At the hearing, the Board of Health members directed the Health Agent, Thomas McKean, to conduct further investigations in order to determine what may have caused your septic system to fail at 45 Uncle Al's Way (aka 102 Uncle Al's Way). The results of the investigation are as follows: (1) According to a water usage report obtained from the Barnstable Water Company, the amount of water used at this property had significantly increased beyond that which the septic system could sustain. These records indicate that 12,500 cubic feet of water was used during a recent 90 day period in 1996 as compared to only 6,250 cubic feet during a 90 day period in 1993.- This calculates to more than 1,000 gallons per day on the average during that recent period in 1996. The septic system was designed to handle only 330 gallons per day. (2) In October, Cape Cod Commission announced that Cape Cod is heading toward record rainfall records and ground level records. This may have or this may not have contributed the failure of your septic system. However, according to the septic system plans prepared by a professional engineer, a five feet adjustment was made to increase the installation height of the septic system to prevent failure of the system during high groundwater events. malone}2 (3) The question remains whether this dwelling is being used as a two family house or a one family house. You testified at the hearing that this is not a two family dwelling. However, you later testified that you finished the lower level of the house, without a building permit, then allowed resident/residents to live in the lower level. Health Inspector Jerome Dunning also provided information to the Health Agent, Thomas McKean, that there are two driveways at this home, one on each side of the dwelling. Although, it is not clear to us at this time whether or not this dwelling is being used as a two-family home, excessive water usage records in recent months cause us to question this further. In conclusion, the Health Agent had ordered you to contact a licensed disposal works installer within seven (7) days of your receipt of the certified letter dated September 25, 1996 dated received by you on September 27, 1996. To date, no plans were received from you at the Public Health Division Office. Please contact Thomas McKean at 790-6265 to provide him information as to your intent in complying with this order. Failure to comply with this order will result in a Board of Health hearing on January 7, 1996 at 7:00 P.M. in the second floor Conference Room, Town Hall, 367 Main Street, Hyannis.
