or his
predecessors.

SUMMARY
The plan recorded as noted above was signed as an"Approval Not Required"plan
on February 25, 1985 which was prior to the change of zoning to one acre minimum lots.
As such, its protection from zoning change falls under Mass. Gen. L. Ch. 40A, s.6, ss 4,
which states:
If a definitive plan, or a preliminary plan followed within seven months by a definitive
plan, is submitted to a planing board for approval under the subdivision control law, and
written notice of such submission has been given to the city or town clerk before the
effective date of ordinance or by-law,the land shown on such plan shall be governed by
the applicable provisions of the zoning ordinance or by-law, if any, in effect at the time of
the first such submission...and,if such definitive plan or an amendment thereof is finally
approved, for eight years from the date of endorsement of such approval
Lots 5 and 6 did not merge even though they were owned by the same entity for a
period of time exceeding five years since they do not abut in the legal sense. "Lots that
meet only at a single point, in the fashion of similarly colored squares on a checkerboard,
are not deemed"adjoining"lots". Sturges v. Town of Chilmark, 380 Mass. 246, 260-261
(1980).
Lots 4, 5 and 6 did not merge as they were protected for a period of eight years by
the above statute and were not commonly owned prior to the expiration date of March 1,
1993. Lot 6 was sold to the Withams in 1991.
Lot 4 and 5 did not merge as they were in separate ownership in 1986.
By the above analysis, it is my opinion that the Locus,namely Lot 4, is a legal
building lot for a single-family residence in the Town of Barnstable.
