The Assessor's field card that cited.'1994 appears to be the year of reconstruction. f Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal No. 1997 - Carrington Variance-Sec'F 3-1.1(5)Bulk Regulations The structure is shown on an aerial photo taken in 1968 and the lot is cited in a deed references as being shown on a deed dated 3 August 1951, recorded in the Barnstable County Registry of Deeds Book 190, Page 123. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals April 2, 1997. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened May 14, 1997, at which time the Board granted the request with conditions. Board Members hearing this appeal were Gene Burman, Tom DeRiemer, Richard Boy, Elizabeth Nilsson, and Chairman Gail Nightingale John Milne,All Cape Engineering, represented George Carrington. Mr. & Mrs. Carrington were present. Hearing Summary: John Milne of All Cape Engineering explained that Lot 239 is a 50'x50'land locked lot which Mr. Carrington has owned for over 40 years. Lot 239 has a single family structure but Mr. Carrington has no legal right of access from the road to the house and has been using other people's land. He bought Lot 079 and is proposing to divide that land into two parcels and to include a 12 foot easement to be used as a driveway for Lot 239. According to Mr. Milne, Mr. Carrington is proposing to combine the new parcel to be known as Lot 2 with the locus to create one new lot that will be 22,62.0 sq.ft. The remaining parcel to be known as Lot 1 will be 46,478 sq.ft. Lot 1 needs zoning relief. Mr. Milne could not describe variance conditions pursuant to Chapter 40A, Section 10. As background, . Mr. Milne stated the property has been in separate ownership since 1957,when Mr. Carrington bought the property. One lot is in his name and one lot in the name of his wife. Public Comment: No one spoke in favor or in opposition. The Board Members further discussed the appeal. Chairman Gail Nightingale felt it would be a better use of the land as it is over one area of land and will allow a legal access to the back lot. Findings of Fact: At the Hearing of May 14, 1997,the Board unanimously found the following findings of fact as related to Appeal No. 1996-48: 1. The applicant is seeking a Variance pursuant to Section 3-1.1(5) Bulk Regulations. The applicant is proposing to divide the vacant lot shown on Map 246, Parcel 79 into two lots. The property is located at 67 and 75 Tobey Way, Hyannisport, MA. 2: The area of the proposed-Iot No. 1 conforms to the requirements of Zoning except that the shape exceeds Section 2-3.4, Lot Shape Factor of 22 and lacks the 100' lot width required in this zoning district. The lot width is approximately 97 feet. 3. The applicant seeks to take .052 acres of the proposed Lot No.2 and add it to the existing neighboring Parcel 239 to allow it to become more conforming. This would increase the tot size, plus the remaining lot would still conform to lot size as that will be over one acre in size. The resulting lot would not meet the lot shape factor. 4: There is a single family dwelling of 1,262 sq. ft. on the lot that has existed there since July 18, 1957 and is exempt-from Zoning. • 5. Granti lot shape factor and lot width and allowing a section ng.the variance relief being sought for the of Lot 2 to merge with this lot would not be detrimental to the neighborhood affected and is an attempt to make the lot more conforming and thus be in the best interest of the town. 6. Granting the relief being sought would not be in derogation of the sprit and intent of the Town of Barnstable Zoning Ordinance,. 7. No findings are made pursuant to Chapter 40A, Section 10. Lot 2 of the above referenced plan shall be united with Parcel No. 239 and held in common ownership. 3. Any development of the proposed Lots No. 1 and 2 shall not be located within 150 feet of the wetlands. 4. The lot,which measures 50 feet by 50 feet square, is land locked and has no frontage. It is accessed by an easement drive from.Tobey Way across three lots. • Lot No. 079 is a 1.62 acre lot that is vacant and measures some 717 feet deep by 96 feet fronting on to Tobey Way. Zoning for this area of the Town, Hyannisport, was originally passed on March 7-8, 1949 as Town Meeting Article 75. Zoning at that time required 7,500 sq.ft. except as provided for in Article 75. Today, the area is zoned RB Residential B Zoning District, where there is a minimum area requirement of one acre, and 20' required frontage. Applicants Request: The applicant is proposing to divided the vacant lot, Map 246, Parcel 79 into two lots, as per a plan titled "Preliminary Plan of Land in Hyannisport, MA for George Carrington dated March 1, 1997, showing: • Lot No. 1: The area of the proposed'Lot No..1 of this plan conforms to the requirements of Zoning except that the shape exceeds Section 2-3.4, Lot Shape Factor. (The proposed lot exceeds a Lot Shape Factor of 22)and it appears to lack the 100' lot width required in this zoning district. • Lot No. 2: The proposed .052 acre Lot No. 2 shown on this plan is being proposed to be added into the existing neighboring Parcel 239. This will increase the size of the existing developed lot to 0.57 acres, providing added lot area for the home and a defined 12' easement to the home. To legitimize the proposed new undersized Lot, the applicant is seeking a Variance to Section 3-1.1(5) Bulk Regulations-Minimum Lot Area and Section 2-3.4 Lot Shape Factor. Lot and Development History: According to the applicant and his engineer, the structure located on Parcel 239 dates to the mid 1940's. According to a previous Assessors Card on the structure, it notes 1957 as the year the structure was built. It appears the structure was a seasonal cottage that was later improved into a year round single family dwelling. The Assessor's field card that cited*1994 appears to be the year of reconstruction. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals April 2, 1997. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened May 14, 1997, at which time the Board granted the request with conditions. Board Members hearing this appeal were Gene Burman, Tom DeRiemer, Richard Boy, Elizabeth Nilsson, and Chairman Gail Nightingale John Milne,All Cape Engineering, represented George Carrington. Mr. & Mrs. Carrington were present Hearing Summary: John Milne of All Cape Engineering explained that Lot 239 is a 50'x5O' land locked lot which Mr. Carrington has owned for over 40 years. Lot 239 has a single family structure but Mr. Carrington has no legal right of access from the road to the house and has been using other people's land. He bought Lot 079 and is proposing to divide that land into two parcels and to include a 12 foot easement to be used as a driveway for Lot 239. According to Mr. Milne, Mr. Carrington is proposing to combine the new parcel to be known as Lot 2 with the locus to create one new lot that will be 22,620 sq.ft The remaining parcel to be known as Lot 1 will be 46,478 sq.fL Lot 1 needs zoning relief. Mr. Milne could not describe variance conditions pursuant to Chapter 40A, Section 10. As background, Mr. Milne stated the property has been in separate ownership since 1957,when Mr. Carrington bought the property. One lot is in his name and one lot in the name of his wife. Public Comment: No one spoke in favor or in opposition. The Board Members further discussed the appeal. Chairman Gail Nightingale felt it would be a better use of the land as it is over one area of land and will allow a legal access to the back lot Findings of Fact: At the Hearing of May 14, 1997, the Board unanimously found the following findings of fact as related to Appeal No. 1996-48: 1. The applicant is seeking a Variance pursuant to Section 3-1.1(5) Bulk Regulations. The applicant is proposing to divide the vacant lot shown on Map 246, Parcel 79 into two lots. The property is located at 67 and 75 Tobey Way, Hyannisport, MA. 2: The area of the proposed Lot No. 1 conforms to the requirements of Zoning except that the shape exceeds Section 2-3.4, Lot Shape Factor of 22 and lacks the 100' lot width required in this zoning district The lot width is approximately 97 feet 3. The applicant seeks to take'.052 acres of the proposed Lot No. 2 and add it to the existing neighboring Parcel 239 to allow it to become more conforming. This would increase the lot size, plus the remaining lot would still conform to lot size as that will be over one acre in size. The resulting lot would not meet the lot shape factor. 4. There is a single family dwelling of 1,262 sq. ft. on the lot that has existed there since July 18, 1957 and is exempt from Zoning. 5.
