It is such a frequent question that our Applications Specialists want to put in our Catalog and/or Instructions sheets for ongoing reference and elimination of these frequent phone calls on it. For us to put in a publication rather than by a specific question to Applications, I would want to pass by you one more time to make sure there wasn't something missing in our communications. What we want to state is something like this: "UL Listed Heat Detectors are suitable for installation in ambients that are not less than 22C below OC." Note that there would be is no specific identification of an upper ambient installation temperature limit because that would be an obvious condition of the trip temperature of the Heat Detector. Also, as such, we would use this statement in reference to any Heat Detector that we sell either now or in the near or far future, Please confirm or advise any qualifications we should make. The following sets forth the basis for these statements. i Zoning Matters The Property is located in the RB zoning district of the Town of Barnstable. Under the Town's zoning ordinance, properties in the RB zoning district must have a minimum lot size of one acre (43,560 square feet) and a lot width of 100 feet. The Property is approximately2 16,000 square feet or about 0.37 acres which is less than the one acre minimum lot size. However, the Property is grandfathered and need not comply with the one, acre minimum if the "lot' has 50 feet of frontage, 5,000 square feet of area, complied with zoning at the time of the zoning change which first made the Property non-conforming, and was not held in common ownership with adjacent land on or after the date of the zoning change. See M.G.L. ch. 40A, Sec. 6; Barnstable Zoning Ordinance at 4-4.2. My review of the title history for the Property demonstrates that the land is grandfathered. In particular, the Property actually consists of four smaller parcels which are shown as Lots 158, 160, 162 and 164, on a plan of land of land recorded in the Barnstable Country Registry of Deeds at Plan Book 205, Pg. 601 (Block A, Section A). The Property was deeded by Mr. Morse to Frank W. and Katherine A. Reilly in 1945 (Book 628, Page 367). In this deed, the Property is described as being 160 feet (along Third Avenue) by 100 feet (along Pine Street) for a total of 16,000. My research shows only two other documents in the chain of title which are an estate tax lien release in 1981 for Frank W. Reilly (Book 3346, Page 280) and a death certificate for Katherine A. Reilly (Book 9661, Page 53).3 Since the Property has over 50 feet of frontage and over 5,000 square feet of area, the property is grandfathered from area requirements unless it was held in common ownership with adjacent property after the time of a zoning change that made the Property non-conforming. Prior to the 1950s, zoning in Barnstable only addressed land use. Beginning in the early 1950s, the Town began to impose minimum lot size requirements. The RB district first required that a lot have a minimum size of 15,000 square feet. That requirement was increased to 43,560 square feet in the mid-1980s. Because a portion of the Property may have been taken by the Town to expand the roadway (see footnote 1), 1 have reviewed the title of adjacent property back to 1951 rather than the 1980s' to ensure that the Property was held in separate ownership when zoning first imposed a minimum lot size requirement. My review shows that the Property was held in separate ownership since at least 1951. Therefore, the Property can be built upon even though it does not meet the minimum lot size requirements_ Currently, the RB zoning district requires a minimum lot width of 100 feet_ "Lot width" is measured at the building setback of the "front" of the "lot." Barnstable Zoning Ordinance, Section 7_ When a "lot" abuts two streets, it must meet the "front yard" setback for both streets. Id. It is unclear as to whether the building commissioner will interpret the "lot width" requirement as applying in two directions to a lot that abuts on two streets. If he does so, the Property may not comply with current "lot width" requirements because, as mentioned previously, it appears that a portion of the "lot" may have been taken for the roadway which would reduce the "width" in one direction to less than 100 feet. However, because the Property was not held in common ownership prior to zoning in Barnstable, the Property should be exempt from this width requirement. See Barnstable Zoning Ordinance, Section 4-4.2 (expressly grandfathering properties from "lot width" requirements). Under the Title 5 regulations, a septic system must be setback ten feet from the property boundary and twenty feet from a foundation wall. in a recent matter in which I was involved, a four bedroom system was designed which occupied (including its reserves area) an area of approximately 100 feet by 10 feet. Thus, if a system was located parallel to Third Avenue on the Property,' an area of approximately 40 feet by 100 feet would be unbuildable to accommodate the system. Given 20 of the 40 feet are already unbuildable due to the 20 twenty foot setback, the buildable foot print area is approximately 50 feet by 130 feet (or 6,500 square feet). Alternatively, the proposed system could be constructed such that the system and reserve are placed with one portion along Pine and the other along third. This would reduce the length of the available building area, but would increase the width for a portion of the Property. Regardless of the configuration, you should be able to construct a three to four bedroom house with garage and maintain a reasonable yard area around the home.
